토지 조성과 사실상 지목변경 취득세 체계 개선방안 (Improvement of Land Construction and the Acquisition Tax System for Land Change)

초록

지방세법은 “지목을 사실상 변경함으로써 그 가액이 증가한 경우”이는 취득으로 보아 간주취득세를 부과하도록 제도를 운영하고 있다. 공부상 지목변경을 수반하지 않더라도 사실상 지목이 변경된 경우 지목변경으로 보아 취득세를 과세하도록 하고 있다. 또한, 간주취득세 과세대상으로 지목변경은 이전등기와관계없이 가액 증가를 취득의 요소로 간주하여 취득의 개념을 확장하고 있다.
현행 지목 변경 취득세의 과세 문제는 사실상 지목변경에 대한 과세의 문제, 토지 조성에 대한 지목변경 과세의 문제, 토지 취득과세의 구조적 한계점을 들 수 있다. 이러한 문제를 개선하기 위해서는 사실상지목변경에 따른 토지 과세체계 재정립이 필요하다. 지목변경 취득 과세요건을 ｢공간정보의 구축 및 관리등에 관한 법률｣ 시행령 제67조의 지목변경 신청의 경우 취득으로 보도록 규정하고, 지목변경 신청이 없더라도 대통령령으로 정하는 지목을 사실상 변경하는 경우는 취득으로 보도록 규정하는 것이다. 또한, 토지의 형질 변경 등이 발생하여 일시적으로 지목이 변경 되었으나 1년이 경과하도록 원상회복되지 않은 경우 또는 원상회복이 불가능한 경우는 사실상 지목이 변경된 것으로 보도록 규정하는 것이다.
한편, 취득의 개념을 보완하여, 취득의 개념에 토지조성에 따른 취득을 원시취득으로 규정하는 것이 필요하다. 간척에 의한 토지의 조성, 택지 및 산업단지 개발 등을 원시취득으로 편입하게 되는 경우, 납세의무, 과세표준, 취득의 시기는 기존의 토지의 조성에 따른 기준을 적용 받게 된다. 이와 같이 지목변경에 대한 근본적인 문제를 개선하기 위해서는 과세요건을 명확히 하는 방안으로 법 제도가 개선되어야 할 것이다.

영어초록

The Local Tax Act operates a system to impose deemed acquisition tax if the value of the land category is increased by virtually changing the land category.
Even if it is not accompanied by a change in the land category, the acquisition tax is imposed on the land category as the change in the land category. A change in the land category for deemed acquisition tax expands the concept of acquisition by considering the increase in value as an element of acquisition regardless of previous registration.
The taxation issues of the current land title change acquisition tax are actually the problem of taxation on land title change, the problem of land title change taxation on land construction, and structural limitations of land acquisition taxation. In order to improve these problems, it is necessary to re-establish the land taxation system due to the change of land title. In the case of an application for a change of land title under Article 67 of the Enforcement Decree of the Act on the Construction and Management of Spatial Information, the tax requirements for land title change are to be regarded as acquisition, and even if there is no application for a change of land title, the case where the land title prescribed by Presidential Decree is actually changed is to be regarded as acquisition. It is stipulated that the land title is temporarily changed due to a change in the nature of the land, but it is not restored after one year.
On the other hand, it is necessary to supplement the concept of acquisition and define the acquisition according to land formation as original acquisition in the concept of acquisition. In the case of incorporating land creation by reclamation, housing site and industrial complex development as original acquisition, the tax obligation, tax base, and the timing of acquisition are subject to the standards according to the existing land formation.
In order to improve the fundamental problem of the change of land category, the legal system should be improved as a way to clarify the taxation requirements.
