방송의 공정성과 법의 포기 (The fairness of Broadcasting and Law’s abnegation)

초록

대상판결은 시민방송이라는 퍼블릭 액세스 채널에서 방송한 ‘백년전쟁’ 이라는 다큐멘터리 방송 프로그램에 대한 방송통신위원회의 제재조치를 다룬것이다. 이 다큐멘터리는 민족문제연구소에서 이승만, 박정희 전 대통령을 매우 부정적으로 평가하여 제작한 것이다. 방송통신위원회는 그 내용이 구 방송심의에 관한 규정 중 공정성과 객관성, 명예훼손 금지에 관한 조항을 위반하였다는 이유로 제재하였다. 원심판결에서 원고는 패소하였으나, 대법원에서 공정성 유지의무를 위반하였다고 볼 수 없다는 등의 이유로 원심을 파기하였다. 그에 따라 이 사건은 매우 정치적인 논란의 대상이 되어 언론의 관심을 받게 되었다.
공정성에 기반한 방송심의제도에 대하여는 강력한 비판이 제기된다. 이견해는 공정성 심의는 일종의 행정기관에 의한 검열이므로 폐지되거나, 유지하더라도 방송사의 모든 프로그램에 대하여 통합심사하거나, 국가정책에 대한 프로그램은 심사대상에서 제외되어야 한다고 주장한다. 대상판결은 이러한 비판론에 영향을 받았다고 볼 수 있다. 반면, 법학자들은 방송의 공적 책임, 방송과 신문의 차이, 역사성 등에 기초하여 방송심의의 정당성을 인정하고 있다.
미국법상 행정국가의 경향은 대상판결의 분석에 유용하다. 베뮬은 휴즈가 제시한 미국법상 법의 문제와 사실의 문제를 구분하는 법리가 행정의 결정을 존중하는 방향으로 변화되었다고 분석한다. 법률가들의 이성적이고 논리적 귀결로서 법의 제국으로부터 행정국가로 가는 법의 포기현상이 발생하였다는 것이다.
우리 판례상 행정에 대한 존중은 요건판단에 대한 재량의 법리로 나타난다. 대법원은 지속적으로 요건부분의 불확정개념 판단에 관한 행정청의 재량과 이에 대한 존중을 인정하고 있다. 그러나 행정이 설정한 기준의 합리성이인정되지 않으면 법원이 다시 개입하는 방식으로 ‘이중의 합리성’의 장치를 마련하고 있다. 반면, 최근의 일련의 전원합의체 판결들에서 대법원은 외견상일응 엄격한 심사를 한 것으로 보이면서도, 실상은 재량권에 대한 통제기준을 무력화시키는 다른 의미에서의 ‘법의 포기’의 경향을 보이고 있다.
대상판결의 다수의견은 이른바 매체별, 채널별 혹은 프로그램별로 심사기준을 달리하여야 한다고 본다. 시청자 제작 프로그램인 다큐멘터리의 경우뉴스 등 보도 프로그램보다 완화된 심사기준을 사용해야 한다는 것이다. 본논문은 대상판결의 논리를 비판적으로 검토한다. 더 나아가 이 사건 방송에대한 심의규정 위반여부는 일종의 행정청의 재량의 행사로서 재량의 존중의문제로 접근해야 한다는 점을 지적한다.
공정성을 기준으로 하는 방송심의에 대하여 제도적으로 개선의 여지가많은 것은 사실이다. 그러나 대상판결은 비판론을 의식한 나머지 무리한 법해석을 전개하였다는 비난을 받을 수 있다. 이러한 태도는 최근 대법원의 일련의 경향을 드러낸다는 점에서 우려된다.

영어초록

The related decision is dealing with the Korea Communications Commission’s sanctions against a documentary broadcast program called “Hundred Years’ War in Korea” which was broadcasted on a public access channel called Citizens’ Broadcasting(RTV). The documentary was produced by the Institute for National Studies, which described former Presidents Syngman Rhee and Park Chung-hee very negatively. Korea Communications Commission(KCC) imposed sanctions on the grounds that the contents violated the provisions concerning fairness, objectivity and prohibition of defamation under Broadcasting Deliberation Regulation. In the ruling of Seoul High Court the plaintiff lost the case, but the Supreme Court overturned the original ruling on the grounds that it can not be regarded as a violation of its duty to maintain fairness. As a result, the case has become a subject of intense political controversy and has drawn media attention.
The broadcasting review system based on fairness doctrine has met with strong criticism. This view argues that fairness review is a kind of censorship by an administrative agency, therefore it should be abolished or integrated into all programs of a broadcaster even if maintained, or such programs on national policy should be excluded from the review. It can be said that the decision was influenced by this criticism. On the other hand, jurists recognize the legitimacy of broadcasting review on the ground of the public responsibility of broadcasting, the difference between broadcasting and newspapers, and the historicity of broadcasting review system, etc.
Under U.S. law, the tendency of an administrative state is useful in analyzing our case. Adrian Vermeule analyzes that American case law theory presented by former chief Justice Charles Evans Hughes that distinguishes between the matter of law and facts, has changed to deference decisions of administration. As a rational and logical consequence of the lawyers, phenomena of law’s abnegation from law’s empire to administrative state occur.
In our case, deference to administration appears as the administrative discretion in confirming requirements of statute provisions. The Supreme Court continues to recognize the discretionary power of administration and the judicial deference to the decision on uncertain concepts in the requirements. However, if the rationality of the standards set by administration is not approved, there will be re-intervention by the court based on the mechanism of ‘double rationality’. On the other hand, in a recent series of en banc decisions, the Supreme Court seems to have done hard look reviews, but in reality tends to ‘law’s abnegation’ in other ways that could dismantle the control standards for administrative discretion.
The majority opinion in the decision deem that different criteria should be applied to broadcast review according to so-called media, channel, or program. It is said that a more relaxed review standard than news programs should be used for viewer-generated documentaries.
This study reviews the logic of the decision critically. Furthermore, it points out that the matter of the violation of regulations on broadcasting review should be approached as a matter of deference to administrative discretion by agency.
It is true that there is much room for institutional improvement in broadcasting review system based on fairness. However, the decision could be criticized for an excessive legal interpretation affected by the strong criticism above mentioned. This attitude is worrisome in that it reveals a recent tendency of Supreme Court’s decisions.
