대륙붕한계 문서제출 사례분석 및 우리의 대응방안 연구 (Our Proposal on CLCS Submission Based on Case Studies)

초록

1982년 유엔해양법협약 제2부속서 제4조에 따라 동 협약이 발효한 1994년 11월 16일부터 10년 후 즉 2004년 11월 14일 까지 200해리 이원 대륙붕한계 문서를 CLCS에 제출해야 하나 개도국 및 후진국들의 준비불비로 연장이 불가피하여 2009년 5월 13까지 제출기간이 한차례 더 연장이 되었다. 이러한 배경 및 근거하에 동중국해에서 200해리 이원의 대륙붕을 향유하고 있는 우리도 제출의무를 부여받고 있어 이에 대한 구체적인 자료준비가 필요하다.
본고는 2008년 3월까지 제출한 9개 제출사례를 유엔해양법협약 및 관련 법규를 근거로 분석 및 검토하여 우리에게 주는 시사점을 도출하고 우리의 대응방안을 제시하고자 한다.
이러한 목적을 당성하기 위하여, 문서제출에 따른 제반절차(원용규정, 제출 대륙붕의 형태 등), 분쟁 및 주변국 관련사항(분쟁의 존재 여부, 주변국과 미해결 해양경계획정 문제가 있는 경우 처리 등), 부분 및 공동제출 관련사항 등을 중점 고찰하여 우리나라에 주는 시사점 중심으로 분석하고자 한다.

영어초록

The 1982 UN Convention on the Law of the Sea(UNCLOS) provides that the continental shelf af a coastal State comprises the sea-bed and subsoil of the submarine areas that extend beyond its territorial sea throughout the natural prolongation of its land territory to the outer edge of the continental margin.
However, the delimitation of the continental shelf between States with opposite or adjacent coasts has a lot of difficulties to be settled in a short term because there are various factors to be considered on the basis of legal, scientific, political, geological, geographical, geomorphological aspects.
In consideration of these circumstances, the UN agreed on that information on the limits of the continental shelf beyond 200 nautical miles from the baselines from which the breadth of the territorial sea is measured must be submitted by the coastal State to the Commission on the Limits of the Continental Shelf(CLCS)(article 76, paragraph 8) and then the Commission will make recommendations to coastal States on matters related to the establishment of the outer limits of their continental shelf. The limits of the continental shelf established by a coastal State on the basis of these recommendations shall be final and binding.
But, most of coastal States could not prepare to submit materials regarding outer limits of their continental shelf to the CLCS within ten years of the entry into force of the Convention for the States. In case of a State Party for which the Convention entered into force before 13 May 1999, it is understood, in accordance with the "Decision regarding the date of commencement of the ten-year period for making submissions to the CLCS set out in article 4 of Annex II to the UNCLOS", that the ten-year time referred in the above article 4 shall be taken to have commenced on 13 May 1999 and so the final date for submission is 13 May 2009.
In this regard, this paper examines and analyses selected several cases submitted to the CLCS and then proposes directions for submission by the Korean government in consideration of relevant laws and regulations, state practice and existing agreements among countries concerned.
