초록

UN 아동권리협약의 기본취지는 어떠한 경우에도 아동의 인권을 보호하고, 인류의 보편적 가치로서 부모의 국적 및 국내체류의 적법성을 떠나 이주아동의 인권을 보장하는 것이다. 우리나라는 1991년 아동권리협약에 가입·비준하였으며, 이 협약의 규정에 따라 모든 아동의 권리를 보장하여야 한다. 그러나 현실은 출생 시부터 체류자격을 취득하지 못하여 기본적인 인권조차도 보장받지 못하고 있다. 미등록 이주아동의 수를 제대로 파악하지 못하여, 객관적인 자료도 없으며, 미등록 이주아동의 인권실태를 제대로 파악하지 못하여 인권의 사각지대에 방치되어 있는 실정이다. 대부분의 미등록 이주아동은 본인의 주체적인 이주의사로 국내에 체류하고 있다기보다는 부모의 의사로 합법적인 체류자격을 취득하지 못하는 경우가 대다수이다. 그럼에도 불구하고 미등록 이주아동은 아동으로서의 권리를 제한당하고 있으며, 단속의 대상으로만 여겨짐으로써 인간으로서의 권리를 위협받고 있다.
이주아동은 우리 헌법상 기본권의 주체이다. 외국인으로서 기본권이 제한되거나 체류자격이 없어 기본권이 부정되는 경우에도 아동을 성인과 같은 수준에서 제한하는 것은 부당하다. 따라서 아동의 최선의 이익의 관점에서 접근할 필요가 있으며, 인권의 관점에서 검토되어야 할 것이다.
이에 본 논문에서는 미등록 이주아동이 강제퇴거에 의해 영향을 받는 상황을 유형화한 후, 인권침해 실태를 아동의 최선의 이익의 관점에서 검토함으로써 문제점을 살펴보고 있다. 또한 개선방안으로서 이주아동인권 기본법의 제정, 보편적 출생등록 제도의 도입, 건강권 및 교육권의 보장, 인권영향평가 제도의 도입, 독립적 아동인권보장 기구의 설치를 제안하고 있다. 이러한 제안으로 미등록 이주아동들의 인권침해가 종결되는 것은 아니지만, 이주아동들의 인권보장 및 증진을 위한 대안적 접근의 시작점은 될 수 있을 것이다.

영어초록

The basic purpose of the UN Convention on the Rights of the Child is to protect the rights of children in any cases, and also to guarantee the rights of immigrant children as the universal value of mankind, regardless of the legality of their parents’ nationality and stay. Korea joined/ratified this convention in 1991. The countries that have ratified this convention should guarantee the rights of every child in accordance with the rules of this convention. In reality, however, even the basic human rights are not guaranteed as the status of stay is not acquired from the birth. Because the number of undocumented immigrant children is not fully understood, there is no objective data. As the actual state of human rights of undocumented immigrant children is not fully understood, they are just left in the blind spot of human rights. Most of the undocumented immigrant children are staying in Korea not based on their own independent will to stay, but because of their parents’ intention with no legal status of stay. Nevertheless, their rights as human beings are threatened by limiting their rights as children and simply considering them as a subject of crackdown.
The immigrant children are the subject of basic human rights under the Constitution of Korea. Even when the basic human rights are limited as a foreigner or the basic human rights are denied because of no status of stay, the children should not be limited in the same level with adults because they should be considered/reviewed in the aspect of the best benefits of children and the perspective of human rights.
Thus, after classifying the situations influenced by the compulsory eviction of undocumented immigrant children, this thesis examines the problems by reviewing the actual state of violation of human rights in the aspect of the best benefits of children. As the improvement measures, this study suggests the enactment of fundamental law for human rights of immigrant children, introduction of the universal birth registration system, guarantee of rights of health & education, introduction of the human rights impact assessment system, and the installation of an independent organization for guaranteeing the human rights of children. These suggestions cannot be the ultimate solution to the violation of human rights of undocumented immigrant children. Nevertheless, the enactment of fundamental law for human rights of immigrant children and other suggestions could be the starting point of the alternative approach for the guarantee/enhancement of human rights of immigrant children.
