연속과 불연속 – 5･16 쿠데타와 헌법적 단층 – (Continuity and Discontinuity — The Coup d’Etat of May 16th and the Constitutional Fault-line —)

초록

헌법재판소는 유신헌법 제53조의 긴급조치에 대한 위헌심사형 헌법소원 사건에서 “현행헌법은 전문에서 ‘1948. 7. 12.에 제정되고 8차에 걸쳐 개정된 헌법을 이제 국회의 의결을 거쳐 국민투표에 의하여 개정한다.’라고 하여, 제헌헌법 이래 현행헌법에 이르기까지 헌법의 동일성과 연속성을 선언하고 있으므로 헌법으로서의 규범적 효력을 가지고 있는 것은 오로지 현행헌법뿐이라고 할 것이다”라고 판시한 바 있다. 그러나 여기서 헌법의 동일성과 연속성이 뜻하는 바는 무엇이며 어떤 기준에 의해 판별할 수 있는지, 헌법의 동일성과 연속성은 헌법을 정점으로 하는 법체계, 나아가 그 법체계가 속하는 국가의 동일성･연속성에 어떠한 영향을 미치는지 등에 관한 문제들은 해명되지 않은 채 남아 있다. 본고는 5･16 쿠데타라는 헌정사적 사례를 통해 이러한 문제들에 대한 시론적 접근을 시도하였는바, 연구의 결론은 다음과 같다.
첫째, 5･16 쿠데타를 전후로 한 두 헌법 즉 1960년 헌법과 1962년 헌법은 실체적 차원에서 많은 연속성을 가지고 있었을지라도 후자가 전자로 이어지는 법적 도출의 연결고리를 가지고 있지 않다는 점에서 절차적･형식적 차원의 연속성을 결하고 있었다. 1962년 헌법은 그 성립근거를 1960년 헌법에 두고 있지 않았을 뿐만 아니라 1962년 헌법 중 1960년 헌법부터 효력을 지속한 것으로 볼 수 있는 규정은 없었다는 점에서 그러하다. 즉, 양자 사이에는 어떤 헌법적 단층이 자리하고 있다.
둘째, 헌법적 단층이 헌법을 정점으로 하는 법체계의 연속과 불연속이라는 차원에서 어떠한 파급효과를 낳는지에 대해서는 이론적 관점에 따라 상이한 평가가 가능하다. 법외적 규범들의 변화도 법체계의 동일성과 연속성에 유의미한 귀결을 가져올 수 있다고 보는 라즈･피니스의 입장에서는 그러한 단층의 존재만으로 전후 법체계의 동일성과 연속성을 확정적으로 판별하기 어려웠다. 반면, 법적 도출관계의 유무라는 기준을 중심으로 법체계의 동일성과 연속성을 판별하는 켈젠의 관점에서는 헌법적 단층을 전후한 양 법체계가 다른 법체계를 구성하게 될 것이었고, 그 연장선상에서 국가의 동일성과 연속성이 유지되는지의 문제도 제기될 여지가 있게 될 것이었다.
셋째, 헌법적 단층이 국가 차원의 동일성과 연속성에 미치는 영향에 관하여는, 적어도 일반적인 국제법적 견해에 따르면 국가승인 문제가 새롭게 제기될 정도로 국가의 연속성을 깨뜨린다고 보기는 어려웠다. 그러나 이는 당시 5･16 쿠데타 국면의 헌법적 단층이 초래한 가장 예민한 문제로 취급되었다. 우여곡절을 거쳐 1962년 헌법이 헌법적 단층의 현존에도 불구하고 기존 헌법의 ‘개정’ 헌법임을 표방한 것은 – 이는 현행 헌법 전문의 태도로까지 이어진다 – 이 문제와 직접적인 관련이 있었다고 볼 수 있다.
헌법재판소 결정의 “헌법의 동일성과 연속성”이 뜻하는 바와 그 효과에 대한 온전한 인식이 가능하기 위해서는 유구한 헌법적 연속성 못지 않게 헌정사 곳곳에 자리하고 있는 단층들도 시야에 둘 필요가 있음을 환기하고자 한다. 본고는 연속과 불연속의 상이한 차원을 나누어 고려하는 것이 헌정사적 고찰에서 유용할 수 있음을 5･16 쿠데타 전후 법적 양상에 대한 분석을 통해 보이고자 시도하였다.

영어초록

The Constitutional Court of Korea ruled in the Case on Emergency Decrees under Yushin Constitution(2010Hun-ba132, March 21, 2013) that “as the Preamble of the Constitution states that it has been ‘ordained and established on the Twelfth Day of July anno Domini Nineteen hundred and forty-eight, and amended eight times subsequently’ and thereby declares its identity and continuity. It follows that the only Constitution with valid normativity is the current one in force.” But questions regarding what is meant here by conceptions such as identity and continuity of the constitution and how can they be assessed, what impact does identity and continuity of a constitution has on identity and continuity of legal systems or even on those of statehood remains to be clarified. This study sets out to explore these questions by examining a rather specific case in Korean constitutional history – the Coup of May 16th. Conclusions of this study are as follows: First, although the Constitutions before and after the Coup has substantial continuity in many respects, they lack formal and procedural continuity in that 1962 Constitution was not generated by an authorized procedure of the former Constitution. Instead, it was adopted by the Supreme Council for National Reconstruction and ratified by a popular referendum. A constitutional fault-line can be identified here.
Second, the implications of this fault-line on the continuity of the legal system can be assessed differently depending on theoretical orientations. I have tried to show that while Joseph Raz or John Finnis would find it rather difficult to draw a clear line of continuity or discontinuity depending only on the criteria of constitutional fault-line, Hans Kelsen would probably see a discontinuity of legal systems before and after the Coup since a new Constitution came into being without any authorization of the former legal system. Moreover, adhering to Kelsen’s view could lead to questioning the continuity of the Korean State, which did actually take place during the early debates over the new Constitution.
Third, although this concern regarding the continuity of the state was widespread at the time, it was unlikely that the above mentioned legal constellations would constitute a discontinuity of statehood according to the dominant doctrines of international law. Regardless, it was conceived as the most sensitive issue apropos the constitutional fault-line caused by the Coup. The Fact that 1962 Constitution proclaimed itself the amendment of the former Constitution – the aforementioned ruling of the Constitutional Court is an important consequence of this self-proclamation – indicated a conscious effort to deal with this problem.
In order to appreciate ‘the identity and continuity of the Constitution’, as formulated by the Constitutional Court, it is crucial to take into account not only the substantial continuities of the Constitution over time but also the constitutional fault-lines subsisting here and there in the fields of constitutional history. Focusing on legal analysis of the Coup of May 16th, this study suggests that differentiating the levels of continuity – constitutional norms, legal systems and statehood - could contribute to this endeavor.
