초록

이글은 루만의 국가이론에 관한 것이다. 우리는 국가를 자명한 것으로 여긴다. 그러나 곰곰이 따져 보면, 사람들이 다양한 의미로, 바꾸어 말해서 모호하게 국가라는 용어를 사용하고 있음을 알 수 있다.
루만의 국가이론은 출발점은 국가개념의 이러한 다양성 또는 모호성이다. 그는 이 모호성을 정치적 개념의 시대착오성이라는 보다 일반적인 관점에서 바라본다. 그에 의하면 많은 정치학적 개념들은 노쇠하여 현실을 제대로 설명할 수 없다. 그럼에도 불구하고 여전히 이러한 개념들이 사용되고 있는데 문제가 있다는 것이다. 따라서 관건은 오늘날의 사회 실상, 곧 기능적으로 분화된 사회에 걸맞게 개념을 명료화하는데 있다.
루만은 국가개념과 관련해서도 사정은 다르지 않다고 한다. 따라서 그의 국가이론의 핵심은 국가 개념을 명료화하는데 있다. 그는 정치학은 이를 수행할 능력이 없다고 하면서 이제 사회학이 나서야 할 때라고 주장한다. 사회학적 관점의 특징은 ‘분화’의 이론을 국가개념에 적용시키는데 있다. 국가개념은 분화의 차원에 따라 다르게 사용되고 있다는 것이다. 즉, 기능적 분화의 차원에서 국가는 정치체계를, 정치체계의 내적 분화의 차원에서 국가는 국가조직을, 그리고 세계정치체계의 차원에서 국가는 영토국가를 의미한다는 것이다. 이처럼 루만은 국가개념의 다(多)차원성을 밝힘으로써 국가개념의 모호성을 해결했다고 주장한다.
많은 논평자들은 루만의 국가이론이 모순적이라고 비판한다. 실제로 모순적인 진술들이 많이 발견된다. 그러나 그의 참된 의도는 국가개념이 모순적으로 사용되고 있다는 것을 밝힘으로써, 역설적이게도 국가개념이 명료해진다는데 있는 것 같다. 이런 경우에는 국가를 의미론으로, 저런 경우에는 그것을 정치체계의 중심조직으로, 또 다른 경우에는 세계정치의 행위주체로 봐야 한다는 것이다.

영어초록

This paper deals with Luhmann’s theory of the state. We consider the state as obvious. But thinking over the concept more deeply, we tend to use it in somewhat ambiguous way.
This conceptual diversity or ambiguity of the state is a starting point of Luhmann’s theory of the state. He observes this ambiguity in more general view of the obsolescence of political concepts. According to him, many of those concepts are too obsolescent to explain the reality of today’s politics. The problem lies in the fact that they are still in use. Therefore, the most important thing is to refine such mis-used political concepts into appropriate concepts which can be well harmonized with today’s social reality in which our society is functionally well-differentiated.
Luhmann also argues that the concept of the state copes with not much different situation. Shortly, the core of his theory of the state lies in the clarification of its concept. He claims that sociology should take this academic burden since political science has no more ability to do it. The sociological perspective is characterized by the application of the differentiation theory to the concept of the state. In the dimension of functional differentiation, the state means the political system while in the dimension of the internal differentiation of the political system it indicates the state organizations and in the dimension of the world political system it refers to a territorial nation-state. Showing such multi-dimensional characteristics of the state, he argues, he can solve the problem of ambiguity inherent in the concept of the state.
However, many critics maintain that Luhmann’s theory of the state contains contradictory statements. In fact, we can find some evidences for such critics throughout Lumann’s works. However, what he really intend is paradoxically to clarify the concept of the state by revealing its ambiguous usage. He argues that we must consider the state as semantics in one case, as the central organizations of the political system in another case, and as the action-subject of the world political system in the other case.
