개성공단 재개의 법적 과제 (Legal Task in order to reopen The Kaesong Industrial Complex)

초록

개성공단은 북한법제 또는 남북간 교류협력법제의 측면에서도 새로운 실험이며 도전이었다. 이러한 진전에도 불구하고 개성공단은 상당한 법제도적 한계를 가지고 있었다. 이러한 한계는 개성공단의 지속가능성을 담보할 수 없게 하므로 공단 재개를 위해서는 반드시 개선될 필요가 있다.
우선 개성공단 개발모델에 대한 근본적 검토가 필요하다. 도시 및 시장과 분리된 공업지구는 한계를 가질 수밖에 없다. 과거 신의주경제특구 또는 중국 쑤저우 개발모델을 참고하여 과감한 개혁개방제도를 도입하는 개성 경제특별구를 만들 필요가 있다. 이 모델은도시개발과 공단개발을 함께 하며 시장제도를 과감하게 도입하는 것을 요체로 한다.
개성공단 재개를 위해서는 무엇보다 공단이 ‘법의 지배’에 따라 운영되어야 한다.
개성공단은 남북한 합의에 의하여 조성된 공간인만큼 협치(協治)의 거버넌스를 확립할필요가 있다. 근본적으로 개성공단과 관련된 입법역량을 강화하여야 한다. 남북 공동의법제기구를 구성하는 것을 검토하여야 한다. 국제적 수준의 법률제도를 구축하기 위해법규를 정비하고 법제간 체계도 확립할 필요가 있다. 분쟁해결제도를 만들어야 한다.
완전한 투자보장을 위한 제도 보완도 필요하다. 남북간 상사분쟁절차 합의서는 조속히이행되어 중재기관이 가동되어야 하며, 그밖에 다른 분쟁해결절차도 마련하여야 한다.
신변안전을 위한 제도도 개선되어야 하고 이를 위해 남북간의 구체적 부속합의서가필요하다. 통행, 통신, 통관을 보다 원활히 할 수 있도록 하고 이를 법적으로 뒷받침하여야 한다.
개성공단 재개를 위해서는 남한 경협법제의 개선도 필요하다. 낡은 남북교류협력법으로는 대규모 협력사업인 경제특구사업을 뒷받침하는 데 한계를 가질 수밖에 없다. 손실보상 제도도 도입되어야 한다. 남북관계의 변화로 자신의 귀책사유 없이 불의의 피해를본 국민에게 정당한 보상을 하여야 한다. 경협보험제도도 대폭 보완하여야 한다. 이러한제도가 있어야 향후 남북관계가 재개될 경우 기업들의 대북투자가 가능할 것이다.

영어초록

The Kaesong Industrial Complex (“KIC”) is a new experiment and challenge from the perspective of the North Korean legal system and the legal system for inter-Korean exchange and cooperation. Despite the progress made through the KIC, however, there have been some limitations in the legal system. In this light, in order to resume the KIS, it is required to overcome such legal limitations as they would pose a threat to the sustainability of the KIS.
First, it is required to launch a fundamental review of the KIS development model. It is obvious that an industrial complex separated from cities and markets has limitations. The KIS needs to learn from the development model of the Sinuiju Special Economic Zone or China’s Suzhou to create a Kaesong Special Economic Zone that implements a drastic reform and open door policy. The keys to such development models are the simultaneous development of both the city and the complex and the momentous decision to introduce the market system.
Second, in order to facilitate a resumption of the KIC, the KIC shall be operated and governed by ‘the rule of law’. The KIC needs to establish cooperative governance since the complex was created through agreement between the two countries.
Fundamentally, they shall enforce the legislative capabilities with respect to the KIC. They shall consider organizing a common legislation office for the two Koreas. It is required to improve the laws and regulations as well as the legislative system so as to ensure the establishment of a reliable legal system on par with international standards. Most of all, they need to establish a dispute resolution system. It is required to supplement the KIS system to provide a full guarantee of investment. The agreement on commercial dispute procedure between the South and the North shall be implemented promptly to enable operation of an arbitral institution, and to come up with other dispute resolution procedures. The laws for personal safety should be improved. To that end, the two countries need to enter into an annex to the agreement specifying detailed matters. It is important to ensure passage, communication, and customs clearance, which should be supported by law.
Last but not least, South Korea’s legislation on inter-Korean economic cooperation should be improved. Because the current Inter-Korean Exchange and Cooperation Act was enacted so long ago, it has limitations in supporting the Special Economic Zone project, which will be the large-scale cooperative project between the two Koreas. It is also required to introduce a loss compensation system. They should compensate for the damages incurred by their people due to a reason not attributable to such people, such as a sudden change of inter-Korean relations. In addition, the insurance system related to the inter-Korean economic cooperation should be supplemented. Such systems would enable companies to invest in North Korea when the two Koreas resume their relations in the future.
