초록

영국, 싱가포르, 호주 등 금융선진국과 나란히 우리나라도 2019. 4. 1. 금융혁신지원 특별법을 시행하여 금융규제 샌드박스 제도를 전면 도입하였으며, 지금까지 32건의 혁신금융 서비스가 지정되어 본격적인 금융규제 샌드박스의 실현을 지켜볼 수 있게 되었다.
그런데 이러한 제도 도입으로 혁신적인 금융서비스의 출현이 가능하게 되었다는 점에서 긍정적인 측면이 있으나, 이러한 혁신금융서비스의 영업과정에서 금융소비자의 피해가 발생할 수 있다는 부정적 측면도 간과해서는 아니될 것으로 보인다.
따라서 조만간 혁신금융 서비스로 지정을 받은 사업들이 등장하게 되고 이러한 서비스의 운영 과정에서 소비자 피해가 발생할 가능성은 충분히 제기되는 만큼, 현재 금융규제 샌드박스의 소비자 보호방안이 적절히 마련되어 있는지 이에 대한 검토가 필요하다고 본다.
이러한 점을 고려하여 본 논문에서는 금융혁신지원 특별법의 전반적인 소비자 보호방안에 대해 살펴보고, 동 법의 모태가 된 영국, 호주의 규제 샌드박스 소비자 보호방안을 검토해 본 후, 향후 금융규제 샌드박스를 이용하는 소비자 보호를 위하여 필요한 개선방안에 대해서 논의해 보고자 한다.

영어초록

The Korean government introduced a legislation called the Financial Innovation Support Act (the “FinISA”), which took effect from April 1, 2019, with an intention to lay the legal foundation to introduce a financial regulatory sandbox, which is already implemented and operated in the UK, Singapore, Australia, etc, where FinTech firms may test their new products and services without certain regulatory oversight pursuant to exemptions for a limited period of time. As of now, a total of 32 innovative financial firms have been exempted from regulatory guidelines under the move, thereby allowing us to observe the actual operation of the financial regulatory sandbox in the FinTech industry.
The implementation of the financial regulatory sandbox has some positive aspects in that it allows existing financial services institutions to develop, market and sell a variety of financial products and services by easing the burdensome regulations and strict control over business activities. However, one of its negative aspects that damages may be incurred to financial customers in the operation of the innovative financial services should not be overlooked.
There is a necessity to review whether there are measures in place to protect financial customers under the financial regulatory sandbox as a possibility that damages may be incurred to financial customers during the operation of businesses that have been designated as innovative financial services has been raised sufficiently.
In consideration of the foregoing, this Article aims to discuss ways to improve the current customer protection measures in place in order to protect customers using the financial regulatory sandbox, after reviewing the general customer protections measures in place under the FinISA and the customer protection measures in place under the financial regulatory sandbox implemented in the UK and Australia, where the concept of the financial regulatory sandbox which forms the basis of the FinISA has derived from.
