스마트 공유경제사회에서 빅데이터의 법률관계에 관한 小考 (An essay on the legal relationship with big data in the smart sharing economic society)

초록

생산방식이나 경제활동의 변화는 정치·사회와 법제도의 변화를 가져온다. 근대 민법 원리로서 사적 자치 원칙이 主唱되던 시대는 상공인 계층이 열었던 근세 자본주의 시대였으며 그들은 개인주의와 자본주의 경제체제를 선호하였다. 인터넷과 인공지능 기술의 발전으로 4차 산업혁명이 전개되면서 저비용의 맞춤형 제품생산이 구현되고 생산활동에 필요한 도구들이 공유(sharing)되면서 스마트 공유경제 시스템을 구현한다. 이러한 시스템에서 데이터는 자동화된 전자거래에서 의사소통(communication)의 도구이며, 빅데이터의 산출물인 판별식은 전체 산업에서 연구개발, 생산, 판매, 물류 및 유통, 마케팅을 실행하기 위한 중요한 소재이다.
여러 원천에서 생성된 빅데이터들이 융합되어 경제적 가치와 효용가치가 높아지며, 일반적으로 공유 플랫폼을 통해 개방적으로 수집·이용된다. 공유는 민법상 공유가 아니라 공동이용(sharing)이다. 빅데이터는 유체물로서 물건이 아니며, 저작물로 보호되는 컴퓨터프로그램이나 데이터베이스이 아니다. 빅데이터 거래의 법적 문제를 계약법상의 관점에서 해결할 수도 있지만 거래가 다중적이고 일시적으로 일어난다는 점에서 빅데이터에 대한 물권적 권리의 창설이 필요하다. 빅데이터의 활용이 프라이버시나 영업비밀을 포함한 타인의 권리를 침해할 가능성이 있으며, 광범위한 전파가능성으로 법익침해가 확대 재생산될 수 있어서 사전적인 예방이 중요하다. 따라서 빅데이터의 재산권 행사에는 공공질서에 부합되어야 한다. 공공복리나 사회질서는 거래의 불확실성을 제거하고 안전한 거래환경 조성을 한다. 따라서 이러한 시대에 스마트 시민이 자발적으로 사적자치와 함께 사적자치를 담보하기 위한 공공복리나 사회질서를 요구할 것이다.

영어초록

Changes in the means of production and the modes of economic activities lead to changes in politics societies and legal systems. The era in which the principle of private autonomy was advocated as the principle of modern civil law was the era of modern capitalism opened by commercial and industrial bourgeois, and they preferred the individualism and capitalist economic system. With the development of the Internet and artificial intelligence technology, the fourth industrial revolution has developed and low-costly customized production is realized. Tools necessary for the production activities are shared, thereby realizing the smart sharing economic system. In such a system, data is a tool for communication in automated electronic transactions, and the discriminant, calculated from big data, is an important material for executing R & D, production, sales, logistics, distribution and marketing in the whole industry.
Big data generated from various sources are converged to increase economic value and utility value, and they are generally collected and used openly through big data sharing platforms. Sharing big data is not the joint ownership in civil law, but rather a common use. Big data is not a physical object protected by the Korean civil law, and it is not a computer program or a database protected by Korean intellectual property laws. Although the legal problem of big data transactions can be solved from the viewpoint of contract law, it is necessary to establish the property rights to big data in that transactions are transient and multiple. The use of big data may infringe the rights of others, including privacy and trade secrets, and advanced prevention is important because infringement can be extended and reproduced as the result of wide propagation of big data. Therefore, property rights of big data must be exercised in compliance with public order. Public order eliminates the uncertainty of transactions and create a safe trading environment. Therefore, in this era, smart citizens will voluntarily demand not only private autonomy, but also public order to secure private autonomy.
