헌법재판에서 입법형성의 범위에 관한 고찰 (A Study on the Scope of Legislative Discretion in the Constitutional Adjudication)

초록

우리 헌법재판소와 같이 세부적으로 규정된 법률의 정합적 해석을 대법원에 거의 맡겨버린 채 헌법을 국가의 공권력작용에 대한 직접적인 심사기준으로 해석할 경우 헌법의 고유체계에 따른 해석의 요구를 피할 수 없다. 그러나 고유한 헌법체계만으로 입법부와 행정부의 공권력작용을 전면적으로 심사하는 데는 여러 어려움에 직면하게 된다. 이러한 어려움은 헌법재판소 결정에서 입법재량, 입법형성의 자유라는 개념으로 나타난다. 그러나 우리헌법재판결정에서 나타나는 입법형성의 구체적 유형들은 그것만으로는 추가적 논증을 제시할 수 없는 공허한 공식에 불과하다. 결국 입법형성의 자유는 헌법적 구속에 대한 고찰이 함께 고려되어야 하지만, 이를 실정헌법에 대한 실체법적 해석에 그칠 경우 헌법재판소는 입법부의 영역에까지 자신의 권력을 확장한다는 비난을 받기 쉽다. 그러므로 입법형성의 자유에 대한 고찰은 실정헌법을 입법부와 헌법재판소의 고유한 기능적 관점에서 실현되는 두 가지 차원의 규범으로 파악해야한다. 그리고 이는 입법부가 법률을 적극적으로 형성함에 있어 행위지침으로 작용하는 행위규범으로서 헌법과 이미 형성된 법률을 헌법재판소가 법원의 형식을 통해 소극적으로 통제하는 통제규범으로서 헌법으로 구분된다. 행위규범과 통제규번의 이중적 차원에서 헌법을 바라볼 경우 입법형성의 자유는 헌법자체를 기능적으로 이해함으로써 실체법 중심의 헌법실현으로부터 벗어나 헌법철학과 헌법사회학이 반영되는 또 다른 성격의 헌법실현을 가능케 하는 단초를 제공한다.

영어초록

In Korea, the constitutional court leaves it to the supreme court to make a coherent interpretation of the laws which are prescribed in detail. When the constitutional court adjudicates on the issue of the power of the state, the legislature and the executive, with an immediate judging standards of constitution, it cannot avoid a demand for making an interpretation of constitution according to its inherent system. But the constitutional court faces many difficulties to do that completely on the basis of an inherent constitutional system alone. These difficulties emerge as the concept of legislative discretion in the decision by the constitutional court. However, the concrete types of legislative discretion are only the empty formulas that is not enough to make an additional argument. Legislative discretion should be studied with a consideration of the constitutional binding but the constitutional court may be criticized for infringing on the boundaries of the legislature if its interpretation of constitution is limited to that of the positive laws as the provisions of constitution. In a study on legislative discretion, therefore, the positive constitutional law should be understood to be a double dimension norm which is realized by the distinct functional viewpoints of the legislature and the constitutional court. It is classified into constitution as behavioral norm and as control norm. The former acts as a guidance when the legislature forms law actively, while the latter acts as a negative criterion in the form of jurisdiction when the constitutional court controls the law which is already formed. If constitution is considered from a viewpoint of a double dimension in behavioral norm and control norm, the legislative discretion offers a beginning of another realization of constitution which reflects a constitutional philosophy and a constitutional sociology with the positive constitutional law by understanding constitution in a functional way.
