주거권 실현을 위한 주거비 지원의 법적 고찰 (A legal study on housing subsidy legislation for housing rights)

초록

주택보급율이 100%를 초과하였음에도 여전히 많은 사람들이 최저주거기준에 미달하는 열악한 주택에서 삶을 지속할 수밖에 없는 이유는 주거비를 감당할 소득능력, 즉 주거비 지불능력이 부족하기 때문이다. 이는 최저주거기준과 주거비 지불능력이 불가분의 관계에 있으며, 주거권 실현을 위한 주거복지 정책 중 주거 빈곤의 핵심적인 해결방법이 주거비 지원제도라는 사실을 의미하는 것이다. 이에 이 글은 주거권의 개념에 대한 정립을 바탕으로 주거부담이 크고, 주거수준 향상이 보다 절실하다고 할 수 있는 사회경제적 약자인 저소득가구의 주거비 지원 법제들을 검토하고, 실질적 주거권 향상을 위한 주거비 지원 법제의 개선점을 모색하는데 목적을 두고 있다.
주거비 지원 규정을 두고 있는 법률로는 「긴급복지지원법」, 「노인복지법」, 「주거급여법」, 「주택도시기금법」, 「한국주택금융공사법」 등이 있다. 이 법률 중 이 글에서는 일시적 지원이나, 노인 등 특정 대상에 한정한 지원이 아닌 경제적 상황에 기초하여 계속적으로 지원하는 제도에 관한 법률을 검토대상으로 하였다. 기초필수적인 주거복지를 위한 제도라고 할 수 있는 공공부조 제도를 규정한 「주거급여법」과 일반적인 주거복지 실현을 위한 주거비 지원 제도를 담고 있는 「주택도시기금법」, 「한국주택금융공사법」의 주거비 지원 제도를 중심으로 검토하고, 개선방안을 도출하였다.
우선, 예산을 보다 효율적으로 운영하고 체계적으로 지원하기 위하여 「주거급여법」, 「주택도시기금법」, 「한국주택금융공사법」상의 각 제도의 역할을 정비하고, 유사제도를 통합할 필요가 있다. 주거권 실현을 위해 주거비 지원 제도 자체를 마련하는 것도 중요하지만, 제도의 실효성 확보를 위해서는 마련된 주거비 지원 제도를 국민들이 이용할 수 있도록 하는 것이 필요하다.
나아가 주거권 실현을 위하여 주거비 보조제도는 다른 주거지원 정책 수단들과 연계할 필요가 있다. 예컨대, 임대료 지불이 어려운 최저소득층은 최저수준 이상의 주택공급을 받을 수 있도록 공공임대주택 지원과 함께, 주거급여, 저리의 전월세 자금 지원을 실시한다. 저소득층 중 주택구입능력이 부족한 계층은 주택구입을 지원하기 위하여 저렴한 공공주택 공급과 저리의 자금 지원이 필요하다. 중간소득층의 주거안정을 위해서는 공공 주택금융 지원제도와 함께 중소형 분양주택의 확대정책이 연계될 때 주거비 지원 효과가 제고될 수 있다.
생활이 어려운 주거급여 신청자들의 주거안정을 위해서는 주거급여의 신속한 지원이 필요하다. 신속한 주거급여 집행을 위해 처리기한 명시 등 세부적 절차를 행정입법의 형태로 마련할 필요가 있다. 또한 거동이 불편하거나 인지능력이 부족한 대상자들의 지원을 위하여 온라인 신청 제도의 활용과 「사회보장급여의 이용․제공 및 수급권자 발굴에 관한 법률」의 직권신청 활용도 필요하다. 주거비 지원의 공정성을 담보하고 지원 신청자의 권리강화를 위해 이유 부기와 청문 절차의 명시도 마련되어야 한다.
전달체계의 효율성을 제고를 위한 방안으로 2015년 12월 23일 시행된 「주거기본법」에 근거하여 ‘주거복지센터’를 기초지방자치단위로 설치하고, 주거복지센터에서 통합적으로 주거비 지원 정책을 수행하는 방안도 고려해 볼 수 있다. 제도의 통합 운영은 주거비 지원 제도를 유기적이고 통합적으로 판단할 수 있게 하여, 중복으로 마련된 제도를 제거하고, 제도 신청의 유도 및 지원 대상자의 발굴도 가능하게 할 것이다. 주거비 지원을 보다 체계적이고 효율적으로 시행하기 위하여 통합적인 주거비 지원 정책 수행이 필요하다.
권리구제는 수급권 행사에 따른 일련의 절차들이 법취지와 생존권 보장이라는 목적에 부합되게 진행되었는지 여부를 확인하고 나아가 위법, 부당한 처분에 의해 침해된 권리의 회복과 보장을 위해 중요하다. 특히 주거급여 수급권자의 결핍된 상황을 고려할 때 권리구제의 의미는 더욱 크다고 할 수 있다. 따라서 주거권 실현을 위한 주거비 지원제도의 권리구제절차를 개선할 필요가 있다. 주거급여 수급자의 의사에 반하는 권리행사의 지연 또는 해태가 발생되지 않도록 하기 위하여 수급권자에게 이유부기 등 정보제공의무가 강화되고, 권리구제 절차에 대한 명시가 필요하다. 그리고 주거급여 권리구제는 수급권자의 생존적 위기 해소와 관련된 점을 고려하여 신속하게 이루어 질 수 있도록 권리구제 기산점 및 제기기간, 처리기간에 대한 재조정이 필요하다. 또한 주거급여 등 주거복지 정책은 전문성과 기술적인 부분이 많다. 불복절차 심사기관도 전문적인 지식을 가지고 있어야 효율적이고 신속한 구제절차가 진행될 수 있으므로, 보다 객관적이고 공정한 권리구제를 위해 이를 전담할 심사기관과 인력규정을 입법적으로 보완할 필요가 있다.

영어초록

The housing supply ratio, which refers to the ratio of housing units relative to the number of household, is more than 100%, but there are a lot of people to live in poor homes do not meet the minimum housing standards, because of lack of income ability to afford housing expenses. This means that the minimum housing standards and housing expenses affordability are inseparable, and vital solution for housing poverty means to housing subsidy system.
The purpose of the study is to seek improvements of housing subsidy legislation for improving housing rights. Recently enacted Housing benefit Act separated from other benefits etc., our country is also interested in housing subsidy system. To actualize housing rights, it suggests the following improvements in this study.
Firstly, it is to clarify the relationship between the housing subsidy systems of various law needs to be improved so that people have easier access to the system. Housing Benefit Act as well as Korea Housing Finance Corporation Act and National Housing &Urban Funds Act are legislations about housing subsidy. However, there is no information that people can see an overview of the whole housing subsidy systems, the relationship between these systems is also unclear. So it is difficult to see if there are any housing subsidy systems.
They will be one of the plans to define clearly between them relations within a legal framework, consolidate similar systems and also to integrate the operating authority for the efficient operation.
Secondly, housing subsidy systems need a connection with other housing policy for stability of living and realization of housing rights. For example, housing subsidy so that they can be reflected in the real rents, amendment of law related with housing rent must be combined with housing subsidy system. Public housing offering will also be considered.
Thirdly, guarantees for specific procedures are required, such as processing period specified, stating clearly about decision and hearing procedure for enhancing applicant rights and stabilizing service delivery system. There is no regulation about processing period from applying to notifying decision and stating reason about disadvantageous action in current law. We need to establish the process of legal for respecting rule of law in realization of housing rights.
Fourthly, it is necessary to establish efficient delivery system for enhancing realization of housing welfare effects. Social welfare system is realized through delivery system. Delivery system is a series of relationship system connected to the needs and resources and service suppliers and demanders. Housing subsidy systems have different legal basis, but effectiveness of delivery system will be enhanced by operating of merging agencies.
Fifthly, to ensure housing welfare the most efficiently, in addition, it is necessary to guarantee administrative remedy. Administrative remedy will be able to recover rights which violated by illegal or unfair action. Generally, disadvantaged groups are difficult to recognize proceeding of administrative remedy and access it. In addition to, there is no regulation about it in Housing Benefit Act. So if anyone to need administrative remedy in the process, they should see other act like National Basic Living Security Act. This situation will lead to delay to exercise their rights and finally they can not exercise their rights against their will because of lapse of the period. Therefore, explicit procedure of administrative remedy need for enhancing accessibility and achieving the aim of administrative remedy. Housing policies such as housing benefit also have so much technical and expertise. So not only operating authorities but also authorities for administrative remedy have expertise. These should be strengthened legally.
Lastly, housing rights are prerequisite for guaranteing human dignity beyond a mere welfare. According to Housing Security Act, each and every human being should have their right to live adequate housing.
Overview of the housing subsidy system of other countries, it took more than 10 years before the time in earnest, and continue to change and improve the system. We will strive for continuous change and development, rather than expecting the housing subsidy system settled in a short time.
