초록

본 연구의 목적은 독일 에너지산업법상 송전망개발계획 그 중에서도 연방수요계획이 어떻게 도입되었고 어떠한 절차로 이루어지는지에 대하여 알아보고자 함이다. 송전망개발계획과 관련된 독일의 계획법제가 어떻게 구성되었는지에 대한 고찰 및 한국 송전망건설법체계에의 도입가능성과 제안을 하고자 한다.
독일은 2011년 대대적인 에너지법 개정을 이룬 에너지패키지로 송전망건설과 관련된 전혀 새로운 계획체계를 만들어내었다. 이 중 가장 중심적인 역할을 하는 것은 에너지산업법 제12조의a 이하에 규정된 송전망개발계획 및 이와 결부된 연방수요계획이다. 우선 연방수요계획에서는 송전망사업의 에너지산업적 필요성이 광범위하게 예측되고, 이를 바탕으로 연방전문계획은 경로예정선의 공간과 환경친화성과 관련한 경로예정선을 확정한다. 연방전문계획에 의해 확정된 송전망의 경로는 연방송전망계획을 통해 문서화되며, 해당 전문계획은 이어지는 계획확정절차를 구속한다. 연방수요계획 및 연방전문계획은 송전망사업자, 연방네트워크청, 입법자 간의 권한을 분배한다.
환경문제에 관한 전문가협의회의 제안을 통하여 새로운 계획법이 도입되었고, 이에 따라서 기존 참여절차의 감축을 통한 절차의 신속화로부터 방향전환을 하게 되었다. 입법자들은 모든 절차에 걸쳐서 절차의 투명성 및 참여를 보장함을 통하여 계획의 실현에 필수적인 사회적 승인과 절차의 신속화를 조화하고자 시도하였다. 특히 공중의 참여를 통한 사회적 승인을 강조하여 송전망의 필수적인 수요의 조사에서만 세 번의 협의절차가 진행된다. 이러한 사고는 한국의 송전망건설계획법제에도 적용될 수 있을 것이다. 안정적인 에너지공급의 보장만이 중시되었던 과거와는 달리 지속가능한 발전을 보장할 수 있으며 사회적 승인을 받을 수 있는 에너지공급이 보다 강조되어, 공중의 의견을 수렴하지 않은 우리나라의 송전망개발계획은 개선되어야 할 필요성이 있다.
또한 송전망개발단계에서의 송전망에 대한 강력한 국가의 책임을 강조하게 되었다. 이를 통하여 독일정부는 강력한 국가 기관 및 제도의 변환을 통하여 국가 자신의 통제가능성을 강화하였다. 특히 환경과 인간의 건강에 대한 위해로 인하여 강력한 저항에 부딪히는 송전망일수록 사전에 부정적인 환경을 예측하고 관련 주민들의 의견을 들어서 이해관계를 조정하는 과정이 필수적이다. 우리나라에서도 송전망건설을 위한 절차적인 계획법을 독일과 같이 체계적으로 입법화한다면 이를 통하여 송전망계획의 정당성을 확보할 수 있게 될 것이다.

영어초록

The sustainable energy transition, the Energiewende is not only in german but also in korean environmental policy highly discussed topic. In order to achieve the climate protection goal, German Goverment aims to reduce national greenhouse gas emissions by 40% by 2020 and by 2050 by 80-95% compared to 1990. To achieve these goals, the german federal government intends to generate electricity entirely from renewable energies in the long term. The Federal Government's Energy Concept of October 2010 illustrates this by setting the following goals for the electricity sector: The new government has raised its renewables target for 2030. 50% of electricity generation from renewable energy sources is planned for the year 2030 and 80% by the year 2050. Especially after the nuclear disaster in Fukushima in Japan and the ensuing nuclear moratorium, the Federal Government decided on a new sustainable energy concept.
Energy conversion from fossil fuelled and nuclear power will only succeed if the infrastructure support a very different kind of energy system. It can't meet the renewable target without major new cross-country power connection. The latest innovations since 2011 have created a completely new planning system for the transmission network in Germany as part of the energy transition. Its central elements are the network development plan and demand planning (§§12aff. EnWG), which were supplemented for offshore wind farms in the area of ​​the exclusive economic zone and their connection lines (§§17aff.EnWG), as well as a special planning approval process for trans-national or transboundary extra-high voltage power lines and for connecting lines of offshore wind farms under the new NABEG. Inspired by proposals from the German Council of Economic Experts on the Environment, this new planning law is characterized by its abandonment of the attempt to speed up procedures by shortening participation rights. The legislator harmonize the required acceleration of planning system with the indispensable acceptance by ensuring transparency and participation at all stages of the complex planning process. At the same time, this development process is characterized by stronger state responsibility for grid expansion. In this sense, the German government is trying to improve its ability to control by restructuring or creating strong central government institutions(.
A prominent position within the interests, which must be considered in the planning of grid expansion, takes the environmental protection. Renewable energy and energy efficiency are not just energy law but environmental planning law. The benefits of an SEA in the energy sector can be seen in the content improvement of grid expansion planning through early consideration of environmental concerns, the ability to pursue appropriate measures to mitigate environmental impacts, speed up the planning process, improve the acceptance of planning outcomes, and achieve sustainability of the energy law.
The study deals in detail with the implementation of national grid expansion planning processes in Germany. In this context, the German approaches and methods should be adapted to the Korean planning system and transferred to the Korean planning practice.
