청소년미혼모의 사회적 인정과 법정책 (Social Recognition and Legal policy of Juvenile Unmarried Mothers)

초록

본 연구는 청소년미혼모의 사회적 인정의 당위성과 현행법을 고찰하여 법 정책 방향 및 대안을 제시하고자 하였다. 청소년미혼모의 사회적 인정은 Axel Honneth의 인정이론의 철학적관점을 차용하여 제시하였다. 개인은 타인을 인정하며 또한 타인으로부터 인정받음으로써 자신의 정체성 형성을 완성한다. 정체성 형성은 자아실현의 원동력과 나아가 사회발전의 원동력이 된다.
따라서 청소년미혼모에 대한 사회적 인정은 청소년미혼모에 대한 자아실현을 가능하도록하며 경제적, 사회적 자립을 가능하도록 하여 사회적 비용 부담을 경감시킬 뿐만 아니라 복지의존도 벗어나도록 한다. 그러므로 청소년미혼모에 대한 사회적 인정은 필연적이며, 사회적인정의 토대는 청소년미혼모가 직면하는 사회적 위험의 해소를 돕는 안전망의 기제로 제시하였다.
현행법은 법률적 도구로써 청소년미혼모에 대한 지원을 명확히 규율하고 있으나, 여전히 미흡함과 보완이 필요하다는 견해를 다음과 같이 제시하였다.
첫째, 헌법에서 보장하는 모든 국민의 행복추구권 보장을 위한 현행법의 강력한 적용을 제시하였다.
둘째, 교육기본법은 교육에 대한 기회균등을 규율하고 있다. 그러나 청소년의 임신은 교육기본법에서 규율하고 있는 교육권마저 학칙에 의한 박탈과 교육권 상실은 청소년의 노동시장진입을 위한 기본지식 습득의 기회마저 빼앗는 기제가 되고 있다. 각 학교의 소극적인 대처와현행법 적용의 한계로 말미암아 청소년미혼모의 자아실현이 훼손되고 있다. 청소년미혼모의학습권 보장을 위한 법적효력 발휘를 제시하였다.
셋째, 한부모가족지원법이 청소년미혼모자 가정의 사회안전망의 역할이 가능하도록 현행법의 보완을 제시하였다.
넷째, 아동복지법은 아동의 출생과 함께 사회적 차별을 불허하며, 또한 아동이 건강하게 사회구성원으로 성장할 수 있도록 규율하고 있다. 그러나 여전히 청소년미혼모자 가정의 아동은보육을 비롯한 다양한 측면에서 아동의 건강한 성장을 저해하는 문제를 촉발하고 있어 청소년미혼모자 가정의 아동에 대한 인식의 전환을 제시하였다.
살펴본바와 같이 청소년미혼모를 위한 헌법, 교육기본법, 한부모가족지원법, 아동복지법 등의 법률적 토대는 이미 마련되어있다. 그러나 사회구성원들의 청소년미혼모에 대한 사회적 인정의 미성숙, 사회적 무시, 법률 적용의 한계 등에 직면하고 있어 개입 방안으로 청소년미혼에대한 법적 적용과 사회적 인정을 필요조건으로 제시하였다.

영어초록

The purpose of this study is to suggest legal policy direction and alternatives by examining the justification of the social recognition of the unmarried mothers and the current law. Social recognition of adolescent unmarried mothers is based on the philosophical view of Axel Honneth's accreditation theory. Individuals acknowledge others and are recognized by others to complete their identity formation. The formation of identity is the driving force of self-realization and the driving force of social development.
Therefore, the social recognition of adolescent unmarried mothers enables self-realization of adolescent unmarried mothers and enables economic and social independence, thereby alleviating the burden of social costs and also relieving the dependency on welfare. Therefore, the social recognition of teenage mothers is inevitable, and the foundation of social recognition is the basis of safety nets to help solve the social risks faced by teenage mothers.
The current law clearly regulates support for unmarried mothers as a legal tool, but suggests that it is still insufficient and complementary.
First, it presented a strong application of the current law to guarantee the right to pursue happiness of all the people guaranteed by the Constitution.
Second, the Basic Education Act governs equality of opportunity for education. However, the pregnancy of adolescents is also a mechanism that deprives the educational right which is regulated by the Basic Education Act and the loss of education rights by the rules of school to take the chance of acquiring basic knowledge for adolescent labor market entry. Because of the limitations of applying each school's passive actions and current laws, the self-realization of juvenile unmarried mothers is being undermined by the passive coping of schools and the limitations of the application of current laws. And to demonstrate the legal effect of guaranteeing the right of learning for unmarried mothers.
Third, the Single Parent Family Support Act provides a complement to the existing law to enable the role of the social safety net of single-mother families.
Fourth, the Child Welfare Act prohibits social discrimination as well as the child 's birth, and also regulates the child to be a healthy member of society. However, the unmarried mother-in-law still suggests the transition of the perception of the child in the unmarried mother-child to the child because the child is triggering the problem of the child's healthy growth in various aspects including child care.
However, as social members face the limit of social recognition, social ignorance, and legal application of adolescent unmarried mothers, legal application and social recognition of unmarried youth are necessary conditions for intervention.
