행정법상 비례의 원칙 ― 대법원 판례를 중심으로 ― (The principle of proportionality under administrative law - with emphasis on the precedents of the Supreme Court of Korea -)

초록

비례원칙은 독일 연방헌법재판소가 판시한 바와 같이 “모든 국가적 행동의 지배적인 지도 원칙”으로서 행정의 모든 영역에 타당한 일반원칙이라고 할 수 있다. 다만, 비례원칙은 그 개념의 추상성 등을 고려할 때 그 내용을 보다 구체화할 필요가 있는데, 우리 대법원의 비례원칙 심사기준에 관하여 학자들 간에 논의가 활발하지는 않으나 대체로 협의의 비례원칙이 주로 적용되고 있다는 평가를 받고 있다. 이는 대법원 판결이 헌법재판소 결정과 달리 구체적인 사실관계를 토대로 이루어진다는 점에 기인한다고 할 것이다.
이와 같은 상황 등을 기초로 이 글에서는 대법원 판례 등을 중심으로 행정법상 비례원칙에 대해 개괄적인 고찰을 하였다. 명령, 규칙 등을 대상으로 한 대법원의 비례원칙 심사는 헌법재판소에서 비례원칙에 따른 규범통제를 하는 것과 비슷한 방식으로 이루어지고 있는데, 반면에 구체적 처분에 대하여 재량권 남용 여부 등을 심사하는 행정법 영역에서는 구체적 사실관계를 기초로 하는 행정재판의 특성을 감안하여 협의의 비례원칙을 중심으로 간단한 비례원칙 심사를 하는 것으로 평가할 수 있다.
앞으로 개별사안의 특성을 반영한 비례원칙의 심사기준 등이 법원의 판결 등을 통하여 제대로 자리잡을 수 있도록 비례원칙의 성질과 내용 등에 대한 깊이 있는 연구를 계속할 필요가 있을 것이다.

영어초록

The principle of proportionality can be regarded as a general principle reasonably applicable to all areas of administration, as a “dominant guiding principle for all national actions”as adjudicated by the Federal Constitutional Court of Germany. Whereas the principle of proportionality needs to be concretized when the abstractness of its concept, etc. is considered, the criteria for examinationof the principle of proportionality of the Supreme Court of Korea have not been actively discussed by legal scholars. However, the Supreme Court of Korea is generally evaluated to have applied mostly the principle of proportionality in a narrow sense, which is thought to be caused by the fact that the judgment of the Supreme Court of Korea is rendered based on concrete facts of the case concerned, unlike the judgment of the Constitutional Court of Korea.
Based on the above understanding of the situation, etc., in this thesis general review of the principle of proportionality under administrative law is conducted with emphasis on the precedents of the Supreme Court of Korea. The Supreme Court examines the principle of proportionality in relation to orders, rules, etc. in a manner similar to the Constitutional Court’s control of norms under the principle of proportionality. On the other hand, it can be evaluated that, in the area of administrative law where it is examined whether discretionary authority, etc. are abused or not in taking a specific administrative measure, the Supreme Court has conducted a simple examination of the principle of proportionality with stress laid on the principle of proportionality in a narrow sense, in consideration of the characteristics of administrative adjudication that is rendered based on concrete facts of the case concerned.
In-depth research and study on the qualities, substance, etc. of the principle of proportionality would be necessary on a continuing basis, in order that the criteria, etc. for examination of the principle of proportionality reflecting the characteristics of each individual case may be properly settled in place through court’s judgments, etc.
