전파법상 전자파 방지를 위한 법적 제고 방안 (Legal Improvement Measures to Prevent Electromagnetic Waves Defined in the Radio Waves Act)

초록

오늘날 수많은 전자제품의 사용과 전기시설의 설치로 인하여 인체에 유해로운 전자파의 위험성이 지적되고 있다.
따라서 현행 전파법에서는 전자파에 대한 인체보호, 전자파 안전시설의 설치, 전자파 측정・조사, 전자파 교육・홍보 및 전자파 방지에 대한 규제 등을 규정하고 있다.
그러나 현실적으로는 전자파의 관리정책상의 문제, 전자파의 기준 문제, 전자파 방지 규제 문제, 전자파 방지에 대한 교육・홍보 등의 문제, 그리고 전자파의 실효성확보 등에 대한 제도상의 문제점이 지적되고 있다.
이상과 같은 전자파로 인한 제도상의 문제점들에 대한 그 개선방안은 다음과 같이 요약될 수 있다.
우선, 현실적으로 생활가전제품 등의 전자파 위험이 확산되어 있는 실정이므로, 향후 전자파로 인한 건강위험의 방지를 위해서는 ‘사전주의’ 원칙에 입각한 정책·제도 마련이 필요하다. 즉 공공이익 차원에서 정부의 전자파에 대한 정책의 완비와 국민의 협조 강화가 필요하다. 특히 정부의 전자파 관리에 대한 체계적이며 통합적인 관리가 필요하다.
그리고, 생활가전제품 등에 대한 전자파 방지 규제가 미흡한 실정이므로, 전자파 차단효과 검증과 전자파 차단 의무 준수 등을 강화하는 것이 필요하다.
또한, 생활가전제품 등에서 발생하는 전자파가 노출 기준 초과와 고압송전선로의 전자파가 초과하고 있으므로, 이에 대한 제한조치 및 규제강화 등 보다 엄격한 행정조치가 필요하다.
그 밖에, 생활가전제품 및 고압송선로 등의 전자파 기준치 초과에 대한 시민들의 무인식과 교육ㆍ홍보 부족 등이 문제가 있으므로, 정부의 지속적이고 안전한 전자파환경 기반 조성을 위한 조사・연구와 교육 및 홍보가 필요하다. 그리고 전자파에 대한 학교교육과 현장교육도 필요하며 매스컴을 통한 생활가전제품 등의 안전한 사용방법 등을 적극 홍보하는 것도 필요하다.
아울러, 생활가전제품 등이 전자파 인체보호기준에 초과되고 전자파 방지기준에 부적합한 기기가 생산・유통되고 있으며, 전자파의 자의적인 평가와 고의⋅과실에 의한 허위평가⋅부실평가 등 위법행위가 발생되고 있으므로, 전자파 기준 초과와 전자파 등급표시 위반에 대한 과태료 부과의 인상과 전자파 측정ㆍ조사 위반에 대하여도 징역과 벌금 등을 상향조정 강화하는 것이 바람직하다.

영어초록

The current Radio Waves Act stipulates the protection of the human body from electromagnetic waves, installation of safety facilities for electromagnetic waves, measurement and survey of electromagnetic waves, education and promotion of electromagnetic waves, and sanctions for violations of electromagnetic waves.
However, in reality, what we are experiencing as problems are the management policy problem of electromagnetic waves, the problem with the electromagnetic wave standard, the problem with the prevention of electromagnetic waves, the problem with education and promotion of electromagnetic saves, and the problem in securing the effectiveness of electromagnetic waves.
First of all, as we have to deal with the reality that the hazard of electromagnetic waves are widespread due to household electrical appliances, we need to come up with policies and systems based on the principle of ‘precaution’ to prevent health risks from electromagnetic waves in the future. In other words, we need a complete set of government policies on electromagnetic waves and stronger cooperation from the public for the interest of the public. In particular, we need to systematically and comprehensively manage the government’s electromagnetic wave management.
In addition, as we have insufficient legal regulations such as labelling requirements of electromagnetic shielding in household appliances, we need to strengthen the verification of electromagnetic shielding and compliance with electromagnetic shielding obligations.
In addition, since electromagnetic waves generated by household appliances exceed exposure standards and electromagnetic waves from high-voltage transmission lines also exceed exposure standards, stricter administrative measures such as restrictive measures therefor and strengthening the regulations are required.
In addition, as there are problems such as lack of citizen awareness and lack of education and public relations on exceeding electromagnetic wave standards such as household appliances and high-voltage transmission lines, we need surveys and researches, and training and public relations to build the foundation for continuous and safe establishment of an electromagnetic wave foundation by the government. In addition, school education and field education on electromagnetic waves are also needed, and it is also necessary to actively promote safe use of household appliances, etc. through mass media.
In addition, household appliances, etc. exceed the human body protection standards for electromagnetic waves, and devices that do not conform to the electromagnetic wave prevention standards are being produced and distributed, and furthermore, illegal acts such as arbitrary evaluation of electromagnetic waves and false or insufficient evaluation, and therefore, it is desirable to increase the amount of fine for exceeding the electromagnetic wave standard and violation of the electromagnetic wave grade labelling, and raise the level of imprisonment and fines for violations of electromagnetic wave measurement and survey.
