사이버테러 대응을 위한 법체계 검토 (The Legal review for Cyber Terror Response)

사이버 테러란 통상적으로 정부나 시민을 위협하려는 목적으로 사이버 툴(tool)을 이용하여 에너지, 수송, 공공시설 등 주요 국가 기반시설을 중지시키려고 하는 행위이다. 사이버 테러는 물리적 방법이 아닌 소프트웨어와 네트워크를 이용하여 사이버공간에서 테러행위를 한다는 점에서 일반적 테러와 구분된다. 최근에 테러리스트들이 공격하는 수단의 하나가 사이버 테러이다. 사이버테러는 적은 비용으로 상대방을 쉽게 공격할 수 있고, 그 결과는 물리적테러보다 오히려 심각하기 때문에 현실적으로 발생할 가능성이 높다. 본고는 사이버테러에대응하기 위한 현행법제의 문제점을 살펴보고, 최근에 국회에 발의된 관련 법안들을 분석하면서, 사이버테러에 대응할 수 있는 합리적 법체계를 검토하였다.

영어초록

No legal concept of cyber terrorism. Cyber ​​terrorism is terrorism and is generally separated from the fact that the terrorist acts in cyberspace by using the software and the network rather than physical way. One of the most recent means of terrorist attacks is the cyber terrorism. Cyber ​​attacks can be easily attacked their opponents with a fraction of the cost, the result is likely to occur due to high severity rather than physical reality terrorism. This look at the problems of cyber-terrorism law to respond to the claim, while analyzing the recent initiative legislation, and review the legal framework that could reasonably respond to cyber-terrorism. Reviewed as follows.
