테러방지법 제정에 따른 테러위기관리체계 개선 방안:경찰의 대테러 역할 강화를 중심으로 (A Study on the Improvement of the Terrorism Crisis Management System by the Enactment of Anti-Terrorism Law:With the Emphasis on Strengthening the Role of the Police)

초록

미국은 여러 테러사건을 경험한 후, 국가적으로는 국토안보부를 신설하여 테러를 전담하도록 하였고 관련된 책임기관의 역할을 강화하였다. 또한 테러 예방에서 경찰 조직의 강점을 확인하고 그 역할을 강조하였다. 지역 경찰조직은 각자의 정보 부서를 개편하고 인원을 강화하는 등의 노력을 기울였으며 연방정부 및 다른 기관과의 협업을 강화하기 위해 함께 계획을 세우고 각 기관의 역할을 분배하고 연합된 조직을 신설하는 등의 노력을 기울이고 있다. 우리나라 또한 세계적으로 테러에 대비하는 움직임에 동참하여 테러방지법이 개정된 지금, 경찰은 테러 범죄에서의 경찰 역할의 중요성을 강조하고 그 책임을 공고히 하기 위해 조직적인 변화가 필요하다. 그러나 현재 제정된 테러방지법만으로는 실제 현장에서의 구체적인 경찰의 역할과 책임에 대한 내용이 부족하며 위기대응상황에서의 현장조직체계에 대한 내용 또한 미비하다.
이 연구의 목적은 전 세계적으로 중요시되고 있는 테러범죄에 대한 대응을 위해 테러범죄에서 경찰조직의 중요성을 강조하고 테러범죄에 대한 효과적인 위기관리체계를 제시함에 있다. 또한 그 위기관리체계에서 경찰조직이 우선적으로 수행할 업무가 무엇인지를 구체적으로 제시하는 것이다. 이를 위한 연구방법으로 현재의 국가 및 경찰조직의 테러 위기관리체계를 분석하여 문제점을 파악하였다. 또한 테러 위기관리체계에서 경찰 역할이 어떤 부분에서 중요하고 강화되어야 하는지를 도출하기 위해 국외의 경찰조직의 위기관리체계에서의 경찰 역할을 파악하고 우리나라의 현재 위기관리체계와 비교하였다. 그 결과, 국외 테러 위기관리체계에서 경찰이 주요하게 담당하는 부분은 테러 예방과 대응분야이며 그 중에서도 초동조치 부분에서 경찰이 수행해야할 업무를 구체적으로 제시하였다. 제시된 역할을 충분히 수행하기 위해서는 경찰 조직 자체에서 시행되어야할 교육이 수반되어야하며 뿐만 아니라 테러에 대응하는 조직간의 협업을 강화하기 위해 안전한국훈련과 같은 국가적 훈련을 활용하여야할 것이다.

영어초록

After experiencing several terrorist incidents, the United States established the Department of Homeland Security to create a department exclusively responsible for terrorism and strengthen its role. Police organizations have also strengthened the role of police in preventing terrorism. Local police organizations are making efforts to reorganize and reinforce their intelligence services and work together with the federal government and other agencies to pland and establish a united organizatio to effectively prevent and respond to terrorism. The South Korea also participated in the movement to prepare for terrorism globally and revised the anti-terrorism law now, the police emphasized the importance of the role of the police in terrorist crime and to strengthen its responsibility, organized change is necessary.
The purpose of the study is to emphasize the importance of police organizations in terrorist crimes and to present effective crisis management systems for terrorist crimes in response to world-class terrorism crimes. In the crisis management system, what business is preferentially performed by the police organization is concretely presented. As a research method for this purpose, we analyzed the current terrorist crisis management system of state and police organizations and identified problems. In order to derive where the role of the police in the terrorist crisis management system should be important and enhanced, the role of the police in the crisis management system in overseas police organizations was grasped and compared with the current crisis management system in South Korea. As a result, the police's main responsibility in the foreign terrorist crisis management system is in the area of prevention and response of terrorism, and in particular, the police have specifically indicated the work to be performed in the initial action section. In order to fully fulfill the role presented, education to be implemented by the police organization itself and national training such as the safe and safe Korean training should be utilized to strengthen cooperation among organizations responding to terrorism.
