미연방헌법과 복지권 논의 (Discussion on the Welfare Rights in the United States)

초록

오늘날 사회국가의 이념에 따라 국가는 모든 국민의 인간다운 삶을 보장하기 위하여 자유의 실질적 조건이 되는 급부를 제공하고 나아가 사회적 정의를 실현해야 하는 폭넓은 책임을 지는 것으로 인식되고 있으며, 이러한 이념은 각국의 헌법에 반영되고 있다. 그러나 미연방헌법은 자유주의 사상에 기초한 내용만을 담고 있을 뿐 사회국가에 관한 명시적인 규정을 두지 않고 있다. 이에 미국에서 복지수급권도 자유주의적 이념에 기초하여 파악되고 있으며 헌법의 내용도 우리와는 상당한 차이를 보이고 있지만, 구체적인 사회복지제도의 형성과 실천현장에서 우리에게 미치는 영향력은 매우 크다. 이에 본 연구는 미연방헌법의 구조와 내용에 초점을 두고 복지수급권을 둘러싼 미국의 논의와 그에 관한 연방대법원 판례의 태도를 살펴봄으로써 사회적 기본권, 특히 사회보장수급권의 법적 성격에 관하여 우리에게 주는 시사점을 찾아보고자 한다.
미연방헌법의 권리장전에는 사회적 기본권에 관한 내용이 포함되어 있지 않다. 또한 권리장전의 규정형식도 대체로 국가에 대한 선언으로서 주로 연방의회를 비롯한 국가권력 행사의 한계를 규정하는 방식을 취하고 있으며, 위헌심사에 대해 명시적인 규정을 두지 않고 있다. 이에 따라 미국에서 복지권은 학계와 판례에서 헌법적 차원의 권리로 인정받지 못하고 있으며, 복지와 관련하여 사법부가 적극적인 역할을 하는 것에 대해서도 매우 부정적이다. 독립선언서의 행복추구권에 관한 규정이나, 헌법전문의 일반적 복지의 증진이라는 문구, 그리고 열거되지 아니한 권리에 관한 수정헌법 제9조 등이 복지수급권에 대한 헌법적 권리성 인정의 근거로 해석할 수 있는지가 검토될 수 있으나 이 역시 부정적인 것으로 파악된다. 다만, 구체적인 사례에서는 수정헌법 제14조의 적법절차의 원칙과 평등보호의 원칙을 통하여 간접적으로 복지수급권이 보장되는 결과를 가져오는 경우가 있을 뿐이다.
우리 헌법은 전문과 경제에 관한 장 등을 통하여 사회국가원리를 수용하고 있을 뿐만 아니라 다양한 사회적 기본권을 규정함으로써 사회국가의 실현에 관한 국민의 권리와 그에 따른 국가의 의무를 명시하고 있다. 즉, 미연방헌법과는 그 사상적 배경이나 규범의 형식과 내용 등 어떠한 측면에서도 유사점을 발견하기 어렵다는 점에서 복지수급권의 법적 성격과 내용에 관한 논의를 하는 경우에 미국의 이론이나 판례를 적극적으로 수용하는 것은 적절하지 않다. 또한 우리 헌법은 사회적 기본권을 모든 국민의 권리로 선언하는 한편 헌법재판제도를 통하여 국회에서의 다원주의적 의사형성에 대한 불신을 명시적으로 표현하고 있다. 따라서 사회보장수급권을 둘러싼 입법권과 사법권의 권한배분과 관련해서도 예산편성권이 의회에 집중되어 있으며 헌법상 의회의 민주적 의사형성과정에 대한 신뢰가 강조되는 미국과의 차별성이 고려되어야 할 것이다.

영어초록

Today, based on the philosophy of social state, it is recognized that the country is responsible for a wide range of services to guarantee all citizens to have freedom in effect with real benefits and practice social justice. This philosophy is almost all reflected in the constitution of the country. But the U.S. Federal Constitution only contains information based on liberal ideology, as well on the social state does not have an explicit provision. Thus, in the United States the social welfare rights is identified on the basis of liberal ideology and the contents of the Constitution has shown a significant difference from the Constitution of South Korea. However, the United States has a big impact on the formation of specific social welfare institution and practice in Korea. Accordingly, this study aims to find legal implications for Korea by looking at the discussion of the American academic world and the tendency of the Federal Supreme Court on the social welfare entitlements, focuses on the difference of structure and content of the U.S. Constitution and the Korean Constitution.
The U.S. Constitution, Bill of Rights does not contain information on the social rights. In addition, the type of the provisions of Bill of Rights is also typically to declare for the government power including Congress that the power can not be exercised in a certain way that the Constitution prohibit, and there is no explicit provision on the constitutional review of the Supreme Court. As a result, welfare rights in the academic and precedent is not recognized as the constitutional right in the United States. Also, they are negative for the judiciary to play an active role in the realization of welfare. It may be reviewed that the provision of the right to the pursuit of happiness in the Declaration of Independence, the expression of promote the general welfare in the Preamble to the Constitution, and the unenumerated rights in the Ninth Amendment are provided as a reasonable basis to accept that the social welfare rights is constitutional, but the views of the majority and precedent also can be analyzed as negative on this issue. There are, however, a few cases obtain results that the welfare rights are guaranteed indirectly, to apply the Fourteenth Amendment about due process of law and equal protection of the laws.
Korean Constitution accepts social state principle through the Preamble and the chapter on economy. Furthermore, stipulates a series of social rights so that clearly expresses the rights of citizens and the obligation of the state to realization the social state. In other words, it is hard to find any similarities in terms of ideological background, including the format and content to the U.S. Constitution. Therefore, it is not appropriate to accept the theory or precedent of the United States to debate on the nature and content of social welfare rights. In addition, Korean Constitution clearly expresses the distrust on the National Assembly in the provisions on the Constitutional Adjudication System. In contrast, in the United States the budget planning authority is concentrated to Congress and the U.S. Constitution emphasizes the Parliament's democratic decision-making. Therefore, these differences also should be considered in discourses on the balance of power between the legislature and judiciary to realize the social welfare rights.
