상해보험에 관한 입법론적 검토 (A Legislative Study on Personal accident insurance to amend Commercial Act)

초록

이 논문은 상해보험과 관련된 입법론적 문제를 다루고 있다. 특히 상해보험의 법적 성질과 중복보험 규정의 적용 등 해석론적으로 문제되는 영역을 검토하고 이를 바탕으로 상해보험의 규정이 입법론적으로는 어떻게 규정되어야 하는지를 검토함을 그 목적으로 한다. 상해보험은 현실적으로 상해사망보험, 상해후유장해보험, 입원치료비등 실손보험으로 구성되어 있다. 즉 상해보험계약에는 정액보험과 실손보험이 함께 포함되어 있다. 그럼에도 불구하고 상법은 상해보험에 관하여 생명보험규정을 준용하고 있다. 입원치료비등 실손보험부분에 관하여 상법의 규정은 많은 한계를 가지고 있다. 따라서 많은 해석론적인 한계를 극복하기 위하여 상해보험에 관한 상법의 규정은 입법론적으로 재검토되어야 한다고 생각한다.
성질 면에서 정액보험인 사망사고손해, 후유장해손해, 실손보험인 입원치료비 등의 손해는 명확히 구분된다. 그러나 상해보험과 관련된 논의에서 상해보험이라는 용어는 포괄적 상해보험계약의 의미로도 사용되고, 실손보상적 상해보험의 의미로도 사용되면서 혼란이 가중되고 있다. 상법은 상해보험계약을 중심으로 포괄적으로 규정하고 있으므로, 여기에서 명확히 정액형 상해보험에는 인보험(또는 생명보험)규정을 준용하고, 실손형 상해보험에는 손해보험규정을 준용하도록 한다면 많은 문제가 해결될 수 있다고 본다.
이러한 상해보험에 관한 입법론적 재정비는 상해보험에 관한 많은 해석론적 문제에 대한 해결책중의 하나가 될 수 있을 것이며, 향후 상해보험에 관한 분쟁의 소지를 줄일 수 있을 것으로 기대해 본다.

영어초록

This paper tries to study legislative problems related to the Personal Accident Insurance(PA Insurance). It also contains the discussion of legal structure of the PA Insurance and whether a lot of PA Insurances are double insurance or not.
According to the coverage in PA policy, the insurer indemnify the personal accident damages. They contain damages for death, injury resulting from accidents and damages for medical treatment. Thus PA Insurance is composed of the usual fixed amount Insurace and loss-compensating PA Insurance. Despite of this fact, Korean Commercial Code applies the articles on the life Insurance mutatis mutandis to PA insurance.
It is criticized that the current commercial law regulations on the PA insurance do not clearly regulate lots of problems of the PA insurance contract. This is due to the fact that the Commercial Code does not regulate the PA insurance independently and comply with the life insurance regulations. In order to overcome many of these interpretational problems, I believe that the Articles of commercial Code on PA insurance should be revised.
In terms of legal structure, damages such as accidental death, accidental injury damages, damages for medical treatment are clearly distinguished. However, in the discussion regarding PA insurance, the term PA insurance is used both as a comprehensive accident insurance contract and also as a meaning of accident insurance(non–life insurance). By the way, since commercial code provides comprehensive coverage of injury insurance contracts, mainly involving life insurance, many confusions are caused.
Therefore, I think that many problems can be solved if we apply life insurance rule to damages such as accidental death, accidental injury damage and apply the non-life insurance rule to damages for medical treatment and apply it to the sickness insurance.
These legislative restructuring of PA insurance can be one of the solutions to many analytical problems related to PA insurance and I hope that it will reduce the possibility of disputes about PA insurance in the future.
