전유부분의 경매로 인해 대지사용권의 성립 이전에 설정된 저당권이 토지공유지분의 범위에서 소멸하는지 여부 - 대상판결: 대법원 2013.11.28. 선고 2012다103325 판결 - (Whether the mortgage set before validation of right to use site disappears with the auction of a section of exclusive ownership in the co-owned share of land)

초록

대상판결은 대지소유권을 가진 집합건물의 건축자로부터 전유부분을 매수하여 그에 관한 소유권이전등기를 마친 매수인이 전유부분의 대지사용권에 해당하는 토지공유지분에 관한 이전등기를 마치지 아니한 경우, 토지공유지분에 대한 소유권을 취득하며, 대지사용권의 성립 이전에 대지에 관하여 설정된 저당권이 토지공유지분의 범위에서 전유부분의 매각으로 소멸한다고 해석한 최초의 판례로 그 의미가 있다. 집합건물의 신축으로 구분소유가 성립하면, 분양자(건축주)가 등기 없이 각 구분건물에 대한 소유권을 취득함과 동시에 구분건물의 소유를 위해 토지에 대한 사용권원이 대지사용권으로 전환되고, 구분소유자의 대지사용권은 전유부분과 종속적 일체불가분성이 인정된다는 점, 대지사용권의 성립 이전에 대지에 관하여 설정된 근저당권은 일체불가분성의 효과와 경매목적물상의 부담에 관한 소멸주의의 원칙에 의하여 소멸한다는 점 등을 비추어 볼 때, 대상판결의 태도는 타당하다. 하지만 전유부분의 대지사용권에 해당하는 토지공유지분에 대한 평가가 최저경매가격에 반영되지 않은 채 매각허가결정이 확정되면 토지공유지분의 범위에서 전유부분의 매각으로 소멸하지만, 그 근저당권자가 보호받지 못한다는 문제가 발생할 수 있다.

영어초록

The precedent of Supreme Court on 28th of November, 2013 (No. 2012Da03225) is noteworthy as it is the first case where a purchaser who bought section of exclusive ownership from a person who has built aggregate buildings and registered ownership transfer but did not complete the registration of ownership transfer for co-owned share of land regarding the right to use site of a section of exclusive ownership, the purchaser has the ownership of the co-owned share of land, and the land mortgage set before the right to use site disappears with selling of a section of exclusive ownership within the range of the co-owned share of land. The ruling of Supreme Court on 28th of November, 2013 is justified (No. 2012Da103325) as following reasons; 1) once partitioned ownership settles with new construction of aggregate building, the builder acquires ownership of sectioned building without registration and at the same time the right to use land is transferred to the right to use site for ownership of the sectioned building and the right to use site of sectional owners is a separable relation with a section of exclusive ownership; 2) mortgage applied to the land before the conclusion of right to use site disappears based on inseparability effects and the principle of extinction on burden from auctioning objects. If the selling is confirmed in the situation where the land evaluation on the co-owned share of land which applied to the right to use site of a section of exclusive ownership does not reflect the lowest bidding price, the mortgage disappears by selling the section owned within the co-owned share of land. However, since there is a problem that the mortgagee is not protected, there should be further development on protection system for mortgagee.
