신재생에너지의 환경적 영향에 관한 법적 고찰 (A Legal Study on Environmental Impacts of the New and Renewable Energy)

초록

에너지와 환경이 연계된 지구적 현안이 지속적으로 제기되면서 신재생에너지가 유력한 대안으로 주목받고 있다. 화석연료 중심의 기존 에너지체계는 에너지원의 개발에서부터 에너지의 생산ㆍ공급ㆍ소비로 이어지는 순환 과정에서 환경에 많은 부작용을 초래하는 것으로 지적되었다. 이와 달리 신재생에너지는 환경친화적 에너지로 인식되고 있는데, 보급 중심의 국가 주도적 정책 하에서 그 환경적 영향에 대한 검토는 미흡한 상황이다.
신재생에너지는 단기적으로 관련 시설의 건설ㆍ제조 과정에서 오염물질을 배출함으로써 환경을 침해할 수 있지만, 중장기적으로 에너지에 의한 환경침해적 영향을 최소화할 수 있기 때문에, 환경적 비용을 감수하더라도 이를 확대할 필요가 있다는 점에 공감대가 형성되어 있는 것으로 짐작된다. 그러나 조력, 수력, 폐기물에너지 등 일부 신재생에너지원들은 환경침해적 성격이 보다 강하게 나타나고 있으며, 지역 경제의 훼손을 초래하고 사회적 갈등을 유발할 가능성이 높으므로, 신재생에너지법 등 관련 법령의 개정을 통해 이러한 문제들을 개선할 필요성이 있는 것으로 판단된다.
환경친화적인 신재생에너지의 보급을 확대하기 위해서는 일률적인 국가 주도적 정책에서 벗어나 국가와 시장이 그 역할을 적절히 분담할 필요가 있으며, 분산형전원 및 시민발전소 등의 도입을 통해 에너지 분야에서의 환경정의 실현을 위해 적극적으로 노력하여야 하고, 민주적 의사결정의 측면에서 신재생에너지 시설의 건설 과정에서 지역 주민 등 이해관계인의 참여를 보장하여야 할 것이다. 또한 공급의무화제도 및 에너지 보조금 제도의 설계ㆍ운용에 있어서 환경적 요소에 대한 고려가 강화되어야 할 필요가 있다고 본다. 나아가 근본적으로는 에너지법제와 환경법제의 정합성을 제고함으로써 에너지와 환경 그리고 경제가 상호 선순환하는 사회를 실현하여야 할 것이다.

영어초록

As the global pending issue linked with energy and environment is continuously raised, new renewable energy draws attention as a dominant alternative plan. The energy system centered on the existing fossil fuel was indicated to cause much side effect toward environment in the energy cycle of productionㆍsupplyㆍconsumption from the development of the energy source. Unlike this, new renewable energy is considered as eco-friendly energy, but under the leading policy controlled by the supplying country the examination on the environmental influence of the energy is insufficient.
Although new renewable energy can encroach on environment by discharging polluted substance in the constructionㆍmanufacture process of the related facilities on a short-term basis, since it can minimize the harmful influence on environment caused by energy on a mid and long-term basis, despite the acceptance of the environmental expenditure there might be the necessity to extend the use of it, which is sympathized with by the general public. However, Some new renewable energy sources such as tidal power, hydraulic power, and industrial waste energy show a stronger harmful character on environment. And these have a high possibility to cause damage to the local economy and to create social conflict, so it is considered that through the revision of the related laws and regulations such as the new renewable energy law, these problems should be improved.
In order to expand the distribution of eco-friendly the new renewable energy. it is necessary that the nation and the market should play its role properly by getting rid of the nation-leading uniform policy, strive aggressively to realize the environmental justice in the field of energy by introducing decentralized rural districts and civil power plant, and guarantee the participation of the interested parties such as the local residents in the light of democratic decision making in the construction process of the new renewable energy facilities. Also in the designㆍoperation of the mandatory supply system and energy subsidy system the consideration on the environmental factors might be reinforced. Furthermore, fundamentally by enhancing the compatibility between the energy legislation and environmental legislation, the nation and the market should realize a society where energy, environment, and economy as well mutually harmonize in a cycle.
