초록

우리나라는 전세계 가상자산 거래 국가 중에서 비교적 큰 규모를 갖춘 시장임에도 불구하고 기반이 되는 법제도 마련에 대한 정부의 소극적 입장으로 인해 가상자산산업은 아직 과도기를 겪고 있는 중이다. 2020년 3월에 개정된 가상자산사업자 신고에 관한 내용을 담은 특정금융정보법이 시행되면서 신고요건을 충족하지 못한 가상자산사업자의 줄폐업으로 인해, 해당 서비스를 이용하고 있는 투자자들의 손해와 일부 거대 거래소들의 가상자산시장 독·과점을 발생시킬 수 있는 바, 예측가능성 및 법적 안정성 확보 차원에서의 정부의 개입이 필요하다. 본 연구에서는 가상자산사업자 신고 요건에 관한 법적 쟁점사항을 도출하였으며, 가상자산사업자 신고의 성격과 그 요건, 적용시기의 적정성 여부, 금융기관의 실명확인계좌발급 업무가 고유의 업무인지 금융정보분석원에 의한 위임업무인지를 검토하였다. 또한 가상자산사업자 신고에 관한 규제 개선방안으로 투자자 보호 및 시장 독과점 예방 방안, 법적 안정성 보장을 위한 가허가제도의 도입, 금융위원회 또는 대통령 소속으로 가상자산사업관리위원회(가칭)를 신설하여 공식 가이드라인 및 집행 지침 배포를 통해 가상자산사업자 및 투자자의 예측가능성을 확보할 것을 제안하였다. 본 연구를 통해 가상자산사업자에 대한 적법·부당한 규제가 아닌 적법·타당한 규제가 이루어져 안전하고 투명한 가상자산의 거래 보장, 투자자 보호가 될 수 있기를 기대한다.

영어초록

Despite South Korea’s relatively large market among virtual asset trading counties around the world, the virtual asset industry is still undergoing a transition period, due to the government’s passive position on preparing the underlying legal system.
Despite the revision of the Specified Financial Information Act in March 2020, which contains information on virtual asset business report, until now, when it was implemented, most virtual asset operators were closed because they failed to meet the reporting requirment, and this can cause damages to investors using the service and monoplies in the virtural asset market of some large exchange. Therefore, government intervention is needed to secure predictability and legal stability. In this study, Legal issue related to the requirements for reporting virtual asset business operators were derived, the nature and requirement of reporting virtual asset business operators appropriateness of the timing of application and whether the financial institution’s issuance of real name verification accounts are unique or delegated by the Financial Information Analysis Institute were reviewed.
In addition, As measures to improve regulations on reporting virtual asset business operators measures to protect investors and prevent monoploy in the market, introduce a provisional permission system to ensure legal stability, and establish the virtual asset business management committee (tentative name) under the Financial Services Commission or the president to provide official guideliness. And it is proposed to secure the predictability of virtual asset business operators and investors through the distribution of enforcement guidelines. Through this research, It is hoped that safe and transparent transaction guarantees and investor protection of virtual assets can be achieved only when legitimate and vaild regulations are made, not legal and unfair regulation on virtual asset operator.
