무인도서 개발을 위한 법적 근거 및 정책방향 연구 (A Study on the Legal Basis and Policy Directions for Development of Uninhabited Islands)

초록

본 연구는 국토의 일부로서 무인도서를 이용하게 되는 해양관광객들의 무인도서에 대한 인식과 관광행태에 적합한 무인도서 개발 법과 정책을 제안함으로써 향후 관광개발과 보존으로 인해 예상되는 다양한 혼란 상황을 방지하는 기초자료로 활용하도록 하는데 목적을 두고 있다. 최근 체험관광이 급증하면서 특수관광상품으로 낚시, 스쿠버다이빙 등 해양레저활동 등이 중심이 되는 해양관광상품이 인기를 끌고 있는 상황이다. 특히, 해양관광객이 급증하면서 유행처럼 확산되고 있는 캠핑, 오지 또는 극한의 상황에 도전하는 체험 위주의 관광객은 무인도서에 대한 관심과 개발을 유도하고 있는 실정이다. 이에 따라 무인도서 체험관광이 관광과 여가의 한 축으로 자리매김하고 있다. 이러한 상황에서 본 연구는 우리나라의 무인도서 개발에 대한 법적 근거와 정책 연구를 통해 무인도서 개발의 정책 방향을 제시하고자 했다. 독특한 해양체험과 여가 욕구를 충족할 수 있는 최적의 자연환경 속에 완벽하게 노출될 수 있는 무인도서를 이용하는 관광객이 점진적으로 증가하고 있으나, 이에 대비한 무인도서 개발에 대한 법적 근거나 정책마련이 부처별, 또는 이해관계자에 따라 다르게 나타나 무인도서에 대한 관광자원 활성화나 생태적 차원의 관리 방안은 아직까지는 미흡한 것이 현실이다.
이에 본 연구는 향후 지속적으로 확대 추진되어질 것으로 예상되는 무인도서를 이용한 해양관광‧생태관광‧체험관광‧탐사관광 활성화 방안에 대한 지원적 성격의 법적 제도적 지원방안을 정책적으로 고려해야 한다고 지적하였다. 개발가능 무인도서로 지정된 섬을 개발하기 위해서는 해당기관의 승인을 받아 추진하도록 규정되어 있고, 승인을 받기 위해서는 그 규모에 따라 개발계획서 등 구비 서류를 갖춰야 한다. 또한 무인도에 대한 개발을 위한 정확한 현황, 주변여건, 개발가능성 여부, 개발에 따른 문제점, 향후 중점개발방향, 중장기적 산업적 가치 등을 명확하게 살펴보고 현명하게 투자를 결정해야 하는 것으로 나타났다. 이에 본 연구는 무인도서를 개발하고자 하는 경우에 필요한 복잡한 법적 근거 및 정책을 분석하였고, 그와 관련된 내용을 좀 더 발전시키기 위한 정책 방향을 제시하였다. 이에 대한 본 연구의 방법은 국내외에서 발간된 다양한 연구논문과 정기간행물, 정부문서와 신문기사, 그리고 관련 법률 등을 고찰하여 제시하였다.

영어초록

The purpose of this study is to suggest uninhabited island development laws and policies suitable for the recognition of uninhabited islands and the tourism behaviors of marine tourists using uninhabited islands. In addition, it aims to use basic data to prevent various confusion situations expected due to future tourism development and preservation. In recent years, a number of marine tourism products such as fishing, scuba diving and other marine leisure activities have become popular. Especially, for the tourists who are experiencing camping, back country or extreme conditions, which are spreading like fashion in the rapid increase of marine tourists, uninhabited islands are attracting interest and development. As a result, uninhabited island experience tours are becoming an axis of tourism and leisure. In this context, this study tried to suggest a policy direction for uninhabited island development through a legal basis and policy study of uninhabited island development in Korea.
Tourists are increasingly taking advantage of uninhabited islands that are fully open in an optimal natural environment to provide for unique marine experiences and leisure needs. However, the legal grounds and policies for the development of uninhabited islands are different according to which departments or stakeholders are concerned. Therefore, the promotion of tourism resources and ecological management of uninhabited islands have not been done yet. This study suggests a support plan for promoting marine tourism, ecotourism, experiential tourism and exploration tourism using uninhabited islands which are expected to be continuously developed in the future. In particular, I pointed out that the legal and institutional support measures of supporting nature should be considered politically. Developable uninhabited islands are required to be approved by the relevant authorities in order to develop the designated islands. In addition, in order to receive the approval, it is necessary to have the necessary documents such as the development plan according to the scale. In particular, it is necessary to make a clear investment decision based on the precise status, development conditions, development problems, future development direction, and mid-to long-term industrial value for uninhabited island development. This study analyzed the legal grounds and policies needed to develop uninhabited islands. In addition, the direction of the policy for further development of the related contents was suggested. This study examines various research papers, periodicals, government documents, newspaper articles, and related laws published in and outside of Korea.
