민법 제752조의 위자료청구권과 그 상속성 (A Study in Civil Code Article 752 on Solatium claims and Those Inheritance)

초록

이 논문은 민법 제752조의 해석을 중심으로 생명침해로 인한 위자료청구권의 상속성 여부에 관하여 학설과 판례를 검토하였다.
그런데, 이에 관하여서는 구민법 시대로부터 논의가 이어져왔는데, 현재까지도 그 논의는 계속되고 있다.
학설은 크게 상속긍정설과 상속부정설로 나누어지고 있으며 대법원판례는 일관되게 상속긍정설을 채용하고 있는데, 어느 학설이 민법 제752조의 해석과 부합하는가의 문제이다. 이에 관한 연구결과를 토대로 다음과 같은 결론을 내린다.
첫째, 상속긍정설은 피해자와 일정한 신분관계에 있는 근친자가 상속한 위자료청구권은 피해자(피상속인) 자신이 입은 정신적 손해를 배상하는 것이다.
둘째, 부양구성이론은 상속부정설의 입장에 서고 있다는 점에서는 수긍이 되나, 이는 민법 제752조의 입법취지를 고려에 넣지 아니하고 이론을 구성하고 있다는 비판을 면하기 어렵다.
따라서, 결론적으로 생명침해로 인한 위자료청구권의 상속성 여부에 관하여서는 민법 제752조의 입법취지가 무엇인가를 전제로 하여 규명되어야 한다고 본다.
민법 제752조는 생명을 침해를 당한 피해자의 보호를 위한 규정이 아니기 때문에 이 규정은 피해자의 직계존속 ‧ 직계비속 및 배우자 등의 간접피해자를 보호하기 위한 규정으로 이해하는 것이 타당하다.
이렇게 이해한다면, 상속부정설이 민법 제752조의 규정에 충실한 해석인 동시에 논리적으로도 타당하다는 결론에 도달한다.

영어초록

This paper reviews the theories and judicial precedent solatium claims compensation money about the inheritance whether infringe as the center of life due to the Article 752 of the Civil Code interpreted.
However, in relation to the above was discussed from Era the old civil code Until now, the discussion continues.
The theory is largely divided into ‘positive theory of inheritance’ and ‘theories that deny the inheritance’ Supreme Court has consistently presented. One theory is the question of civil code comply with Article 752 of interpretations. Based on the findings of this, it comes down to the following conclusions.
First, positive theory of inheritance is the next of kin to inherit the right to claim Solatium in constant relationship with the victim's identity is to compensate for the emotional distress he suffered victims(inheritee).

Therefore, they stand conclusion about whether life due to violations of the right to claim Solatium inheritance identified by the premise of what the Civil Code Section 752 of legislative intent.
This provision is advisable to understand the rules for protecting the indirect victims of such ‧ lineal ascendants and lineal descendant of the spouse of the victim's life, Civil Code Section 752 because it is not a regulation for the protection of victims of abuses.
If we understand this, the theories that deny the inheritance reached the conclusion that it is logically valid both a faithful interpretation of the provisions of the Civil Code Article 752.
