미국의 법령체계 및 입법절차상 시사점 (Laws and Ordinances System of the U.S. and Current Events Point of a Legislative proceedings)

초록

먼저 미국은 판례법주의 국가이지만, 오늘날 의회에서 제정된 실정법들이 판례법에 우선하는 효력을 가진다. 따라서 미국의 법령체계는 미국 연방헌법이 최고의 효력을 가지고, 미국 연방법률과 조약이 그 다음의 효력을 가지며, 미국 연방행정명령과 행정법규 및 행정규칙, 주 헌법, 주 법률, 주 행정법규와 행정규칙, 지방자치단체의 조례의 순서로 효력을 가진다.
다음으로 미국 의회에서의 입법절차를 살펴보면 상원과 하원의 법률안 제출, 상원과 하원의 소관 상임위원회로의 회부, 상원과 하원의 소위원회로 회부 및 심사와 전원위원회에 보고, 상원과 하원의 본회의 심사, 상원과 하원에서 통과된 법률안의 다른 원에 이송 및 심사, 상ㆍ하원의 법률안 통과여부가 반대의 결과일 때 양원협의위원회의 심사, 양원협의위원회의 조정, 상원과 하원 각 의장의 서명 및 대통령에게 이송, 대통령에게 법률안 이송 후, 10일 경과시 법률의 성립, 대통령이 법률안에 대해 서명 거부나 휴회 중에 서명하지 않고 10일이 경과시 상ㆍ하원 각각의 재적과반수 출석에 3분의 2 이상 득표하면 법률의 성립 등 여러 절차들을 거친다.
끝으로 미국 의회의 입법절차 중에서 신속하고 효율적으로 입법절차를 진행시키기 위한 법률안의 내용에 따른 의안대장 또는 의사목록 등재제도, 소위원회 심사배제 요청제도, 의사규칙 적용중지제도, 의회심사법에 의해 모든 행정기관이나 행정부처가 발한 법규성이 있는 규칙들에 대한 규범심사제도, 본회의의 상시 개최제도를 향후 우리나라의 의회에서 도입하는 것이 바람직하다. 또한 의회에서 폭 넓고 다양한 의견의 토론 및 개진을 위한 법률안을 복수 상임위원회에 회부하는 제도와 옴니버스 법률안제도도 향후 우리나라의 의회에서 도입하는 것이 바람직하다.

영어초록

First, the United States of America (hereinafter referred to as “the U.S.”) is a nation with the doctrine of stare decisis, but these days the positive law enacted by the U.S. Congress take precedence over the case law in the nation. Therefore, the Constitution of the U.S. has the highest effect in the laws and ordinances system of the U.S., followed by the U.S. federal laws & treaties, the U.S. federal executive orders & the U.S. administrative rules & the U.S. administrative regulations, the U.S. state constitutions & laws, the U.S. state administrative rules & state administrative regulations and the U.S. by-laws.
Next, Legislative proceedings of the U.S. Congress consist of the following item conducted and related to by the Senate and the House of Representatives including but not limited to submitting legislative bills, referring to any standing committee in jurisdiction and its subcommittee, reporting to the Committee of the Whole, evaluation at plenary session, transferring and evaluating bills passed either by the Senate or the House of Representatives to the other House, evaluation of the Conference Committee in the event of any rejection of a bill, coordination of by the Conference Committee, signing of the Chairman on bills from both Houses and transferring them to the President, establishment of law after 10 days from the date of transferring each bill, and establishment of law in the event that 10 days have passed from the date of that the President rejects signing on any bill or non-signing during a recess based on satisfying the attendance of majority of registered members from each House and acquiring votes in two-thirds.
Finally, it is recommended that the systems regarding the calendar registration by contents of a bill, request for abolition of evaluation by subcommittee, suspending the application of parliamentary rules, evaluation of legal norms issued by all and any administrative institutions or departments in accordance with the Congressional Review Act and holding plenary meetings temporarily are to be introduced by the National Assembly of the Republic of Korea henceforth in accordance with the contents of bills for fast and efficient implementation of legislative proceedings. It is also recommended for referring to two or more standing committees and for omnibus bills for widen discussion and statement.
