관세평가상 구매대리용역의 범위에 관한 연구 (A Study on the Scope of Buying Agent Services for Customs Valuation)

초록

관세평가상 수입물품의 과세가격에서 제외되는 구매수수료에 대하여 구매자를 대리하는 구매대리인의 역할과 관련하여 관세당국과 수입자(납세의무자)간에 다툼이 발생하고 있다. 본 논문에서는 구매자가 지급하는 구매수수료에대하여 관세법령과 WTO 관세평가협정의 규정 등을 분석하고 통관절차를 거친 후 사후조사과정에서 발생하는 사법당국의 판례를 고찰하여 구매대리용역의 범위에 관한 검토 기준을 법적 실질과세 측면에서 연구하였다.
본 논문은 2011.4.1 개정된 관세법령을 적용하여 구매수수료 여부를 판단함에 있어서 법적 실질설에 따라 구매대리 용역의 범위에 대한 검토요건을 제시하였다. 관세평가상 구매수수료로 볼 수 없는 구매대리 용역의 범위를, 구매대리인이 자기의 계산으로 용역을 수행했는지 여부(수입계약의 당사자 판단, 제조업체의 선택권과 통제권), 구매대리인이 해당 수입물품에 대하여 소유권 또는 그 밖의 이와 유사한 권리가 있는 경우(수입물품의 소유권과 위험의 이전, 수입물품의 하자담보책임과 멸실위험, 클레임청구권, 수입물품의 재고보유 책임, 수입물품 운송 등에 대한 책임), 구매대리인이 해당 거래나 가격을 통제하여 실질적인 결정권을 행사하는 경우(수입계약 내용의 결정권, 수입상의 지시와 통제 수행여부) 등으로 구분하여 분석하였다.
구매대리 용역을 판단할 수 있는 범위에 대하여 법적 실질과세 원칙을 적용할 수 있는 검토요건을 제공함으로써무역거래의 예측 가능성과 법적 안정성을 도모하여 관세당국과 납세의무자간에 불복으로 인한 물류비용과 행정비용을 최소화하는데 기여할 수 있을 것으로 기대된다.

영어초록

There is a lot of dispute between the customs authorities and the importers(taxpayers) regarding the role of the buying agent on behalf of the buyer on the buying commissions excluded from the customs value of imported goods due to the Customs Valuation. In this paper, after analyzing the Customs Legislation and the provisions of the WTO Customs Valuation Agreement on the buying commission paid by the buyer, the precedents of the judicial authorities were analyzed and the review criteria of the range of the buying agent service were studied in terms of legal real taxation.
The legal real taxation assessment criteria for the scope of buying agent services are presented by applying the revised Customs legislation. The review criteria for the range of buying agent services that can not be regarded as buying commissions under the customs valuation are as follows. First, whether the activities undertaken on the buying agent on the his own account was reviewed as to whether the parties to the import contract had the option and control of the manufacturer. Second, we reviewed whether the ownership of imported goods on the buying agent is based on the ownership of imported goods and risk transfer, warranty and loss responsibility, claims right, inventory and transportation responsibility. Third, the buying agent reviewed whether to exercise the actual decision-making power by controlling the transaction or the price, by determining the contents of the import contract, the direction and control of the import.
This paper proposes a review requirement that can be applied to the principle of legal real taxation on the extent to which the buying agent services can be judged. By providing the forecast ability and legal stability of the trade transaction, the logistics cost and the administrative cost caused by disagreement between the customs authorities and taxpayers to minimize the risk of injury.
