초록

글로벌 무한경쟁 환경에서 국민 행복은 국가안보가 전제되지 않으면 성립되지 않는다. 이에 많은 주권국가가 국가안보법제를 구축한다. 자유의 적에 대해서는 관용을 베풀 수 없다는 것이 인류의 지혜이기 때문이다. 그러나 국가안보와 관련된 몇 개의 죄를 추상적으로 규정하고 있다는 것만으로는 국가안보가 확보되지는 않는다.
현재 미국 정보공동체에 가장 중요한 활동 근거법이 미국 자유법과 해외정보감독법이다. 그동안 국내에도 미국 자유법과 해외정보감독법에 대한 단편적인 소개는 있었다. 하지만 헌법 위반 논란, 법에 따른 정보기구의 활동반경과 현재의 실제적인 활동가능 모습을 소개한 논문은 거의 없는 상황이다. 이를 위해서는 미국 애국법에 대한 이해가 선행되어야 한다. 특히 미국 애국법에 대한 법리논쟁은 왜 미국 자유법이 만들어졌는지를 알려준다. 사실 미국 애국법은 연방국가인 미국에 독특한 법이고 인권침해법이라는 편견에 사로잡힌 견해들이 적지 않았다.
이에 본고에서는 초국가적안보위협세력의 대두와 함께 국가안보사범 법제에 대한 새로운 조망과 필요한 이유 그리고 그 구체적인 내용을 미국 자유법과 해외정보감독법을 통해서 살펴보고자 한다. 아무쪼록 본 연구가 2020년 현재까지도 미진한 국가안보사범과 그에 대한 처단 절차에 대한 법규범적 통제를 통하여 효율성과 적법절차 준수의 조화를 도모하는 등으로 국가안보 법치에 대한 관심을 가지는 계기가 되었으면 하는 바람이다.

영어초록

National security is safety and defense of a nation state, including its citizens, economy, and institutions, which is regarded as a duty of government. Originally conceived as protection against military attack, national security is now widely understood to include also non-military dimensions, including the security from terrorism, economic security, energy security, environmental security, cyber-security etc.
People’s happiness under the global unlimited competition circumstances can only be established by the premises of national security. All sovereign states therefore will construct ‘national security criminal legal system’ as a natural government responsibility.
However, the abstract and conceptual provisions of crimes to ensure the security and existence of a liberal democratic nation and to protect constitutional orders are not enough to attain national security and defend constitutional value and security.
Of course, as the Article 37 of the Constitution of the Republic of Korea is provided that “[t]he freedoms and rights of citizens may be restricted by Act only when necessary for national security, the maintenance of law and order or for public welfare.” Meanwhile, "The freedom and rights of the people shall not be downplayed for reasons not listed in the Constitution. Even if all freedom and rights of the people are limited by law only if necessary for national security, order maintenance or public welfare, and even if limited, they cannot infringe on the essential contents of freedom and rights," The most important of the basic laws of American intelligence community activities today are the American Freedom Act and the Foreign Intelligence Surveillance Act. However, although there have been fragmentary introductions of the U.S. Freedom Act and the Foreign Intelligence Surveillance Act in Korea, few papers or reports have introduced the radius of activities of the intelligence tool as a result of the need, the reason for revision, and the controversy over the fundamental violation of the for him, of course, a thorough understanding of the U.S. Patriot Act, which has been said to be the embodiment of U.S. national security protection, must be preceded. However, there were many prejudiced views that the U.S. Patriot Act is a unique law for the federal state and a human rights violation law.
In this paper, I will look at the reasons and details of the need for a new view and provision of security criminal legislation along with the emergence of transnational security threats through the U.S. Freedom Act and the Foreign Intelligence Surveillance Act. Hopefully, this research will serve as an opportunity to pay attention to the rule of national security law by promoting the harmony of efficiency and compliance with legal procedures through legal and regulatory control over national security criminals, which are still very insufficient in Korea to date in 2020.
