공익사업시행지구 밖의 손실보상 확대 방안 (Measures to Expand Compensation for Losses Outside the Public Service Implementation District)

초록

헌법은 국민이 가지고 있는 재산권을 보장하도록 하고 있으며, 이에따라 국가는 국민의 재산권 보장을 위해 노력하고 있다. 국민이 가지고있는 재산권 특히 공익필요에 의한 개인에게 발생시키는 손실에 있어그 손실을 보상하도록 규정하고 있다. 개인이 받는 재산권 손실에 있어재산권 보상을 완전보상을 하도록 헌법에서 규정하고 있으나, 실제법률과 보상에서는 완전한 보상이 제대로 이루어지지 않는 한계를 가지고 있다.
개인이 가지는 재산권 침해 특히, 공공필요에 의한 재산권 침해에대한 손실보상은 공익사업을 위한 토지 등의 취득 및 보상에 관한 법률에서 손실보상에 대한 원칙과 보상 종류 및 기준 등을 정하고 있다. 이 법률 제79조는 공익사업시행지역 밖에 있는 토지 등에 대한 보상에 대한 내용을 규정하고 있으나, 그 보상기준 등이 개인이 가지는 재산권보장을 침해하지 않고 현실적으로 보장하고 있는가는 의문이다.
공익사업시행지구 밖의 재산권침해에 대하여 현행 법률에서는 손실보상 규정을 두고 있으며, 이 법률 규정에서 손실보상 대상 범위에 대해 시행규칙으로 위임입법화 하고 있다. 위임입법인 시행규칙에서 정하고 있는 보상규정은 주로 사업지구 밖의 토지 등의 재산적 피해와 어업 및 영업 등의 권리에 대한 침해에 대한 피해를 보상하고 있다.
그러나 그 보상규정이 가지고 있는 문제점은 개인이 가지는 재산권침해에 대한 보상으로 이를 법률에 규정을 두어야 함에도 하위 행정입법으로 정하고 있어 위임입법의 한계를 벗어났다고 볼 수 있다.
또한 보상규정 외의 재산적 침해인 권리 등에 대한 침해에 대하여는 별도의 보상규정을 두지 않아 개인의 재산권을 침해하는 한계를 가지고 있다.
또한 하위입법인 시행규칙에서 정하고 있는 공익사업지구 밖의 손실에 대하여 그 규정이 불확정개념을 사용하고 있다. 시행규칙에서 영업손실에 대한 보상의 경우 “배후지 3분의2 이상이 상실되어 그 장소에서 영업을 계속할 수 없는 경우, 진출입로 단절, 그 밖의 부득이한 사유로 인하여 일정한 기간 동안 휴업하는 것이 불가피한 경우”라고하여 명확하지 않은 개념을 사용하고 있다. 특히 3분의2가 상실되지 않으면 피해요건에 해당되지 않아 피해보상을 받을 수 없는 한계가있다. 이처럼 명확하지 않고 불확정적인 개념을 사용하는 것은 법률유보의 명확성과 구체성의 원칙에 반하는 결과를 발생하고 있다.
따라서 본 연구는 공익사업시행지구 밖의 토지 등의 보상에 대한재산적 침해에 대한 법률 규정을 토대로 그 한계점을 검토하고 그 개선방안을 제시하였다. 즉 공익사업으로 인해 발생하는 피해에 대하여 그 피해구제를 완전하게 하기 위해서는 법률의 명확성과 법률의 구체성을 확보하고 피해구제를 확대하는 방안이 검토되어야 한다.

영어초록

The Constitution guarantees the property rights of the people, and accordingly, the state is making efforts to guarantee the property rights of the people. It is stipulated to compensate for the loss of property rights owned by the people, especially in the case of losses caused to individuals due to a need for the public interest. Although the Constitution stipulates that property rights compensation be fully compensated for the loss of property rights received by individuals, the actual law and compensation has limitations in that complete compensation is not properly achieved.
The principle of compensation for loss, types and standards of compensation, etc. are set in the 「Act on Acquisition of Land, etc. for Public Works and Compensation」. Article 79 of this Act stipulates the contents of compensation for land outside the area where public works are implemented, but it is questionable whether the compensation standards, etc. do not infringe on the protection of individual property rights and are realistically guaranteed.
With respect to property rights infringement outside the public utility implementation district, the current law has provisions for compensation for losses, and the scope of loss compensation is entrusted to legislationas a n en forcemen t rule in the p rovision s of t his law.
The compensation provisions stipulated in the Enforcement Regulations of the Enforced Legislation Act mainly compensate for damage to property, such as land outside the project district, and damage to rights such as fishing and business. However, the problem with the compensation regulation is that it is set as a sub-administrative legislation even though it should be stipulated in the law as compensation for the infringement of individual property rights, so it can be seen that it is beyond the limits of the mandated legislation.
In addition, there is no separate compensation provision for infringement of rights, which are property infringements other than the compensation provisions, so there is a limit to infringing individual property rights.
In addition, for the loss outside the public service district stipulated in the enforcement regulations of the subordinate legislation, the regulation uses the concept of indeterminate. In the case of compensation for business loss in the Enforcement Regulations, “If it is impossible to continue business at the location due to loss of more than two-thirds of the hinterland, if it is unavoidable to close the business for a certain period of time due to disconnection of access roads or other unavoidable reasons” Therefore, an unclear concept is used. In particular, if two-thirds is not lost, it does not meet the damage requirements, so there is a limit to not being able to receive compensation for damage. The use of such an ambiguous and indeterminate concept is contrary to the principles of clarity and specificity of legal reservations.
Therefore, this study reviewed the limitations based on the legal provisions on property infringement with respect to compensation for land outside the public service implementation district, and suggested improvement measures. In other words, in order to completely relieve the damage caused by public works, measures to secure the clarity of the law and the specificity of the law and to expand the damage relief should be reviewed.
