초록

정부는 안전한 식품·의약품 등이 국민에게 공급되도록 관리할 의무를 진다. 이들 제품의 안전성을 확보하기 위해서는 제품의 인·허가 심사단계부터 시판 후 안전관리까지 전 주기에 걸쳐 과학과 근거 중심의 규제정책이 필수적이다. 이에 따라, 우리나라에서는 식품·의약품 등의 안전성, 유효성, 품질, 성능 등의 평가부터 인·허가 및 사용에 이르기까지 안전관리 전반에 관한 기술, 기준 및 접근방법을 다루는 규제과학이 도입되었다. 또한, 국내 규제과학 발전을 위한 법적 근거로서 기존의 안전기술법을 전부개정하여 규제과학혁신법을 발의하게 되었다.
본 연구에서는 규제과학혁신법의 제·개정 연혁과 규정별 주요 내용 분석, 규제과학혁신법의 입법적 가치 및 향후 나아가야 할 방향을 제안하였다. 규제과학혁신법의 핵심 내용은 규제과학의 개념을 정립하고 이를 법률에 도입하는 것이다. 이 법을 통해 혁신제품을 포함한 식품·의약품 등의 안전성, 효과성 등에 대한 새로운 평가기술과 기준을 개발하는 연구개발사업을 지원하고, 제품개발 초기 단계부터 제품화 성공률을 높이기 위한 제품화 지원 활성화와 관련 전문인력 양성의 법적 기반을 마련하였다. 또한, 규제과학의 범주에 의약품뿐만 아니라 식품과 위생용품 등을 포함하여 규제과학의 적용 대상을 분명히 하였다. 규제과학혁신법을 기반으로 규제과학이 식의약 산업의 경쟁력을 뒷받침할 수 있는 과학적 근거의 핵심이 된다면, 규제혁신 추진으로 식의약 산업이 활성화되고 국민의 안전한 제품 선택권이 더욱 확대될 것으로 기대한다.

영어초록

Governments must ensure that safe food, drugs, and other products are supplied to the public. To ensure the safety of these products, science and evidence-based regulatory policies are essential throughout the entire cycle, from the approval stage to post-market safety management. Accordingly, regulatory science has been introduced in Korea, which covers technologies, standards, and approaches to safety management, from evaluating the safety, efficacy, quality, and performance of food and drugs to their approval and use. In addition, as a legal basis for developing regulatory science in Korea, the Act on Regulatory Science Innovation for Supporting Food and Drug Safety and Commercialization(hereinafter the Regulatory Science and Innovation Act) was proposed by amending all existing Act on the Promotion of Technology for Ensuring the Safety of Food and Drugs.
This study analyses the history of the enactment and revision of the Regulatory Science and Innovation Act, the main contents of each provision, the legislative value of the Regulatory Science and Innovation Act, and the direction to be taken in the future. The core content of the Regulatory Science and Innovation Act is to establish the concept of regulatory science and introduce it into the law. The Act supports R&D projects to develop new evaluation technologies and standards for the safety and effectiveness of food and drugs, including innovative products. It lays the legal foundation for commercialization support to increase the success rate of commercialization from the early stages of product development and the training of related experts. It also clarifies the scope of regulatory science to include drugs, food, and hygiene products. Based on the Regulatory Science and Innovation Act, if regulatory science becomes the core of scientific evidence that can support the competitiveness of the food and drug industry, it is expected that the promotion of regulatory innovation will revitalize the food and drug industry and further expand the public's right to choose safe products.
