환경정보공개제도의 법률상 및 운영상의 문제에 관한 법적 검토 (A Study on the Operational and Legal Issues of the Environmental Information Disclosure in Korean Legal System)

초록

환경 문제가 국가적으로나 사회적으로 중요한 사안으로 등장하는 가운데 환경 정보 공개의 중요성은 날로 높아지고 있다. 국가나 공공기관이 중앙에서 통제하는 방식만으로는 근본적으로 환경 문제를 해결하는데 스스로 한계를 가지기 때문에 사회의 다양한 계층의 참여를 바탕으로 위해성에 대한 정확한 정보를 주민들에게 알리고 언제라도 그러한 정보에 접근 가능하도록 하며 이를 필요로 하는 이해당사자들에게 효과적으로 전달하는 과정이 매우 중요하게 되었다. 이러한 일련의 과정 속에서 중요한 역할을 하는 것이 바로 환경정보공개제도이다. 우리나라는 1996년 12월에 공공기관의 정보공개에 관한 법률이 제정되었고 1998년부터 시행되고 있다. 우리나라는 일반적인 정보공개제도를 도입하였기 때문에 특수 분야에 한하여 강화된 형태의 환경정보공개제도를 가지고 있지는 않다. 다만 개별 환경 법률에서 환경정보공개 규정에 근거하여 환경정보가 공개되고 있다. 이 논문에서는 일반적인 행정 정보공개제도 바탕 위에 환경정보공개제도가 어떻게 운영되고 있는지를 먼저 객관적으로 점검하고 분석한 후에 법률상⋅운영상의 문제점들을 도출해 보고 그에 대한 바람직한 개선방안을 모색해보고자 하였다. 환경정보공개에 대한 평가는 성공적 사례를 가지고 있는 미국의 제도와 비교⋅분석적 관점에서 분석하여 우리나라 환경정보공개상의 문제점을 개선하는데 도움이 될 만한 부분들을 개선방안에서 논하였다. 우리나라 환경정보공개제도상 지적되는 문제로는 비공개 사유의 불명확성, 정보제공 방식의 문제, 지방자치단체의 역할의 미흡, 위해정보 관리체계의 부재 등을 들 수 있다. 미국은 1995년 중반부터 모든 위해성 관리정책에 리스크 커뮤니케이션의 개념을 도입하여 가장 철저히 수행하고 있는 국가로 수용자 입장에서 작성된 정보의 제공하고 있으며, 위해정보 관리체계가 확립되어 있고, 데이터 통합화를 통한 정보 접근의 편의성을 구축하는 한편 비공개 정보의 엄격한 제한을 통해 가장 성공적으로 환경정보공개제도를 운영하는 나라로 자리매김하고 있다. 미국과 비교해 볼 때 우리나라의 위해정보전달 수준은 정보를 생산하고 제공하는 초기 단계로 파악된다. 우리나라도 리스크 커뮤니케이션 도입의 필요성을 절감하고 리스크 커뮤니케이션의 발전단계별로 우리가 추진 가능한 과제들을 도출하고 향후 정책에 반영하고 위해성관리체계를 구축하는 기반을 쌓아가는 것이 중요하다.

영어초록

The disclosure of environmental information is one of the critical rising issue in Korea. It is because we already experienced, through the accumulation of experiences on the environmental issues relating to source of pollution, that it is hard to solve the environmental problems in a way of central controling method, and thus informing accurate information to the local residents regarding risk information based on the participation of various people of all social stratum, always admitting the access to the information and an effective process for delivering such information to the person who needs it became very important. In such a series of processes, the environmental information disclosure system plays an important role. In Korea, Official Information Disclosure Act was enacted in 1996 and has been enforced since 1998. Since we have adopted generalized form of information disclosure system, we do not have intensified environmental information disclosure system in special areas so environmental information is disclosed based on each individual environmental laws. This paper is trying to identify each operational and legal issues of the Environmental Information Disclosure in Korean legal system after analyzing how the Environmental information disclosure system is operated under general information disclosure system in Korea and draws improvements in the conclusion. The evaluation of the environmental information disclosure system in Korea was discussed in terms of comparing American system which is highly evaluated as having successful cases for leading information disclosure system in the area of risk communication.
The United States is a country where the information disclosure system is carried out most thoroughly by introducing the concept of risk communication since the mid-1995. They provided the information in the user stand, and it has firmly established risk information management system, constructed the ease of access to information through data consolidation and strictly limited the closed information, which brought the country as the most successful country in environmental information disclosure system. Compared to the United States, the level of our environmental information disclosure system is identified as staying in the initial step in providing information. We should realize the necessity of applying elements of risk communication to the environmental information disclosure system and bring about available tasks that can be carried out in each level of risk communication through the environmental information disclosure system.
