소비자전문상담사 활성화를 위한 소비자기본법의 개정방향 (Policy Direction of an Amendment to the Consumer Basic Act for a Consumer-Specialized Counselor)

초록

2003년 소비자전문상담사 1회 시험을 시작으로 국가기술자격법에 의한 소비자전문상담사가 배출되기 시작하였다. 그러나 소비자전문상담사 시험은 소비자기본법상 근거 규정없이 국가기술자격법에 따라 시행됨으로써, 소비자상담 자격제도가 상담 수준 개선을 위한 수단으로 활성화되지 못하였던 것이 현실이다. 즉, 소비자상담 자격제도가 소비자기본법과 유리되어 존재함으로써, 자격시험 통과자를 상담 기관에 어떻게 활용할지, 자격시험 통과자가 어떤 능력을 갖추고 어떤 업무를 수행할지 또 변화하는 상담 업무에 어떻게 적응토록 할지 등이 마련되지 못하며, 이는 곧 상담서비스의 개선 또는 향상에 자격제도가 역할을 하기 어려움을 의미한다.
소비자전문상담사 활성화를 위해서는 소비자기본법에 그 근거기준을 명시하고, 정부차원에서 소비자전문상담사를 활성화 하려는 노력이 필요하다. 이에 본 연구에서는 현재 소비자전문상담사 제도에 대한 현황과 유사 자격제도를 검토하여 소비자전문상담사 제도의 문제점을 분석하고, 이를 토대로 소비자전문상담사 활성화를 위한 소비자기본법의 개정방향을 제시하였다.
본 연구에서 제안하는 주된 방향은 다음과 같다.
첫째, 현재 국가기술자격법에 규정되어 있는 소비자전문상담사 관련규정을 소비자기본법에 명시하여 그 자격의 질을 관리한다. 둘째, 각 지방자치단체의 조례를 근거로 전국 17개 시도에 설치되어 있는 소비생활센터 설치 관련 규정을 소비자기본법에 명시하고, 이를 시군구에까지 확대하며 소비자전문상담사 고용을 의무화함으로써 군소단위에 이르기까지 각 지역 소비자들이 소비자복지향상의 기회를 갖도록 한다. 셋째, 소비자전문상담사 자격을 취득한 이후에도 정규적인 보수교육을 통해 소비자 중심시대에 맞게 소비자업무담당자 능력의 질적 향상을 도모한다. 넷째, 민간기업의 소비자상담 관련 부서에서도 소비자전문상담사를 고용할 것을 권고한다.

영어초록

Consumer-specialized counselor have been authorized pursuant to the Act on National Technical Licenses since the start of the first consumer- specialized counselors exam in 2003. However, as the consumer-specialized counselor exam was enforced pursuant to the Act on National Technical Licenses without any basis under the Consumer Basic Act, the current situation sees no empowerment in the license system on consumer counseling as a means to improve the level of counseling. The consumer counseling system is separated into the Consumer Basic Act and it is difficult to establish the consumer-specialized counselor in the right position and to educate them for a continuously changing market. More progress is needed in the development of the consumer counseling system.
It is necessary to provide a basis in the Consumer Basic Act and make an effort to activate the role of the consumer-specialized counselor at the governmental level. This study presented the direction of amendments to the Consumer Basic Act to activate the role of the consumer- specialized counselor based on a review of the current situation of the present consumer-specialized counselor system the background of similar license systems, and an analysis of the problems in the consumer-specialized counselor scheme.
The main policy directions of this study are as follows: First, to manage the quality of the licenses, it is necessary to stipulate the related provisions of the consumer-specialized counselor provided for in the current Act on National Technical Licenses and in the Consumer Basic Act. Second, it is necessary to specify the related provisions to establish the Consumer Affairs center installed in 17 Korean cities and provinces on the basis of the rules in each of the self-governing bodies in the Consumer Basic Act and expand it to the level of cities, districts, and counties to provide small local areas the opportunity to improve the welfare of consumers. Third, after the acquisition of a consumer-specialized counselor license, it is necessary to help enhance the ability of the counselor in charge of consumers to understand changes in the consumer- oriented era through regular supplementary training. Fourth, the employment of a consumer- specialized counselor in a department related to the consumer counseling of a private companies is recommended.
