초록

지방분권과 함께 흔히 거론되는 주제가 지역균형발전이다. 지방의 자치를 강화하고 지역이 고르게 발전해야 한다는 것이 원칙적인 차원에서 규범적으로 이의를 제기할 만한 사항으로 보이지는 않기 때문에 이렇게 아울러 언급되는 것이 특별히 이상하다고 할 것은 없을 수도 있다. 그러나 이 두 사안이 모두 중요한 것으로 이해된다는 점 이외에 양자 간의 관계가 실제로 어떠한 것인지에 대해 생각해볼 필요가 있다. 지방분권과 지역균형발전은 우선 헌법의 편제상으로도 구별되지만, 개념상 전자가 후자로 당연히 연결되는 것도 아니고, 실제 사례를 살펴보아도 전자가 항상 후자의 실현을 보장해주는 것도 아니다. 헌법원리적인 관점에서 살펴보아도 지방분권이 민주주의원리의 맥락에 연결된다면 지역균형발전은 사회국가원리와 관련되는 것으로 이해된다. 지방분권이 지역주민의 참여를 통한 민주적 의사결정의 당위성과 필요성을 근거로 하고, 지역균형발전은 전국 어느 지역에서든 국민이 기본권 실현을 위한 일정 수준의 여건을 향유할 수 있어야 한다는 관심과 관계가 있다. 지방분권이 지방의 자율성 보장을 지향한다면 지역균형발전은 그러한 자율적 발전이 야기하는 차등적 결과를 시정하는 조치를 요구한다. 지방자치의 역사적 경험과 문화적 토대가 튼실하지 않은 우리 사회의 사정을 생각할 때 지방분권의 지역균형발전과의 변별점에 대한 특별한 주의 없이 민주주의원리나 사회국가원리에 대한 호소만이 강조된다면 지방의 자율성 보장이 의미하는 고유한 영역의 확보가 그 의의를 충분히 구현하지 못할 수 있다. 지방자치 영역에 초점을 두고 볼 때 이러한 자율과 균형의 문제는 지방자치단체 파산제도와 지방재정조정제도에 비추어 볼 수 있다. 지방자치단체의 자율성이 스스로의 문제에 대한 자유로운 결정과 책임을 뜻한다면 필요한 재정 부문의 제도적 개선을 전제로 지방자치단체 파산제도의 도입이 이러한 측면에서 의미가 있을 것이라고 본다.

영어초록

Balanced regional development is a topic often referred to alongside the decentralization of power. It may not be particularly strange to mention them together because there is nothing to object to normally in the argument to strengthen the decentralization of power and develop regions evenly. However, it is necessary to consider what the relationship between the two really is in addition to the fact that both of them are understood to be important. The decentralization of power and balanced regional development are prescribed in separate chapters of the Constitution. However, the former is not necessarily conceptually connected to the latter, and the former does not always guarantee the latter in reality. From a constitutional point of view, while decentralization is linked to the context of the principle of democracy, it is understood that balanced regional development is related to the principle of social state. The decentralization of power is based on the justifiability and necessity for democratic decision-making through the participation of local residents, and balanced regional development relates to the concept that citizens should be able to enjoy certain conditions and hold basic rights in any part of the country. If the decentralization of power is aimed at ensuring local autonomy, balanced regional development calls for measures to correct the differential consequences of such autonomous development. When considering the circumstances of our society, in which historical experience and the cultural foundation of local autonomy is insufficient, the appeal to the principle of democracy or the principle of social state may not be adequate if it is emphasized without special attention to the differentiation of the decentralization of power for guaranteeing the autonomy of the provinces from balanced regional development. Focusing on the sphere of the local autonomy system, the problem of autonomy and balance can be seen in the municipal bankruptcy system and the local finance adjustment system. If local autonomy means free decision-making and responsibility for a region’s own problems, the introduction of the municipal bankruptcy system will be meaningful in this respect together with the necessary institutional improvement of the financial sector.
