초록

스포츠산업은 미래 일자리 창출과 새로운 부가가치 창출의 선도적 역할을 수행할 수 있다. 그러나 국내 스포츠산업의 역사나 시장 환경은 아직 자생적이고 지속발전 가능한 산업생태계를 확립하지 못하고 있다. 이를 극복하기 위하여 전략적으로 스포츠산업진흥법을 제정하였다. 스포츠산업진흥법의 법률적 성격을 명확히 함으로써 정책 결정권자들이 법률을 바탕으로 정책을 입안할 때, 적극적인 산업 활성화 전략을 도모할 수 있다. 법률 제정의 목적과 구성내용에 따라 국가행정 및 지원의 성격이 결정되고, 행정의 시장에 대한 영향력이 매우 크기 때문에 분명하게 법 특성에 대한 이해가 요구된다. 따라서 본 연구의 목적은 스포츠산업진흥법의 법률적 특성을 설명하는데 있다. 이에 본 연구는 스포츠산업진흥법의 법 특성을 분석하고 설명하기 위하여 두 가지 분석범위를 설정하였다. 첫째는 법률에 명시된 법률 간 관계분석을 통하여, 스포츠산업진흥법의 법적 위상을 확인하고자 하였다. 둘째는 스포츠산업진흥법의 내용분석을 통하여, 그 특성을 분석하였다.
도출된 분석 결과는 다음과 같다. 첫째, 국민체육진흥법과의 법률적 관계에서 기술적으로나, 내용적으로 스포츠산업진흥법은 독립적인 법률로 인정된다. 둘째, 스포츠산업진흥법은 내용적으로 개별성, 경제성, 독립성, 중앙집권적 특성, 지원적 특성, 선택적 개방성, 특례성의 특성을 가진다. 이상의 결과를 종합하여 다음과 같은 결론적 제언을 도출하였다. 스포츠산업 정책은 오직 경제적 가치를 중심으로 정책을 수립하는 것이 타당하다, 또한 내용적 특성을 취합한 결과, 집중적이고 독립적인 정책수립 우선권을 가지고 있다. 따라서 법률의 범위와 국가 정책방향이 합치되도록 보다 적극적인 정책수립을 추구할 수 있다.

영어초록

The sports industry is a field that is likely to play a leading role in creating future jobs and creating new economical added values. However, the history and the market environment of the domestic sports industry still do not establish an independent and sustainable industrial system. To overcome this, the government strategically legislate the act of Sports Industry Promotion. There is a need to promote aggressive industrial revitalization strategies by clarifying the legal nature of the Sports Industry Promotion Act when politic decision makers hand out policies based on law. The nature of government administration and support determined by the purpose and composition of the legislation, it is necessary to understand the clear legal identity cause of the influence of the administration on the market is so great. Therefore, the purpose of this study is to explain the legal identity of the law of Sports Industry Promotion. Therefore, this study sets two research problems to analyze and explain the legal identity of Sports Industry Promotion Act. First, the relationship analysis specified in the law was performed to confirm the legal status of the Sports Industry Promotion Act through the relationship analysis specified in the law. Second, the legal identity and characteristics of sports industry promotion law were analyzed through content analysis.
The results of the analysis are as follows. First, the sports industry promotion law is regarded as an independent law in terms of the legal relation from the technical and content perspective. Second, the Sports Industry Promotion Act has seven characteristics of individuality, economics, independence, centralization, supportive characteristics, selective openness and exceptionality. Based on the above results, the following conclusions were drawn. It is reasonable to establish a policy based on economic value of sports industry policy. In addition, as a result of collecting the contents characteristic, it has priority to establish intensive and independent policy. Therefore, it is possible to pursue more active policies within the scope of the law and the national policy direction.
