고령화 사회의 노인 강력범죄 원인과 효과적인 대응방안에 관한 연구 (The Study on The Causes of Elderly Violent Crimes in the Aged Society and Effective Counter Measures on Crimes.)

초록

본 연구는 최근 급속한 인구의 고령화 추세에 따라 증가하고 있는 노인에 의한 범죄, 특히 살인, 강간 등 성폭력, 방화 등 강력범죄가 증가하는 현상에 주목하여 그 원인을 파악하고 효과적인 대응방안을 모색하고자 하였다. 이를 위해 공식적 통계를 통하여 노인범죄의 증가 추세, 특히 강력범죄의 비중이 지속적으로 증가하는 현상을 확인하였으며, 언론에 보도되었던 심각성이 두드러진 몇 가지 노인 강력범죄의 사례분석을 통하여 그 원인을 구체적으로 살펴보았다.
분석결과 첫째, 의학․과학의 발달로 과거에 비해 노화로 인한 신체적인 기능 저하가 늦추어지면서 71세 이상 초고령층의 범죄가 증가하고 있으며, 특히 강간 등 성범죄의 증가 및 재범율이 현저한 것으로 나타났다. 또한 여전히 노인층의 경제적 어려움이 절도 등 재산범죄의 동기로 작용하지만 급속한 사회변화의 과정에서 소외됨으로써 사회와 가족의 냉대 등에 대한 분노의 표출로 살인이나 방화 같은 강력범죄가 증가하고 있다. 따라서 노인범죄의 원인을 과거처럼 단순히 주로 노인의 열악한 경제적 사정에서 찾는 것은 한계가 있으며 신체적․심리적 요인을 포함하여 다양한 시각에서 그 원인을 살펴 볼 필요가 있다고 본다.
둘째, 특히 강간 등 성범죄가 지속적으로 증가하고 있을 뿐만 아니라 재범율이 높은 점에 비추어 볼 때 노인의 성에 대한 사회적 인식을 새롭게 할 필요가 있다고 본다. 노년의 성을 긍정하는 사회적 풍토 조성을 위한 노력과 아울러 노인들이 신체적 에너지를 건전하게 해소할 수 있는 다양한 사회문화적 프로그램의 개발, 노인 대상의 성범죄 예방교육프로그램 시행, 형사사법기관과 사회복지기관 등 유관기관들 간의 협력체제 구축을 통한 재범방지노력 등을 통해 노인의 성범죄에 보다 능동적이고 적극적으로 개입･관리하는 방안이 모색되어야 할 것이다.
셋째, 사회변화와 유리되어 외로움과 고립감 등을 느끼는 노인들일수록 이러한 감정을 범죄로 표출하는 경우가 많기 때문에 노인을 위한 폭넓은 복지정책과 다양한 프로그램의 개발로 노인들의 사회적 유대감을 높이고 사회참여활동의 기회를 늘려야 한다. 노인의 심리적 고립감을 해소하고 사회적 유대감을 높이는 것은 사회복지적 측면에서뿐만 아니라 동시에 범죄예방을 통하여 사회안전망 구축에 기여할 수 있다고 본다.

영어초록

As aging has been on the rapid increase recently, the violent crimes by elderly like murder, rape, sexual violence, arson have also been on the increase. Accordingly, this study gets a goal that the causes of those crimes should be grasped and groped for effective solutions.
The results of analyses are as follows.
First, as the physical function by medical and scientific development solidifies, the crimes by the group of high age (over 71) are increasing. Moreover, in special sexual crimes like rapes increase steeply and the rate of repetition of offenses deserves being remarkable. In addition, the study indicates that the insecurity of economic situation in elderly violent crimes gives rise to the property crimes like larceny. However, as a result of alienation which appears in the process of rapid changes of society elderly violent crimes have committed crimes like murder, arson in order to express their resentment, which arises from inhospitality that their family and society show to them. Accordingly, this study shows that if we think of the causes of elderly violent crimes as their coarse economic problems, there will be limit to understand elderly violent crimes. So the study tells us that there should be need to survey the causes of crimes in various viewpoints including physical and psychological backgrounds.
Second, since sexual crimes like rapes not only are on the continual increase but the rate of repetition of offenses are high, there is need to get the social recognition toward the sexuality of elderly anew. Thus, the society that they belong to should give them the climate that accepts elderly sexuality positively and various sociocultural programs to exhale physical energy in old people. Also the enforcement of preventative programs for sexual offenses, the collaboration of criminal institution and social welfare facilities should be made by making efforts to prevent repetition of offenses. Besides, A scheme should be laid to intervene and manage elderly sexual crimes with inactive and aggressive attitudes.
Third, elderly tend to express their feeling of isolation through a criminal act when they feel loneliness and isolation from the social changes. So, by giving the broad welfare policy and various programs, society should enhance social relationship with elderly and increase the opportunity for them to take part in social activities. Dissolving elderly psychological isolation and enhancing social relationship will contribute to the net of social security not only in social welfare but in preventing crimes simultaneously.
