초록

헌법재판소는 2023년 9월 26일 남북문제와 관련된 주요 결정 2건을 같은 날 선고하였다. 하나는 대북전단등 살포를 금지하고 위반 시 형사처벌하도록 정한 「남북관계 발전에 관한 법률」 조항에 대한 위헌결정이고, 다른 하나는 「국가보안법」상 이적행위조항 등에 대한 합헌결정(헌재 2023. 9. 26. 선고 2017헌바42등 결정)이다. 이 글은 그 중 대북전단금지 위헌결정(헌재 2023. 9. 26. 선고 2020헌마1724 결정)에 대해 평석하는 글이다.
헌법재판소는 대상결정의 심판대상조항이 단순히 남한 지역에서 북한 지역으로 전단등을 살포하는 것을 규제하는 표현의 방법 규제가 아니라 북한 정권에 대한 비판적 내용을 담은 대북전단등 살포를 금지하는 것, 즉 ‘표현의 내용’을 규제하는 조항이라고 보고 엄격한 위헌심사를 하였다. 그러나 심판대상조항의 제명이 ‘남북합의서 위반사항’임에도 이 부분에 대한 검토는 이루어지지 않았다. 대상결정에서 남북합의서 위반의 의미와 관련된 부분의 판단 공백은 헌법재판소가 관련 남북합의서의 법적 효력을 기존과 마찬가지로 인정하지 않겠다는 입장을 행간에 보여준 것이라 평가될 여지가 있다.
문제는 헌법재판소가 같은 날 선고한 「국가보안법」 사건에서는 ‘헌법 제3조의 영토조항의 해석상 북한은 반국가단체에 불과하다’고 명시하였다는 점이다. 이는 헌법재판소가 남북관계의 현실을 고려하여 북한을 반국가단체인 한편 대화와 협력의 동반자로 보며 이중적 지위를 인정해 온 기존의 입장과 차이가 있다.
결국 헌법재판소는 남북 간 합의서의 법적 효력에 대해서는 판단하지 아니하면서 북한의 법적 지위에 대해서는 ‘헌법 제3조 영토조항의 해석상 반국가단체에 불과하다’는 입장을 동시에 표명한 것인데, 최근 남북관계의 경색을 현실적으로 고려할 수밖에 없다 하더라도, 대북전단등 살포 금지 규정이 남북 간 합의서의 내용에 그치는 것이 아니라 그간 정권 교체에 따른 남북합의 불이행 및 폐기를 방지하고 지속성 있는 대북정책 내지 통일정책을 유지하기 위해 남북 간 합의에 규범력을 부여하고자 제정된 「남북관계 발전에 관한 법률」에 규정된 법률조항이라는 점에서 비판적 시각이 가능하다.
헌법재판소는 최고의 유권헌법해석기관이다. 우리 「헌법」은 제3조에 영토조항을 두고 있고 1987년 헌법 개정 시 제4조에 평화통일조항을 추가하였는데, 양 조항의 의미가 상반되기 때문에 「헌법」 제3조와 제4조의 관계에 대한 헌법재판소의 해석은 남북관계의 현실에 영향을 받기도 하고 반대로 미치기도 한다. 70년 이상의 분단의 역사 동안 남북관계는 수없이 화해와 갈등을 반복하며 부침을 겪어왔고, 이는 남북관계가 언제든 다시 화해와 협력의 관계로 전환될 가능성이 있다는 것을 의미하기도 한다. 따라서 남북관계 및 북한의 법적 지위에 대한 헌법재판소의 입장은 미래지향적으로 열려 있을 필요가 있다. 이에 이 글에서는 대상결정의 평석을 통해 대북전단등 살포 금지와 관련된 주요 남북합의서의 내용과 법적 효력에 대해 살펴보며 남북관계나 북한의 법적 지위에 대한 헌법재판소의 입장은 미래를 위해 열려 있을 필요가 있음을 짚어보았다.

영어초록

The Constitutional Court of Korea issued two major rulings related to North-South issues on September 26, 2023. One ruling was on the constitutionality of a provision in the “Inter-Korean Relations Development Act” that prohibits the distribution of anti-North Korean leaflets and imposes criminal penalties for violations. The other ruling upheld the constitutionality of the provisions in the National Security Act concerning acts of treason (Decision No. 2017Hun-Ba42, September 26, 2023). This article provides a commentary on the unconstitutionality ruling regarding the prohibition of anti-North Korean leaflets (Decision No. 2020Hun-Ma1724, September 26, 2023).
The Constitutional Court viewed the provision in question as not merely regulating the method of expression related to the distribution of leaflets from South Korea to North Korea but as a regulation of the content of expression that criticizes the North Korean regime. Consequently, the court applied a strict standard of judicial review. However, the court did not examine the implications of the provision’s title, which is “Prohibition of Violations of Inter-Korean Agreements.” The omission in the judgment regarding the meaning of violations of the Inter-Korean Agreement could be interpreted as an indication that the Constitutional Court intends to disregard the legal effect of such agreements.
The issue arises from the fact that in the National Security Act case decided on the same day, the Constitutional Court explicitly stated that “North Korea is merely an anti-state entity” in the interpretation of Article 3 of the Constitution, which concerns territorial integrity. This stance marks a departure from the court’s previous position that acknowledged North Korea’s dual status considering the realities of inter-Korean relations.
While the court was silent on the legal effect of Inter-Korean agreements in the leaflet ban ruling, it took a rigid and static stance in the National Security Act decision regarding North Korea’s legal status, which has been a major obstacle in peace treaty negotiations. This stance, despite the practical need to consider the current tensions in inter-Korean relations, is open to criticism from the perspective of efforts by the government and legislative bodies to establish normative power for Inter-Korean agreements and maintain consistent North Korean policies.
As the highest authority in constitutional interpretation, the Constitutional Court’s interpretation of Article 3 (territorial provisions) and Article 4 (peaceful unification provisions) of the Constitution reflects and impacts the reality of inter-Korean relations. Over the 70 years of division, inter-Korean relations have oscillated between reconciliation and conflict, suggesting the possibility of a future shift towards reconciliation and cooperation. Therefore, the Constitutional Court’s stance on inter-Korean relations and North Korea’s legal status should remain forward-looking. This article examines the implications of the ruling on the prohibition of anti-North Korean leaflets and discusses the need for the court’s perspective on inter-Korean agreements and North Korea’s legal status to remain open to future developments.
