공익 개념에 대한 존재론적 인식과 당위론적 인식: 한국인의 공익 인식 유형 (Public Interest as an Ontology and Oughtness: Perception Types on Public Interest in Korean Society)

초록

구성원 다수, 혹은 공동체 전반의 이익을 지칭하는 ‘공익(public interest)’은 공동체의 목표이자 성립 이유이다. 그럼에도 불구하고 공익의 의미는 명확하지 않다. 우선 사익을 초월하는 규범적 가치로서 공익을 인식하는 견해와 사익의 총합 혹은 절충으로 인식하는 견해가 대립하고 있다. 또한 공익 개념이 지나치게 모호하다는 지적도 존재한다. 그러나 개념의 모호성에도 불구하고 사회공동체들은 여전히 ‘공익’이라는 이름 아래 다양한 가치를 추구하고 있다. 이에 본 연구는 보다 정치한 공익 개념을 확립하고자 기획됐다. 한국사회의 구성원들의 공익 인식을 분석한 결과, 네 가지 상이한 인식 유형이 나타났다. 첫째, ‘상황적 인식론’이다. 공익의 내용은 상황에 따라 달라지며, 때문에 국가나 공적 기관이 효과적으로 공적 역할을 수행하기 어렵다고 인식하는 유형이다. 둘째, ‘이상주의적 규범론’으로서 공익은 사익과 다른 도덕적인 행동 규범이라고 인식하는 유형이다. 셋째, ‘자유주의적 긍정론’으로서 공익은 사익과 유사한 개념이므로 공동체는 사회적 편익을 극대화해야 한다고 인식하는 유형이다. 이 유형은 상대적으로 행정 기구나 미디어가 공적 역할을 잘 수행하고 있다고 생각한다. 마지막으로 ‘다원주의적 역할론’이 나타났다. 사적인 이익 추구와 도덕적인 규범이 모두 공익에 포함되며, 국가나 공공기관의 역할도 상황에 따라 달라진다는 견해이다.

영어초록

Public interest, which refers to the interest of members of a community or the community itself, is a goal as well as a reason of existence of the community. Nevertheless, there is not a clear and widely accepted opinion regarding what public interest means. First of all, there are two main opinions which conflict each other. One opinion considers public interest as an absolute value surpassing private interests, while the other regards it as a sum or a compromise of private interests. Furthermore, the concept of public interest is sometimes too vague to understand. However, communities are still pursuing diverse values, while assuming them as public interest. This study aims to contribute in establishing a more refined concept of public interest. Through an analysis of what Korean people consider as public interest, this study finds out four distinct types of understanding. The first type focuses on an understanding of situational role for public interest. Because public interest is dubious conept, this type believes that the public interest varies according to circumstances. The second type underlines an understanding of idealistic norm as public interest, considering that it is a norm of behavior distinguished from private interest. The third type highlights an understanding of liberal affirmation of public interest. This type thinks that a community has to maximize its public interest as private interest is pursued. In particular, this type positively recognizes the role of administrative organizations and media in pursuing public interest. The last type focuses on an understanding of pluralistic role for public interest. This type regards that public interest includes seeking both private interest and ethical norms and that the role of government or governmental organizations varies according to circumstances.
