소년법의 요보호성과 독일 소년법원법의 비례성원칙 (Necessity of protection in juvenile law and principle of proportionality in german juvenile court law)

초록

소년법 제32조는 소년부 판사가 심리 결과 보호처분을 할 필요가 있다고 인정하면 결정으로써 보호처분을 하도록 규정하고 있다. 제32조 각호에 규정된 10가지 보호처분은 소년법의 목적에 비추어 보면, 범죄소년, 촉법소년 및 우범소년의 환경조정과 품행교정을 위해 부과되는 제재수단이다. 그러나 각각 성격과 내용을 달리하는 10가지 보호처분이 병렬적으로 규정되어 있어서 보호처분이 복지·후견적 처분인지 아니면 형벌 또는 보안처분과 유사한 작용방식을 띤 교육처분인지가 불분명하다. 소년법이 어떤 법영역에 속하는지의 자리매김이 힘든 이유도 이러한 모호함에서 기인한다고 할 수 있을 것이다.
소년보호처분의 성격을 논하는 것은 논외로 하고, 여기서는 보호처분을 할 필요가 있다는 문언이 어떤 의미를 담고 있는지 그리고 법문언의 의미내용에 따라 각각의 소년보호처분이 어떤 단계구조를 띨 수 있는지에 관한 이론구성을 시도해 보고자 한다. 이를 위해 우리 소년법과 가족유사성을 띠고 있는 일본 소년법의 요보호성개념을 둘러싼 해석론을 살펴보고, 요보호성 개념의 다른 재구성 가능성에 대해 고찰한다. 이러한 재구성 가능성의 접점으로 보충성원칙과 비례성원칙이 소년에 대한 개입의 법치국가적 규제원칙으로 정초되어 있는 독일 소년법원법의 교육처분과 소년형벌의 단계구조에 대해서도 살펴본다. 이를 바탕으로 입법론적 제안에 앞서, 우리 소년법 제32조의 병렬적 보호처분을 각각의 보호처분 간의 단계구조로 재해석할 수 있는지에 관한 해석론을 전개한다.

영어초록

This essay focuses upon the interpretation of the provision of juvenile law and analyse the possibility of application of the principle of proportionality in the juvenile court dispositions.
The juvenile justice system shall emphasize the well-being of the juvenile and ensure that any reaction to juvenile offenders shall always be in proportion to the circumstances of both the offenders and the offence.
The provision of our juvenile law, “in necessity of”, may be translated into “be in proportion to”. The principle of proportionality is well-known as an instrument for curbing punitive sanctions, mostly expressed in terms of just deserts in relation to the gravity of the offence. The response to young offenders should be based on the consideration not only of the gravity of the offence but also of personal circumstances. The individual circumstances of the offender should influence the proportionality of the reactions.
By the same token, reactions aiming to ensure the welfare of the young offender may go beyond necessity and therefore infringe upon the fundamental rights of the young individual, as has been observed in some juvenile justice systems. The proportionality of the reaction to the circumstances of the both the offender and the offence, including the victims, should be safeguarded. New and innovative types of reactions are as desirable as precautions against any undue widening of the net of formal social control over juveniles.
The juvenile court disposition shall be guided by following principles. first, the reaction of taken shall always be in proportion not only to the circumstances and the gravity of the offence but also to the circumstances and the needs of the juvenile as well as to the needs of the society. Secondly, restrictions on the personal liberty of the juvenile shall be imposed only after careful consideration and shall be limited to the possible minimum. Thirdly, deprivation of personal liberty shall not be imposed unless the juvenile is adjudicated of a serious act involving violence against another person or of persistence in committing other serious offences and unless there is no other appropriate response.
