일본 특허출원비공개제도의 도입과 시사점 (Introduction and Implications of the Non-Disclosure System for Patent Applications in Japan)

초록

일본정부는 대규모 사이버공격 및 국제 테러, 지정학적 긴장감 고조 등에 적극 대응하고자 금년 5월에 경제안전보장추진법을 제정하였다. 동법에는 국가와 국민의 안전을 확보한다는 취지하에 특정중요물자의 확보를 위한 연구개발, 그 연구개발의 성과물에 대한 특허출원 중에서 안전보장에 관한 발명을 공개하지 않는다는 특허출원비공개제도를 도입하였다.
동 제도는 일본특허청이 총괄하는 것이 아니라 내각부(내각총리대신)가 주관부서로서 전체업무를 총괄담당하고 있다. 특허청장은 특허출원일로부터 3개월 이전에 1차 심사하여 비공개 대상발명을 선정하여 내각총리대신에게 송부하고, 내각총리대신은 관련 기관과 협의하여 최종 비공개 대상발명을 선정한다. 비공개 대상발명으로 선정되면, 출원인은 내각총리대신의 허가를 받지 않고는 실시할 수 없고, 외국특허출원도 불가능하다.
우리나라는 특허법에서 “국방상 필요한 발명”에 한해서 정부(특허청장)가 비공개 및 외국출원을 금지하고 있지만, 일본은 내각부에서 내각총리대신이 비공개 대상발명의 선정 및 실시의 허가제, 위반시 강력한 벌칙을 적용하도록 규정하고 있다. 이러한 일본의 제도가 실시되는 경우에는 국방관련기술뿐만 아니라 넓은 의미에서의 경제안보에까지 적용되어 우리기업들에게도 소재, 부품, 장치 등의 원자재 확보에 큰 영향을 미칠 것으로 판단된다. 따라서 우리나라도 이에 대응할 수 있는 안보와 경제의 결합에 관한 기술개발을 적극 추진하는 정부정책이 필요하고, 그 연구 성과물로서 국방 관련기술 이외의 경제안보 관련기술의 특허출원에도 비공개제도의 도입을 적극 검토할 필요가 있다.

영어초록

The Japanese government enacted the Economic Security Promotion Act in May this year to actively respond to large-scale cyber attacks, international terrorism, and rising geopolitical tensions. The Act introduced a patent application non-disclosure system that does not disclose inventions related to security among patent applications for R&D and the results of R&D to secure specific important materials.
The Japanese Patent Office is not in charge of the system, but the Cabinet Office (the Prime Minister) is in charge of the overall affairs as the department in charge. The head of the Korean Intellectual Property Office shall conduct the first examination three months before the date of filing the patent application, select the non-disclosure target invention to send to the Prime Minister, and the Prime Minister shall select the final non-disclosure target invention in consultation with the relevant institution. If an invention is selected as a non-disclosure target invention, the applicant cannot apply without obtaining permission from the Prime Minister, and it is impossible to file a foreign patent application.
In Korea, the government (the head of the Korean Intellectual Property Office) prohibits private and foreign applications only for inventions necessary for national defense under the Patent Act, however in Japan, the Cabinet Office stipulates that the Prime Minister shall apply a permit system for the selection and implementation of the non-disclosure target invention, and strong penalties for violations. When such a Japanese system is implemented, it is expected to have a significant impact on securing raw materials such as materials, parts, and devices for Korean companies as it is applied not only to defense-related technologies but also to economic security in a broad sense. Therefore, Korea also needs a government policy that actively promotes the development of technologies related to the combination of security and economy, as a result of the research, it is necessary to actively consider the introduction of a non-disclosure system in patent applications for economic and security-related technologies other than defense-related technologies.
