계쟁물 승계인과 기판력의 주관적 범위 (The successor of subject-matter in dispute and the subjective extent of Res Judicata)

초록

변론종결 후에 당사자로부터 계쟁물을 승계한 제3자가 기판력을 받는 민사소송법 제218조 제1항의 변론종결 후의 승계인(이하 ‘제218조 승계인’이라고 한다)에 해당하는지 여부에 관하여, 판례는 ‘소송물이 채권적 청구권인 경우에는 제218조 승계인에 해당하지 않지만 소송물이 물권적 청구권인 경우에는 제218조 승계인에 해당한다’는 입장을 취하면서도, 유독 패소한 원고로부터 계쟁물이 승계된 경우에는 ‘소송물이 물권적 청구권이라도 제218조 승계인에 해당하지 않는다’는 입장을 취한다.
위와 같은 판례가 타당한지 여부를 검토하고, 계쟁물 승계인에 대한 기판력의 확장에 관하여 이론적 일관성을 유지하는 동시에 구체적 사안에서 바람직한 결과를 도출할 수 있는 기준을 모색하는 것이 본 논문의 목적이다.
기판력을 받는 계쟁물 승계인의 범위는 소송물이론에 따라 결정된다고 보는 것이 일반적이다. 하지만 위 승계인의 범위를 결정하는 기준은 소송물이론이 아니라 집행 절차에서의 효율성이어야 한다. 그리고 이러한 효율성 측면에서 볼 때, 계쟁물이 원고와 피고 중 누구로부터 승계되었는지, 그리고 원고와 피고 중 누가 승소하였는지와 상관없이, 기판력의 주관적 범위는 청구가 물권적인 경우에는 승계인에게 미치고, 청구가 채권적인 경우에는 승계인에게 미치지 않는다고 보는 것이 타당하다고 생각한다.
판례와 같이 패소한 원고로부터 계쟁물이 승계된 경우에는 승계인에게 기판력이 미치지 않는다는 획일적인 결론을 내리는 것에 비하여, 위와 같은 경우에도 청구가 물권적이면 기판력이 승계인에게 미친다고 보는 것은 판례의 논리적 일관성을 유지할 뿐만 아니라 구체적인 사실관계를 반영하여 각 사실관계에 적합한 결과를 도출할 수 있는 장점이 있다.

Regarding whether the successor of subject-matter in dispute subsequent to a closure of pleadings is the successor subsequent to a closure of pleadings specified in Article 218, Paragraph 1 of the Civil Procedure Act(hereinafter ‘Article 218 successor’), Supreme Court precedent basically takes the position that ‘the successor of subject-matter is the Article 218 successor if the objects of lawsuit is based on real rights, but not if the object of lawsuit is based on obligation’, but especially in the case that subject-matter in dispute is inherited from a losing plaintiff, it takes the position that ‘even if the objects of lawsuit is based on real rights, the successor of subject-matter is not the Article 218 successor.’ The purpose of this paper is to examine whether the above precedents are valid, and to seek standards that can keep theoretical consistency and lead to desirable results in specific cases regarding the subjective extent of Res Judicata to the successor of subject-matter in dispute.
It is generally believed that the scope of the successor of subject-matter in dispute subject to res judicata is determined according to the theory of the objects of lawsuit. However, the standard for determining the scope of the above successor should be efficiency in the compulsory execution procedure, not the theory of the objects of lawsuit. And in terms of this efficiency, regardless of whether the subject-matter in dispute is inherited from the plaintiff or the defendant, and whether the plaintiff or the defendant prevails, the subjective extent of Res Judicata extends to the successor if the claim is on real rights.
Compared to making a uniform conclusion that res judicata does not extend to the successor in cases where the subject-matter in dispute is inherited from the losing plaintiff as in precedent, taking the view that ‘in the above case, if the claim is based on real rights, the res judicata extends to the successor' has the advantage of being able to reflect the specific factual situation and derive a result appropriate for each factual situation.
