초록

이 글은 1896년 대구부－경상북도 김산군 민장치부책을 분석하여 당시 김산 지역 백성들이 겪고 있던 분쟁의 종류와 양상을 파악해 본 것이다. 민장치부책은 관청에 접수된 각종 청원서인 민장의 요약본과 각 민장에 대한 군수의 판결인 제사로 구성되어 있다. 청원의 내용이 소략하기는 하나 당시 지역 사회에 산재하던 제반 갈등이 소장으로 표면화되고, 이에 대응하는 관의 태도를 생생하게 보여준다는 점에서 연구의 가치가 있다.
현전하는 김산군 민장이 작성된 시기는 1894~1895년 갑오을미개혁을 거치면서 조세제도, 지방행정제도, 사법제도, 경찰제도 등 거의 모든 분야에 걸쳐 급격한 제도적 변화가 일어난 직후로, 민장에는 당시의 혼란스럽고 복잡한 사회 상황이 잘 드러나 있다. 기존의 민장 분석 연구를 참고하여 김산군 민장을 주제별로 분류하면 백성들 사이의 경제적 갈등이 가장 높은 비율을 차지하며, 부세 문제로 인한 호소가 그 뒤를 잇는다. 현전하는 타 지역 민장에서는 1890년 이후 부세갈등의 비율이 15%정도에 불과한 데 비하여 김산군의 부세 관련 청원 비율은 30%나 될 정도로 높은 편이었다. 이는 당시 백성들이 급속도로 진행된 조세제도, 지방행정제도 개혁 이후 여러 문제에 직면했음을 가늠하게 한다. 한편 김산군수는 대체로 공권력을 동원해서 갈등을 해결하기보다는 당사자간의 사적인 해결을 도모하는 입장을 견지하였다. 특히 경제적 분쟁에 있어서는 승자와 패자가 명확하게 드러나지 않는 사례도 많았다.
1896년 김산군 민장에는 중앙정부로부터 하달된 새로운 제도와 지역 사회에서 유지되고 있던 관습이 서로 충돌하고 있던 각종 사례가 드러난다. 중간 납세자층의 급료가 신정례로 공식화되었는데도 여전히 각종 잡세가 혁파되지 않았다. 1896년 역도제가 폐지된 이후 김산군 소재 김천역과 추풍역 역토(驛土)의 매매, 소유, 경작을 둘러싸고 기존 역속인과 역토를 사들인 일반 백성들 간의 갈등이 표면화되기도 하였다. 반면에 중앙정부에서 공식적으로 신분 차별을 철폐하였음에도 김산군에서 신분적 질서는 공고하게 유지된 것으로 보인다. 이렇듯 신구 질서의 충돌로 인한 혼란을 정면으로 경험하고 있던 김산군 백성의 목소리와 관의 대응을 충실하게 담아내고 있다.

영어초록

This article analyzes minjangchibuchaek, which is the file of petitions, of Gimsan-gun, compiled in 1896, to understand the types and aspects of the conflicts that the people of the Gimsan-gun were experiencing at the time. Minjangchibuchaek consists of a summary of the various petitions received at the Gimsan-gun office, and the judgment of the governor for each petition. Although the contents of the petition are brief, the study is worthwhile in that it vividly shows the various conflicts the local community was experiencing at the time and the government's response to them.
This period was immediately after the rapid institutional changes in almost all fields, including the tax system, local administrative system, judicial system, and police system, during the Gabo․Ulmi reform in 1894-1895. The file of petitions of Gimsan-gun, 1896, clearly illustrates this chaotic and complex situation. When categorizing Gimsan-gun petitions by subject by referring to previous research, economic conflict occupies the highest rate, followed by tax conflict. A similar trend can be found in the minjangchibuchaek of other regions in the same period, but compared to other regions where the ratio of tax conflicts since 1890 stayed around 15%, in Gimsan-gun, the ratio of tax conflicts was as high as 30%. This phenomenon is presumed to be the result of being directly affected by the rapidly changed tax system and local administrative system. Also, looking at the attitude of the governor of Gimsan-gun in handling those conflicts, he was generally seeking a private resolution between the parties rather than mobilizing public power, and this tendency was particularly pronounced in economic conflicts.
The people of Gimsan-gun were experiencing various confusion as the new system implemented by the central government and the customs maintained in the local community collided with each other. The existing custom of collecting various miscellaneous taxes continued, and the salaries of officers of the local government were formalized as a new regular rule. After the post-station-routes system was abolished in January 1896, conflicts between the existing subordinates to Gimcheon and Chupung stations located in Gimsan-gun, and the common people who purchased the land of those post-stations surfaced over the sale, ownership, and cultivation of the land. Meanwhile, although the central government officially abolished social class discrimination, the social hierarchy was firmly maintained in Gimsan-gun. As such, the file of petitions of Gimsan-gun, 1896, contains the voices of the people of Gimsan-gun who faced chaos due to the clash of old and new orders.
