성매매특별법상 자발적 성매매행위의 비범죄화 가능성 고찰 (Review on possibility of decriminalization on voluntary sexual traffic according to the Act on the Punishment of Acts of Arranging Sexual Traffic)

초록

최근 우리 헌법재판소는 성매매특별법 제21조 제1항에 대한 위헌심판사건 선고를 앞두고 있고, 국제엠네스티는 2015년 8월 영국 더블린에서 개최한 국제대의원총회(International Council Meeting)에서 합의에 의한 성매매행위의 비범죄화를 권고하는 등, 국내외에서 자발적 성매매의 비범죄화 논쟁은 점점 뜨거워지고 있다. 그런데 자발적 성매매의 비범죄화를 사회구조 및 형사정책적인 관점에서 접근하는 것만으로는 해결의 실마리를 찾을 수 없다. 그래서 본문에서는 보호법익적 관점에서 비범죄화 가능성을 확인하였다. 인권이나 인간의 존엄성은 그 내용의 공허함으로 인해 보호법익이 될 수 없음을 논증했으며, 성풍속은 사회일반의 성적 감정의 집적으로써 범죄화로 인해 침해되는 기본권과 비교하여 우위를 장담할 수 없음도 확인하였다. 한편 자의성구별에 대한 논란에도 불구하고, 성적자기결정권 또한 자발적 성매매행위의 보호법익이 될 수 없음을 논증하였다. 이처럼 자발적 성매매는 그 보호법익을 확인하기 어려운 범죄이다.
성매매는 실무상으로도 많은 문제점이 있다. 낮은 기소율과 가벼운 처벌, 그리고 존스쿨제도의 남용 등 형벌의 효과를 기대하기 어려운 실정이다. 이런 점에서 본 논문은 입법론으로 자발적 성매매의 비범죄화를 주장한다. 만약 건전한 성풍속에 대한 이해의 차이로 비범죄화에 대한 사회적 합의가 어렵다면, 성매매여성의 인권침해를 최소화하는 방향에서 자발적 성매매 및 생계형 성매매를 위법성조각사유로 규정하는 방안을 차선책으로 제시한다.

영어초록

Recently domestic and international debate on decriminalization of voluntary sexual traffic is intensified ever, such as the imminent decision by Korean Constitutional Court on the adjudication of constitutionality thereon according to paragraph 1, article 21 of the Act on the Punishment of Acts of Arranging Sexual Traffic, and the recommendation on decriminalization of consensual sexual traffic by international Amnesty at the International Council Meeting held in August 2015 at Dublin, Ireland etc. By the way, the approach to voluntary sexual traffic from the viewpoint of social structure and criminal policy only cannot provide any clue to the resolution thereof. In this record, this study confirmed the possibility of decriminalization from the viewpoint of benefits and protections of the law. This study demonstrates that human right or human dignity shall not become benefits and protections of the law due to inherent vacantness, and it is confirmed that sexual custom is the accumulated sexual emotion of the society, and the predominance thereof upon the basic right infringed by the criminalization cannot be asserted. Meanwhile, this study demonstrates that sexual self-determination right cannot become the protections of the law for voluntary sexual traffic, despite of the dispute on differentiation of arbitrariness. As such, voluntary sexual traffic is a crime for which the benefits and protections of the law are difficult to be verified.
Sexual traffic involves many problems in practice. The effect of punishments thereon can scarcely be anticipated due to low prosecution rate, light penalty and abuse of zone school system etc. In this regard, this thesis contends decriminalization of voluntary sexual traffic as theory of legislation. If the society cannot reach the consensus on social agreement of decriminalization due to the different understanding of sound sexual custom, the way of defining voluntary sexual traffic and sexual traffic for subsistence as circumstances precluding wrongfulness to the extent the infringement of human right of is minimized, is presented as the second-best solution.
