초록

이 논문은 현행 민법의 적용 및 해석과 관련한 몇 가지 법적 문제라고 정하였다. 이 논문에서 검토하는 규정 중 일부를 소개하면 다음과 같다. 민법 제98조는 유체물 및 전기 기타 관리할 수 있는 자연력을 물건이라고 정의하고 있다. 민법 제109조는 착오규정으로서 일정한 법률행위 내용의 중요한 부분에 착오가 있다면 표의자는 그 의사표시를 취소할 수 있지만, 그러한 착오에 대하여 표의자에게 중과실이 있었다면 취소권을 부정하고 있다. 민법 제126조는 표현대리책임 규정 중의 하나인데, 대리인이 권한을 넘는 법률행위를 하였더라도 제3자에게 정당한 이유가 있었던 경우에는 예외적으로 본인이 무권대리행위의 책임이 귀속될 수 있는 것으로 규정하고 있다. 민법 제204조는 점유보호청구권의 내용으로서 점유자가 점유를 침탈당한 경우에는 반환청구권과 함께 손해배상청구가 가능한 것으로 규정하고 있다. 민법 제320조는 유치권에 관한 규정으로서 타인의 물건 등을 점유한 자에게는 그 물권 등에 관하여 생긴 피담보채권이 변제기에 있다면 실제 변제받을 때까지는 유치하고 있는 물건 등에 대하여 반환청구를 거절할 수 있지만, 불법점유에 해당되는 경우에는 유치권을 행사할 수 없도록 규정하고 있다. 본고에서 저자는 민법전의 다양한 규정들을 중심으로 당해 규정의 적용 및 해석과정에서 발생할 수 있는 법적 쟁점을 살펴보았는데, 민법총칙에 관한 것으로는 법문상의 부적절한 표현, 가상화폐, 착오, 표현대리, 제한능력자의 보호문제 등을 중심으로, 물권법에 관한 것으로는 점유침탈과 손해배상의 관계, 질권에 있어서 물권적 청구권, 공동저당, 유치권에 있어서 불법점유의 문제 등을 중심으로 검토하였다.

영어초록

The title of this thesis is ‘Some Legal Issues related the Application and Interpretation of current Civil Law-Focusing on Part Ⅰ General Provisions and Part Ⅱ Real Right in Korea Civil Code-’. Some of the provisions considered in this paper are as follows. Article 7 of the Civil Code stipulates that Before a minor performs any juristic act, his agent by law may cancel the consent and permission given under the preceding two Articles. Article 98 of the Civil Code stipulates that Things mentioned in this Act shall mean corporeal things, electricity, and other natural forces which can be managed. Article 109 of the Civil Code stipulates that A declaration of intention may be voidable if made under a mistake in regard to any essential elements of the juristic act: Provided, That if there has been gross negligence on the part of declarant, he shall not claim it to be voidable. Article 126 of the Civil Code stipulates that If an agent has performed a juristic act in excess of his authority, and if a third person had justifiable reason to believe that the agent had authority to do such an act, the principal shall be responsible for the act. Article 204 of the Civil Code stipulates that If a possessor has been deprived of the possession of his property, he may demand the return of that which he was deprived as well as compensation for damages. Article 368 of the Civil Code relates to joint mortgages. Article 320 of the Civil Code stipulates that The provisions of the preceding paragraph shall not apply if the possession has originated in an unlawful act. I explained about the main contents of several regulations and some system in the Korea Civil Code and dealt with the important contents of the legal issue in connection with virtual currency(electronic valuables), apparent representation, mistake, claim for return of possessions, pledge settings contract, the protection of people with limited ability to trade, inadequate expression, Joint Mortgages, problem of illegal occupation in lien and suggested especially the problems and improvements in connection with several regulations and some system in the Korea Civil Code.
