초록

부동산 개발을 통해 이익이 발생하게 되면 그 이익을 공공의 목적을 위해 일부 환수해야한다는 개발이익환수의 요구로 1990년 개발이익환수에관한법률이 제정되었다. 그러나 모든 규범의 경우 제도화가 선행되는 것이 중요하지만 그에 못지않게 국민이 공감할 수 있도록 그 제도를 현실에 반영시키는 노력이 중요하다. 지금 우리 사회는 토지 공공성과 토지로부터 발생하는 개발이익 공유화에 대한 사회적 공론화가 여전히 부족한 상황이다. 이에 충분한 공론화를 바탕으로 사회적 합의를 도출한 다음 토지 이용, 계획, 보유, 개발, 처분, 관리 각 단계별로 토지 공공성을 실현할 수 있는 제도를 정밀하게 재설계해야 한다. 다만, 그 기초는 토지의 소유권과 토지이용의 자율성을 크게 훼손하지 않아야 하는 점도 잊어서는 아니된다. 정부의 수많은 부동산 정책에도 불구하고 그 정책들이 실패하는 근본적인 이유가 무엇일까에 대해서는 여러 견해가 있겠지만, 일관성 없는 부동산 정책과 투기를 잡겠다는 사고에 사로잡혀 규제위주의 정책만 줄기차게 밀어붙인 점이 가장 큰 요인일 것이다. 다만 그 이면에 있는 다른 본질적인 이유로서 수도권 중심의 경제력 배분구조가 문제라는 지적이 많다. 수도권을 중심으로 하는 투기 수요의 진입 욕구와 주택 수요의 집중은 서울과 경기도 및 인천의 공간적 수용성이 물리적으로 확장되지 않는 이상 그 욕구와 수요를 충족할 수 없다. 다른 지역의 부동산은 망해도 서울을 중심으로 하는 수도권 지역의 부동산은 불패라는 인식이 바뀌지 않는 이상 모든 부동산 정책은 무용지물이 될 수 있다. 또한 극단적으로 경기도와 서울에 더 이상 택지를 개발할 곳이 없고 오히려 충청도는 제2의 수도권으로 부상하면서 또 다른 지역 간 갈등을 야기하고 있는 것도 사실이다. 이런 점을 감안하면 진정한 부동산 정책은 국가균형개발을 통한 서울과 수도권의 경제력 집중을 지방으로 고르게 분산시키는 것임을 명심해야 할 것이다.

However, in the case of all norms, it is important that institutionalization precedes it, but it is equally important to make efforts to reflect the system in reality so that the public can sympathize with it. Currently, our society is still lacking in public opinion about the public nature of land and the sharing of development benefits from land. To this end, social consensus must be reached based on sufficient public opinion, and then the system that can realize land publicness in each stage of land use, planning, holding, development, disposal, and management must be precisely redesigned. However, it should not be forgotten that the foundation should not significantly damage the ownership of land and autonomy of land use. There are various opinions as to what is the root cause of the failure of the government's numerous real estate policies, but the biggest factor is that they were caught up in inconsistent real estate policies and the idea of ​​catching speculation and pushed only regulation-oriented policies. will be. However, as another essential reason behind it, many point out that the economic power distribution structure centered in the metropolitan area is a problem. The desire to enter the speculative demand centering on the metropolitan area and the concentration of housing demand cannot satisfy the desire and demand unless the spatial receptivity of Seoul, Gyeonggi-do and Incheon is physically expanded. Even if real estate in other regions fails, all real estate policies may become useless unless the perception that real estate in the metropolitan area centered on Seoul is invincible is not changed. In addition, it is also true that, in the extreme, there are no more places to develop housing sites in Gyeonggi-do and Seoul, and on the contrary, Chungcheong-do is rising as the second metropolitan area, causing conflicts between other regions. Considering this, it should be borne in mind that the realestate policy is to evenly distribute the concentration of economic power in Seoul and the metropolitan area through balanced national development to the provinces.
