초록

최근 크게 이슈가 되고 있는 망중립성 문제는 인터넷 환경에서 네트워크의 중립성을 유지함으로써 이용자와 콘텐츠 사업자들이 자유로운 정보와 사업활동을 영위할 수 있도록 네트워크 사업자의 활동을 규제할 것인가를 논점으로 하고 있다. 이는 지속적으로 변화ㆍ발전하는 IT분야의 기술영역과 시장상황을 배경으로 나라마다 다양한 조건 속에서 논의되고 있기 때문에 광범위한 분야를 아우르는 복잡한 사안으로서 이론적으로 간명한 해결을 기대할 수 있는 성격의 문제는 아니다.
대략적인 논의의 구도는 폭증하는 데이터 전송량을 소화해내기 위해서는 네트워크의 증설과 고도화가 요구되고 이를 가능하게 하기 위해서 네트워크 사업자가 트래픽 관리 등 네트워크에 대한 일정한 통제를 할 수 있어야 한다는 주장과, 오늘날의 IT혁명과 정보사회는 개방되고 자유로운 인터넷 공간에서 일어난 혁신과 창의를 통해 가능했는데 네트워크 사업자가 네트워크를 통제하게 된다면 인터넷은 더 이상 그러한 개방과 혁신의 속성을 잃게 될 것이고 따라서 정보통신과 문명의 발전이 둔화될 것이라는 우려를 축으로 한다.
네트워크 사업자와 콘텐츠 사업자들이 재산권이나 경제활동의 자유를 주장하면서 각각 IT산업의 지속적 발전과 나아가 삶 전체에 걸친 편익 증대를 확보하기 위해서 이러한 입장이 관철되어야 할 필요성을 강조하고 있는데 이는 경제적 자유의 측면에서만 영향을 미치는 사안은 아니고 인터넷을 활용하여 생활을 영위하는 일반 이용자들의 표현의 자유와도 관계가 된다. 망중립성이란 네트워크 상에서 전송되는 콘텐츠 등에 대하여 네트워크 사업자가 차별적 취급을 해서는 안 된다는 것을 핵심으로 하는데 네트워크 사업자가 트래픽 관리 등을 이유로 특정한 이용자의 데이터에 대한 통제를 가하게 된다면 이는 해당 이용자의 표현의 자유와 관련해서 문제가 될 수 있다.
네트워크 이용자의 표현의 자유를 보장하기 위해서 그 헌법적 의의를 강조하는 것만으로는 실질적인 대책이 될 수 없다. 망중립성 문제는 자유로운 공간으로서 인터넷 영역이 보유하는 공적 성격을 어떻게 유지, 발전시킬 것인가를 중심에 두고 있지만 네트워크의 증설과 고도화라는 현실적인 경제문제와 분리될 수 없기 때문이다. 그리고 관련 사업자들의 경제적 자유도 실제적 분석 없이 단순히 공익에 의뢰함으로써 만연히 제한을 정당화할 수는 없다. 사이버 공간을 전제로 한 정보활동의 가능성을 보장하는 차원에서 기본권 논의는 단순히 국가권력의 침해부재로서 확보되는 자연적 의미의 자유와 달리 일정한 물적 조건이 광범위한 차원에서 확보될 것이 요구되는데 이는 자유로운 정보활동의 보편적 구현을 위한 조건형성과 자유로운 재산권 행사와 경제활동 보장의 문제를 아울러 생각할 필요를 경험하게 한다. 본 논문에서는 우선 우리 헌법상 경제질서와 경제적 기본권을 아우르는 규범구조에 대한 이해를 전제로 망중립성 문제에 대처하기 위한 개인과 기업, 정부의 역할에 대한 바람직한 구도를 조망하고, 현재 망중립성 규제와 관련해 문제가 되는 구체적인 논점들을 살펴보면서 개별적인 경우에 연계되는 기본권 보장을 위한 실제적 과제를 검토한다.

영어초록

Network neutrality is an issue that deals with whether or not there should be regulations on network service providers concerning the neutrality of Internet networks so that the users and entrepreneurs can manage information and business without restrictions. The concept of network neutrality is an enormous issue encompassing vast area for it is discussed in a varied conditions of each country’s continually developing and changing IT technology and market situations; consequently, it is not a matter of which a simple solution is expected.
A broad outline of the discussion is as follows. Some insist that in order to cope with rapidly increasing demand on data transmission, network service providers need to be capable of controlling the network including the matter of traffic control. And the others are concerned that once network service providers control the network, the properties of Internet--the renovative and creative forces of the liberal and open space--which enabled IT revolution and information society might be weakened, and this might result in the slowdown of the progress in information communication and culture as a whole eventually.
Network service providers and contents providers each emphasize the importance of their position concerning continuous progress of IT industry and overall increase of benefits. This not only affects the matter of economic freedom but also is related with the issue of the freedom of expression of general users who utilize Internet in their lives. Network neutrality centers on the principle that network service providers should not discriminate among the contents in the network; if network service providers restrict certain user’s data with the excuse of traffic control, the freedom of expression of the corresponding user may be violated.
Just emphasizing the constitutional significance is not sufficient as a practical measure to secure the freedom of expression of the network users. Although the gist of the matter of network neutrality is how to sustain and develop the public characteristics of Internet network as a liberal space, the practical economic issues concerning extension and advancement of the network cannot be separated from the discussion. Furthermore, regulations on the related entrepreneurs’ economic freedom should not be justified with the general excuse of public good without proper scrutiny. The debate on the fundamental rights on the dimension of ensuring the possibilities of practicing information exchanges in cyber space differs from the natural liberty, which is guaranteed by the absence of coercion on the part of the government power, in that certain material conditions are necessary on a vast range; and this demands considering together the making of conditions that enables general realization of free information exchanges, and the problem concerning free exercise of property rights and liberal economic practices. This thesis overviews the desirable conditions concerning the role of individual, business, and the government to deal with the matter of network neutrality on the basis of proper understanding on the normative system including constitutional economic order and fundamental economic rights; and then it investigates specific problems at issue which are relevant to the regulations on network neutrality, which leads to examining practical assignments to guarantee fundamental rights in each particular occasion.
