재산권의 관점에서 본 개인정보와 빅데이터의 관계 (Relationship between personal information and big data from the perspective of property rights)

초록

빅데이터는 관련 기술의 발달로 바이오, 의료, 소셜미디어, 광고, 금융, 통신, 사물인터넷(IoT), 자율주행차 등 많은 분야에서 활용되고 있다. 그런데 빅데이터를 활용한 산업의 발전으로 막대한 부가 창출되고 있는 반면에 빅데이터의 기반이 된 개인정보의 제공 주체들이 소외될 우려도 점점 커지고 있다. 즉 빅데이터 기반 산업의 발전이 빅데이터를 가지고 있는 소수의 업체들에 독점됨으로 인해서 신규진입장벽을 형성하기도 하고 관련산업의 발전으로 개인의 일자리가 줄어들 우려도 커지고 있다. 이러한 산업이 의도하는 장밋빛 미래인 인간은 일을 덜하고 문화생활을 향유하는 행복한 삶이 아니라 많은 사람들이 일자리가 없어 극빈층으로 전락할 우려를 낳고 있는 것이다. 따라서 데이터 경제에서 개인정보 주체들이 보다 능동적인 지위를 획득 하여야 빅데이터 산업이 꿈꾸는 인간들의 행복한 미래가 올 것이다. 즉 개인정보주체들에게 개인정보와 빅데이터에 대한 보다 능동적인 지위를 부여할 필요성이 있다. 데이터 경제에 대한 지나친 낙관론을 경계하고 재산적 가치를 창출하는 개인정보의 과실이 정보주체인 개인에게 돌아갈 수 있는 방안을 모색해야 한다. 그렇다면 개인정보에 대한 재산적 가치는 어떤 형태로 데이터 생산자인 개인에게 보전될 수 있을 것인가? 우선 개인정보 내지 데이터는 데이터 경제의 범위에 들어가기 전과 후로 나누어 구분되어야 할 것이다. 데이터 경제의 범위에 들어가기 전에는 기존의 개인정보 내지 데이터의 종류에 따라 기존의 법체계로 수용하여야 할 것이다. 개인정보내지 데이터가 데이터 경제의 범위에 들어가면 기존의 물권이나 지식재산권과는 다른 유형인 데이터재산권이 성립하는 것으로 하여야 할 것이다. 데이터재산권은 배타적 지배권의 성격도 가지지 않고 사후적 수익권에 중점을 두는 권리로 이해하여야 할 것이다. 여기서 데이터재산권이 성립하게 되는 요건으로서 중요한 의미를 가지는 것이 개인정보 활용에 대한 동의이다. 따라서 개인정보주체에게 사후적 수익을 부여하는 개인정보 활용 동의의 의미가 중요해진다. 현재의 개인정보활용 동의는 개인이 그 내용을 정확하게 파악하기도 힘들 뿐만 아니라 그 효과도 개인이 정확하게 판단하기 힘들다. 그리고 이 부분에 대한 과도한 제약은 빅데이터를 활용하려는 기업에게도 장애요소로 작용할 수 있다. 그렇다면 이러한 동의의 의미를 개인정보의 활용에 대한 허락의 의미 이외에도 재산적 권리를 창출하는 사회적 합의 내지 계약으로 활용하는 방법을 고민할 필요가 있다. 그것은 개인정보 활용을 통해 발생하는 데이터재산권의 사후적 이익을 국가나 사회에 양도하는 계약으로 고려될 수 있을 것이다. 그리고 그 활용으로 생기는 이익은 개별적인 개인정보 주체에게 돌려주어야 하는 것이 아니라 국가와 사회의 관리하에 기본소득 등의 재원으로 활용하는 거나 복지재원으로 활용하는 방안 등을 생각할 수 있다. 이를 통해 빅데이터 회사들에게 개인정보 활용의 가능성을 더 넓게 열어주어 데이터 경제의 활성화를 추구할 수 있을 것이다.

영어초록

Big data is being used in many fields such as bio, medical, social media, advertising, finance, communication, Internet of Things (IoT), and self-driving cars due to the development of related technologies. The development of industries using big data is creating enormous wealth. On the other hand, there is a growing concern that the providers of personal information, which are the basis of big data, will be alienated. In other words, the development of big data-based industries is monopolized by a small number of companies that have big data, which creates barriers to new entry, and there is a growing concern that individual jobs will be reduced due to the development of related industries. The rosy future that the data economy intends is a happy life in which humans do less work and enjoy cultural life. However, on the contrary, many jobs are lost and the majority of people are raising concerns that they will fall into extreme poverty.
Therefore, there is a need to give personal information subjects a more active position on personal information or data. We must beware of over-optimism about the data economy. It is necessary to find a way to attribute the property value created through the use of personal information to the individual, the subject of information. Then, in what form can the property value of personal information be preserved for the individual, the data producer? First of all, personal information or data should be divided into before and after entering the scope of the data economy. Before entering the scope of the data economy, it will have to be accepted into the existing legal system depending on the type of existing personal information or data. If personal information or data falls within the scope of the data economy, it should be regarded as establishing 'data property rights', a type different from existing property rights or intellectual property rights. Data property rights should be understood as rights that do not have the characteristics of exclusive control and focus on ex-post beneficial rights. Consent to the use of personal information has an important meaning as a requirement for establishing data property rights. Therefore, the meaning of consent to use of personal information, which grants ex-post profits to the subject of personal information, becomes important. It is difficult for individuals to accurately understand the contents of the current consent to use personal information, and it is also difficult for individuals to accurately understand the effect. And excessive restrictions in this area can act as an obstacle for companies that want to utilize big data.
Then, it is necessary to think about how to utilize the meaning of such consent as a social agreement or contract that creates property rights in addition to the meaning of permission for the use of personal information. It can be considered as a contract that transfers ex-post benefits of data property rights generated through the use of personal information to the state or society. Profits generated from the utilization do not have to be returned to individual subjects of personal information, but can be used as financial resources such as basic income or welfare resources under the management of the state and society. Through this, it will be possible to open the possibility of using personal information to big data companies to promote the data economy.
