방송광고판매제도 변화에 따른 미디어렙의 도입방안 (A Study of Media Rep Introduction according to the Change of Broadcasting Advertising Sales System)

초록

정치권과 방송업계에선 미디어렙 도입에 관한 논의가 한창이다. 작년 11월 헌법재판소가 한국방송광고공사의 방송광고독점 판매에 대한 헌법불합치 판결을 내렸기 때문이다. 헌법재판소가 광고공사의 독점적 방송광고판매에 대한 위헌 결정을 한 근거는 광고공사가 출자한 회사에게만 지상파 방송광고 판매대행을 허용하는 것은 지상파 방송광고 판매대행 시장에 경쟁체제를 도입한 것으로 볼 수 없다는 것이다. 헌법재판소는 사실상 위헌이나, 지상파방송의 방송판매가 무질서한 상태에 빠질 것을 우려하여 헌법불합치 결정을 하기로 하고 광고공사의 독점개선 기한을 올해 말까지로 결정하였다. 미디어렙 제도는 국내 방송산업은 물론이고 광고산업에 미치는 영향이 매우 크기 때문에 신중히 다루어야 할 정책사항 중 하나이다. 바람직한 미디어렙 도입방안은 방송통신융합의 새로운 환경에 맞고 또한 우리 방송계와 광고계에 새로운 활력소가 되기 위해 국내 미디어렙 제도는 다수의 미디어렙이 경쟁하는 체제가 보장되어야 한다. 경쟁 미디어렙체제 도입에 있어서의 핵심은 헌법재판소의 결정대로 실질적인 경쟁이 보장되어야 한다. 그러나 당분간 미디어렙의 이종매체 판매는 유보하는 것이 좋을 듯하다. 이종매체간 광고영업 허용 시 지상파계열 매체의 연계판매를 통해 지상파로의 방송광고 쏠림현상 심화가 예상되기 때문이다. 현재 방송광고시장의 성장은 정체되어 있고 지상파의 독과점이 심한 현실에서, 이종매체 판매 권한은 신문과 취약매체를 약화시켜 결론적으로 미디어의 다양성을 훼손할 가능성이 있기 때문에 신중한 접근이 필요하다.

영어초록

Since the Constitutional Court’s ruling in November 2008 against the KOBACO's exclusive right of advertising sales for broadcasting stations, media rep introduction for broadcast advertising is under hot debate not only in the political circle but also in the Korean broadcasting industry. The rationale for the Constitutional Court’s ruling is that the current statute that an exclusive sales right should be granted only to the agents financed by the KOBACO cannot be viewed as a guarantee to allow for complete competition for broadcast advertising sales. In fact, the Constitutional Court viewed it as violation of the Constitution, but given the possibility that the market may be thrown into complete chaos, the decision of 'variance between the Constitution and the statute' was considered athropriate and, thus, amendment should be made until the end of this year. Considering its significant impacts upon the broadcasting and advertising industries, exceptional attention should paid to the development of media rep system. Basically, as reflected in the Consitutional Court's decision, our media rep system should fit with the changing environment surrounding our broadcasting and advertising industry, which is best characterized as the convergence of broadcasting and communication. In addition, it should be structured and developed to ensure full competition among a multiple number of participating agencies. While the most essential part of new media rep system must point to perfect competition, as directed by the Constitutional Court's decision, it is suggested that cross-media sales by media rep be prohibited for a while. Unbalance in advertising expenditures between network television and all other media is expected because of the possibility that cross-media sales will force a considerable shift in demand from other media to network television advertising. Considering the current status of Korean advertising media industry where network television outweighs all other media, cross-media sales may exacerbate the current status of newspapers and other media and, thus, damage to the diversity of media.
