초록

오늘날 세계적인 규모로 인권침해에 대한 소송을 법원에서 심리하고, 법적구속력이 있는 판결을 내릴 수 있는 절차가 유럽, 미국, 아프리카 지역의 인권조약의 규정에 상정되어 있다. 이 중 미국 및 아프리카 인권재판소는 개인이 제소한 소송을 처리하지 않는다. 그러나 유럽인권재판소는 개인이 제기한 소송을 심리하는 절차를 통하여 인권을 보장하기 때문에 유럽인권조약을 인권의 국제적 보장에 대하여 가장 완성된 모델로 평가받고 있다. 그러나 객관적으로 검토하면 개인이 제기한 인권침해의고충을 유럽인권재판소에서 심리하여 법적구속력이 있는 판결을 내린다는 절차로 조약을 시행한 것은 1998년의 제11의정서의 발효한 이후부터이다. 유럽인권조약의 특징은 유럽인권재판소가 체약국 법원의 상급심이 아니라는(유럽인권협약 유럽인권재판소는 보완적 존재이다)위치를 유지하면서 인권 및 기본적 자유의 보호와 촉진이라는목적을 실효적으로 보장하는 기관이다. 또한 유럽인권재판소의 판결에 의하여 체약국의 법적 체계에 변화를 줄 수 있기 때문에 유럽인권재판소의 판결의 근거규범이 되는인권조약에 대한 해석방법과 권리보장에 대한 중요성은 커지고 있다. 유럽인권조약은개인의 자유권을 중심으로 보장하고 있지만, 그 중 소수의 차별금지에 대한 규정을 두고 이를 엄격하게 보장하고 있다. 본 논문에서는 유럽인권재판소의 판례를 중심으로인권조약에서 보장하는 차별금지와 권리제한에 대한 내용을 검토하고자 한다.

영어초록

Today, proceedings to give legally binding decisions and examine the lawsuit on violationof human rights in the court at a global level are prescribed in regulations on human rightstreaties of Europe, the United States and African region. Among them, the courts of HumanRights from the United States and African region do not deal with lawsuits filed byindividuals. Meanwhile, since the European Court of Human Rights guarantee human rightsthrough the process to examine the case filed by individuals, it has been evaluated the mostcomplete model with respect to the international guarantee of the European Convention onHuman Rights. However, an objective review revealed that the enforcement of the treatywith the procedure to give legally binding decisions through the examination of the case ofhuman rights abuses filed by individuals in the European Court of Human Rights startedsince the entry into force of Protocol No. 11 in 1998. The European Convention on HumanRights are characterized by the European Court of Human Rights to ensure protection andpromotion of human rights and fundamental freedom effectively, while maintaining its positionthat it is not a higher court of contracting state courts(European Convention on HumanRights European Court of Human Rights has complementary position). In addition, sincethe decisions made by the European Court of Human Rights can affect the legal systems ofthe contracting states, there has been growing importance of interpretation methods onhuman rights treaties and guarantee of rights, which serve as norms of decisions made bythe European Court of Human Rights. The European Convention on Human Rights ismainly focused on the guarantee of individuals’ rights to freedom, but it also prescribes asmall number of non-discrimination provisions and ensure them. In this regard, this paper attempts to examine the contents on the limitation of rights and non-discrimination guaranteed by the European Convention on Human Rights, with focus on judical precedents of the European Court of Human Rights.
