연예인표준계약상 배상책임보험에 관한 쟁점 (The Issue on Liability Insurance in Entertainer's Standard Contract)

초록

연예사업의 효율성을 제고하기 위하여 연예인은 매니지먼트사와 전속계약을 체결하고 상호 신뢰관계에 근거하여 연예인은 자신의 역량을 최고로 발휘하여 연예활동을 하고, 이에 반해 매니지먼트는 연예인의 연예활동을 수익모델로 하여 최대의 수익을 올릴 수 있도록 연예활동과 관련된 업무를 전반적으로 관리하는 서비스를 연예인에게 제공하게 될 것이다. 연예인과 매니지먼트사 사이에 체결하는 전속계약은 고용계약, 위임계약 또는 도급계약 등의 성질을 가진다. 그러므로 연예활동 중 생겨나는 연예인의 제3자에 대한 책임에 대하여 연예인과 전속사의 법적 책임문제가 관심의 대상이다. 고용관계라면 사용자로서 지휘감독체계에 있으므로 이에 근거한 사용자로서의 책임일 것이고, 연예인 전속계약이 일종의 도급계약이라면 역시나 도급인인 전속매니지먼트사가 사용자로서의 배상책임을 질 것이다.
연예인이 부담하게 되는 배상책임에는 계약상 책임과 불법행위 책임이 있다. 이때 연예활동과 직접적인 연관관계가 있는 연예인이 제3자에게 배상책임을 부담하여야 할 경우 연예인은 이를 해결하기 위하여 책임보험제도를 이용할 수 있다. 배상책임보험은 특정 활동 중 발생한 배상책임을 보험자에게 전가함으로써 개인책임을 분산시키는 역할을 하는 것인데, 연예인으로서 전문직업에 종사하는 과정에서 생겨나는 배상책임에 대하여는 전문직업인배상책임보험을 활용할 수 있다. 다만 연예인을 보호하기 위하여 이 보험제도를 명시적으로 표준계약서에 적시하고 이를 활용하면 연예활동이라는 예술적 급부행위를 함에 있어서 이로 인하여 발생할 수 있는 부담스러운 배상책임으로부터 일종의 안전장치를 마련하는 것이 될 것이다. 그 외에도 연예인의 생존권 보장차원에서 사회보험이나 공제 등을 잘 활용하여 연예인의 불안정한 생활에 대하여 보호받을 수 있는 길을 열어주어야 한다.

영어초록

In order to enhance the efficiency of the entertainment industry, an entertainer concludes an exclusive contract with the management agency and, based on mutual fiduciary relationship, engages in entertainment activities displaying his/her utmost competence, while the management agency provides an overall management service of entertainment activities related business for maximum profit with the entertainer’s activities as profit model. The exclusive contract concluded between the entertainer and the management agency has the property of employment contract, mandate contract or contract for work. At the center of attention is the issue of legal liability between the entertainer and the management agency on the entertainer's liability for a third party affected during entertainment activities. In relations of employment, as the user is under direction and supervision system, the liability is on the user based on this system; in case the entertainer's exclusive contract is a contract for work, the exclusive management agency, as the person who ordered work to be done, bears the liability for damage as the user.
The liability for damage that the entertainer bears includes contractual liability and tort liability. In case the entertainer in direct corelation with the entertainment activity is to bear liability for damage for a third party, the entertainment can make use of the liability insurance system as a resolution. Liability insurance disperses individual liability by transferring the liability for damages affected during a specific activity to the insurer. In case of liability for damages affected during a process of profession as entertainer, professional liability insurance can be utilized. The explicit mention of this insurance system in the standard contract for protecting the entertainer and its utilization can act as a safety device against burdensome liability for damages in the artistic performance(Leistung) called entertainment activity. In addition, protection for the unstable livelihood of the entertainer should be provided by utilizing social insurance or mutual aid system in consideration of the entertainer’s right to life.
