초록

최근 학교폭력 등 소년범죄를 근절하기 위한 범정부적 노력에 힘입어, 학교폭력 피해응답률 등관련 지표가 개선되는 등 이러한 노력이 일정한 효과를 거두고 있는 것처럼 보인다. 하지만, 학교폭력으로 인한 자살 등 최근 들어 발생한 일련의 사건들에서 드러나듯이, 한국사회에서 소년범죄는 여전히 고질적이고 심각한 사회문제로 남아있다. 이것은 가해소년의 처벌과 선도에 기반하고있는 기존의 정책들 그리고 더 거시적으로는 소년사법체계가 문제를 근본적으로 해결하기에는 한계가 있으며, 새로운 대안 모색이 절실하다는 것을 보여주고 있다.
이와 관련 전 세계적으로 회복적 사법에 입각한 소년정책들이 학계의 큰 관심을 끌고 있고, 실무적으로 그 효과성도 입증되고 있다. 한국에서도 21세기에 들어오면서 소년사건의 처리와 관련하여 회복적 사법을 적용하기 위한 이론적 논의와 실천적 노력이 전개되고 있다.
소년범죄와 관련한 회복적 사법의 실행은 기소 前단계에서부터 형집행 단계에 이르기 까지형사절차의 모든 단계에서 가능한 데, 범죄문제를 처리하는 최초의 단계인 경찰단계에서부터 체계적으로 이루어져야 한다. 그 이유는 무엇보다도 당사자 간의 갈등이 심화되기 이전인 사건발생초기 경찰의 적절한 개입을 통해 문제를 해결하는 것이 회복적 사법의 목적(피해회복, 가해자의재사회화, 당사자의 관계회복)을 달성하는데 훨씬 효과적이기 때문이다.
이와 같은 문제의식 하에서 이 글은 소년범죄에 대한 대응으로 경찰에서 회복적 사법의 이념과 원칙을 구체화할 수 있는 실천방안을 제시하고 이를 뒷받침하기 위해 해결해야 할 인식론적․법적․제도적 과제를 살펴보고자 한다.
소년사건의 처리와 관련한 경찰의 회복적 개입은 세 가지 방식으로 구체화될 수 있다. 첫째,회복적 사법 프로그램과 경찰 다이버전의 연계, 둘째, 경찰에 의한 가해소년의 지역사회에의 위탁, 셋째, 비공식적인 회복적 경찰활동이 그것이다.
경찰단계에서 회복적 사법의 성공적인 실행과 발전을 위해 해결해야 할 과제들로는 다음과 같은 것들이 있다. 범죄 및 그 대응방식과 관련한 개별 경찰관들의 인식의 변화, 회복적 사법 프로그램에의 회부 및 프로그램의 결과에 따른 사건종결 결정과 관련한 경찰재량권의 법적 공식화,효과적인 실무 프로그램의 개발․실험․평가, 회복적 사법의 이론과 실무에 대한 경찰관의 교육훈련 및 전문화 등이 그것이다

영어초록

Recently, thanks to government-wide efforts to eradicate juvenile delinquency like school violence, these efforts seem to have been paid off to a certain level such as improvement in the indicator related to response rate about school violence victimization.
However, as revealed in a recent series of events including suicides due to school violence, the juvenile delinquency in Korea is a deep-seated serious social issue. This shows that the existing policies focusing on penalizing and rehabilitating the youth offenders, and more macroscopically, juvenile justice system have their limitations to fundamentally resolve the issues, thus, it is imperative to explore new alternatives.
The juvenile policies based on the restorative justice are attracting great attention of academia worldwide, and their effectiveness is being proven in actual practice. From the 21st century, theoretical discussions and practical efforts for the application of restorative justice with respect to the handling of juvenile delinquency are ongoing in Korea.
Restorative justice relating to juvenile delinquency can be implemented in all stages of criminal proceedings from pre-prosecution to execution of the sentence. Such implementation should be done from the police step, the very first stage of crime handling since resolving the issue at the early stage of the incidence through the appropriate involvement of the police before the conflict between the parties intensifies is much more effective to achieve the purposes(reparation of the harms, reintegration of offenders, restoring relationship between the stakeholders, etc.) of restorative justice.
In this context, this study propose the action plan to embody the ideal and principle of restorative justice by the police in response to juvenile delinquency and review epistemological, legal and institutional challenges to be addressed to support the action plan.
The restorative intervention of the police relating to juvenile delinquency can be concretized in three different ways; first, application of restorative justice programs in conjunction with the police diversion; second, refering youth offenders to local communities; and third, informal restorative policing.
Challenges to be addressed for the successful implementation and development of restorative justice at the police stage are as follows; changes in the awareness of an individual police about crime and response towards crime, legal formalization of police discretion relating to the referral to the restorative justice program and the decision about case termination according to the result of the programs, development, experiment and evaluation of the effective working programs, and police training & specialization about theory and practice of restorative justice, etc.
