초록

최근 글로벌 기업들이 특허를 둘러싸고 존망의 명운을 건 치열한 경쟁을 벌이고 있다. 스마트폰, 하이브리드 자동차 등 융복합 제품이 많아지면서 신제품 개발에 필요한 특허수요가 급증하고 있으며, 핵심특허를 보유한 기업이 산업의 주도권 확보에 유리하다는 인식이 확산되고 있기 때문이다. 특허전쟁의 양상과 이에 따른 산업 경쟁구도의 재편을 조망하기 위해서는 학계나 산업계 할 것 없이 특허비즈니스 환경의 변화상을 면밀히 파악할 필요가 있다. 과거에는 특허가 제조를 위한 필수조건으로 인식되었으나 이제는 특허를 이용한 제조활동 이외에 특허실시, 벤처 투자, 재판매 등 특허권 자체를 비즈니스 도구로 활용하는 공격적 수익창출 활동이 활발하게 전개되고 있다. 특허를 보유하지 않고 다수의 기술 제공자와 기업의 필요 기술을 중개해주는 활동도 늘어나고 있으며, 특허 등 무형자산의 유동화 상품도 등장하고 있다. 특허와 주요산업의 경쟁구도 변화는 어떠한가?우선 스마트폰의 경우 개별기업 간 경쟁뿐만 아니라 운영체제를 공유하는 생태계 간 특허 공방으로 확대되고 있다. 애플, 구글, 마이크로소프트 등이 막대한 현금 보유량을 바탕으로 기업인수와 특허매입에 적극적으로 나서면서 향후 특허공방은 더욱 심화될 전망이다. 반도체 산업의 경우 성장세가 둔화되고 있으며 기업 간 수익성 양극화가 뚜렷한 메모리반도체 분야에서는 기술력을 갖춘 중위권 기업이 누적된 적자를 만회하기 위해 미활용 특허를 특허관리전문기업(NPE)에 양도하거나 직접 특허실시 사업을 강화하는 쪽으로 움직이고 있다. 일부 중위권 기업의 특허매각과 사업철수로 반도체 산업의 구조조정이 가속화될 것이다. 조명산업에서는 원천특허를 중심으로 소수의 선도업체가 특허블록을 구성하고 있다. 최근에는 발광다이오우드 관련 어플리케이션 시장이 확대되면서 이들 분야에서 특허분쟁이 발생하고 있다.
이러한 변화속에서 사업자들은 현재의 주력 사업뿐만 아니라 미래 신사업 영역과 인접 분야까지 포괄하는 특허 포트폴리오를 구성하는 것이 필요하다. 나아가 글로벌 특허 생태계에서 살아남을 수 있는 견고한 특허 역량을 구축할 필요가 있으며, 해외 대학, 연구소 등과 연계하여 필요한 핵심기술을 빠르게 탐색, 확보해야 한다. 정부는 특허 경쟁력이 취약한 중소기업을 지원하는 정책을 강화할 필요가 있다.

영어초록

The patent lawsuit has peaked in the past year since the smartphone market has flared up. Everyone knows that the greatest value Google has attained for 12.5 billion dollars is Motorola's patent portfolio, which will give them an incredible arsenal in this conflict. Before an alliance with Motorola, Google has disposed of just 1,500 patents regarding smartphones, while Apple had 4,000 and Microsoft 17,000. It is also not surprising that Google has decided to better prepare itself for future attacks at any cost. Among other things, Google has attained a large market share with Android because it offers its platform to manufacturers without charge, while Microsoft charges the license of its Windows Phone 7 operating system. Neither Microsoft nor Apple are fond of a technology development and this was the trigger for the lawsuits against HTC and Samsung; a war started over patent breach.
Clearly, Apple and Microsoft's demands regarding the manufacturers who use Android OS are designed to make the devices more expensive, which would slow down the further rise of the Google platform. Google is clearly hoping that it's purchase of Motorola Mobility will enable the Mountain View giant to use the strategy of its competitors and win a few lawsuits to raise the prices of devices which use Windows Phone 7 and iOS by charging small royalties. Even worse, some of these companies might be targeted by lawsuits from all sides because they produce smartphones with Android and Windows Phone.
The patent war, however, can be useful for the users, as it might result in an more even distribution of market shares when it comes to mobile platforms. Microsoft and Nokia want other manufacturers to support their platform in order to raise the bar of its recognizability and expand the developing circle. The longer the war lasts, the more the market will be leveled out. Despite pointless additional production costs, the final smartphone prices will go down.
This article deals with the emerging technology protectionism and competition consolidating scheme on knowledge property. Two main issues of the importance of intellectual property and its protection are argued in this work. More and more, an espionage has been increasing and many nations prepared anti espionage act to prevent from stealing industrial secrets and to protect national interest. I believe this piece may trigger to start realization of the importance why knowledge property protection is so crucial in the national security. Readers may obtain the background ideas of the emerging technology protectionism and practical information of the competition consolidating scheme. Especially, this research will contribute to understand the atmosphere of the global patent war and how to counteract high-technology stealing by the government and the private company.
